Graham Hallett ANO REVIEW CONSULTATION The CAA has published its response to the recent consultation about Air Navigation Order changes which aim to provide a simpler and more proportionate legal basis for the regulation of those GA activities that fall under national (and not European) regulation. The response, CAP44, at CAP44, addresses all of the policy decisions considered in the review process, and sets out which will be taken forward into the new ANO 206. The BBAC supports the CAA s approach to proportionate, risk-based regulation. SOUTHEND REVIEW The CAA is carrying out the long-awaited review of the Southend ACP. Info available at Pilots Circular

2 UK PPL(B) LICENCE APPLICATION The CAA have informed the BBAC that recent PPL(B) licence applications and log books have contained errors that has led to additional work and delays in the issue of licences. This does not reflect well on the BBAC, when we are working with the CAA towards approval as a formal training organisation from April 208 under EASA requirements. The PPL(B) application form has guidance notes and we would strongly request that any Instructor, Examiner or pilot who gives training to a student, reads the guidance notes and assists the student pilot in completing their paperwork correctly. Often another pair of eyes will spot something that the student has missed. On completion of training, a student pilot needs to send the following to the CAA: Red pilot log book - Before sending this, the student will need to ensure that all training exercises (-20) have been completed at least once with a BBAC Instructor, recorded in the remarks column and signed by the Instructor, with the Instructor's licence number. These flights must be clearly annotated Instructor Flight. Any training flights with other (non-instructor) pilots should also have the exercises listed and signed by the pilot giving the training, with his/her licence number. All training tethered flights must also be recorded. If any exercises are not listed and /or signed, the CAA will return the application for further training. 2. Licence application form completed by the Student and the Examiner 3. Passport or Birth Certificate - a certified copy signed by a CAA Balloon Examiner is acceptable for this, provided that the examiner has actually seen the original and that he/she certifies the copy with the exact wording required by CAA. 4. Payment form FCS 500 and fee (currently this is 83 see CAA Scheme of Charges) 5. Do not send the BBAC Pilot Training Record (blue student log book) to the CAA this is a record of your BBAC training and this should be sent by your examiner to the BBAC Training Officer, who will analyse and record the training info. Your BBAC Pilot Training Record will then be sent back to you. English Language Proficiency (ELP) Certificate You will need to have an ELP when you apply for an EASA Licence in the future but the ELP can only be issued when you have a CAA licence number. When you have your CAA licence, contact a UK CAA appointed (and UK based) Balloon Examiner who will conduct a simple, ground-based assessment of your English skills for a level 6 proficiency endorsement. If you are not of Level 6 standard [natural English speaker] only a recognised language school can assess you for other ELP levels. UK appointed examiners may not assess overseas based candidates nor candidates holding a Part- FCL licence issued by any other EASA state, without first meeting a number of additional requirements. 4 CAA LICENCE SUSPENSIONS More info that the CAA has announced that, with immediate effect, pilots who infringe controlled airspace could have their licences provisionally suspended while the incident is assessed if it is deemed sufficiently serious. The criteria used to determine the level of seriousness of a particular infringement has also been published in CAP404 at Following a recent incident at the beginning of the flying season, when a Red Arrows display was severely disrupted because of an infringement, the CAA has already provisionally suspended the licence of a pilot. PART-NCO BECOMES LAW Part-NCO (non commercial operations) becomes law in the UK on 25 August 206. The attached documents have just been published by the CAA for general guidance and further information may be found at Part-NCO is actually Annex VII of the Air Operations Regulations [(EU) 965/202] and its full title is Non-Commercial Air Operations with Other-Than Complex Motor-Powered Aircraft. With this title it may appear that this would not apply to balloons, but, as the wording of the actual regulation makes clear, balloons (and sailplanes) are indeed covered by this part. However, the EASA Committee voted positively on a legislative proposal which included, inter alia, the postponement of the applicability of the Air OPS rules for operation with balloons until 8 April 208 (and for sailplanes until 8 April 209). An explanation of the process might help you understand that this is an important step in a complex process, referred to as the comitology process as it involves it passing through a number of committees. Once a legislative proposal is voted by the EASA Committee (which is capturing the will of the member states) it is forwarded to the European Council and European Parliament, which have 3 months to exercise their right of scrutiny (sort of a veto). Once the proposal returns from the European Parliament (hopefully without any comments or objections) it will be adopted by the European Commission and published in the Official Journal thus becoming EU law. The whole process takes up to 6 months (after the vote in the EASA Committee) and the European Parliament scrutiny period expires on 5 July 206. EASA has recently contacted their colleagues in the European Council and they have been informed that they are striving to have the amending Regulation adopted and published by 22 July 206. So, in summary, non-commercial balloon air operations in the UK are expected to remain under UK national [Air Navigation Order] rules until 8 April 208 (the same date that Part-FCL for balloons will be implemented) provided that the above mentioned amending Regulation is adopted and published, at least by 25 August 206. Commercial balloon operations will also continue to be under UK national regulations (ANO) until 8 April 208. Pilots Circular 4

Over the past year they have added new content and features to their new GA product in line with customer feedback, and are delighted that the number of registered users is continuing to grow.
