3 CCAR General Each certificate holder shall, in its operation under this part, ensure that its crewmembers comply with the applicable duty period limitation, flight time limitation and rest requirement of this chapter. No individual who does not comply with this chapter may act as a required crewmember in operations under this part. (a) The terms used in the chapter are defined as following: Term Definition Approved Sleeping Area refers to a place approved by CAAC authority and designated for crewmembers to have a good sleep. Calendar Day Duty Period Rest Period Operational Delay refers to the time in accordance with UTC or local time division, from 00:00 to 23:59; refers to a consecutive period of time starting from the moment a crewmember reports for duty upon receiving flight tasks assigned by the certificate holder (exclude the time taken from his/her residence location or base to the report location) to the moment his/her duty is relieved. In the event of an operational delay within a duty time, sleeping time is not calculated as duty time if the crewmember can have a rest in a place where sleeping facility is available. refers to a consecutive period of time starting from the moment a crewmember arrives at the rest place to the moment he/she leaves rest place for the next assignment. No certificate holder may arrange work for him or disturb his/her rest during the rest time. The time taken for his/her flight as an occupant for the completion of his/her assigned flight task between the residence base and duty location may not be included into the duty time of this duty period; refers to a delay due to such objective factors as bad weather conditions, airplane equipment malfunctions, ATC problems. (b) In this chapter, flight time of a crewmember refers to the duty time including in-seat flight time (time for flight experience) and non-in-seat flight time. Page 3

4 CCAR Pilot duty period limitation, flight time limitation and rest requirement (a) In a two-pilot crew, each pilot shall meet following requirements for duty period, flight time and rest period: (1) Each pilot may be scheduled for a duty period of no more than 14 hours within which flight time may not exceed 8 hours. For a flight with no more than 2 legs, flight time can be extended to 9 hours. Each pilot shall be given a rest period of at least 10 consecutive hours after duty period, but regarding to the time for the occurrence of relieving flight task is after midnight at the local time, 12 consecutive hours of rest period shall be scheduled, and this rest period shall occur between the completion of the scheduled duty period and the commencement of the subsequent duty period. (2) In the event of an operational delay, the rest period subsequent to the duty period can be reduced to 9 hours if the actual duty time of the pilot does not exceed the time limit of 14 hours. (3) In the event of an operational delay, the duty period of the pilot may be extended to no more than 16 hours. In that case, the 10-hour rest period subsequent to the duty period may not be reduced. (b) In a three-pilot crew including a second pilot in command who meets the stipulation of (a) in , each pilot shall meet following requirements for duty period, flight time and rest period: (1) Each pilot may be scheduled for a duty period of no more than 16 hours within which flight time may not exceed 10 hours. For a flight with no stopover, flight time can be extended to 12 hours. Each pilot shall be given a rest period of at least 14 consecutive hours after duty period, and the rest period shall occur between the completion of the scheduled duty period and the commencement of the subsequent duty period. (2) In the event of an operational delay, the rest period subsequent to the duty period can be reduced to 12 hours if the actual duty time of the pilot does not exceed the time limit of 16 hours. (3) In the event of an operational delay, the duty period of the pilot may be extended to no more than 18 hours. In that case, the 14-hour rest period subsequent to the duty period may not be reduced. (c) In a three-pilot crew including a second pilot in command who meets the stipulation of (a) in and an approved sleeping area is provided for flight crew, each pilot shall meet following requirements for duty period, flight time and rest period: (1) Each pilot may be scheduled for a duty period of no more than 18 hours within which flight time may not exceed 14 hours and each pilot shall be provided with the chance to rest at the approved sleeping area. Each pilot shall also be given a rest period of at least 18 consecutive hours after duty period, and the rest period shall occur between the completion of the scheduled duty period and the commencement of the subsequent duty period. (2) In the event of an operational delay, the rest period subsequent to the duty period can be reduced to 16 hours if the actual duty time of the pilot does not exceed the time limit of 18 hours. (3) In the event of an operational delay, the duty period of the pilot may be extended to no more than 20 hours. In that case, the 18-hour rest period subsequent to the duty period may not be reduced. (d) In a four-pilot crew including a second pilot in command who meets the stipulation of (a) in ,, each pilot shall meet following requirements for duty period, flight time and rest period: (1) Each pilot may be scheduled for a duty period of no more than 20 hours within which flight time may not exceed 17 hours and each pilot shall be provided with the chance to rest at the approved sleeping area. Each pilot shall also be given a rest period of at least 22 consecutive hours after duty period, and the rest period shall occur between the completion of the scheduled duty period and the commencement of the subsequent duty period. (2) In the event of an operational delay, the rest period subsequent to the duty period can be reduced to 20 hours if the actual duty time of the pilot does not exceed the time limit of 20 hours. (3) In the event of an operational delay, the duty period of the pilot may be extended to no more than 22 hours. In that case, the 22-hour rest period subsequent to the duty period may not be reduced. Page 4

6 CCAR Navigator, flight engineer and flight radio operator duty period limitations, flighttime limitation and rest requirements (a) If a crew includes one navigator, one flight engineer or one flight radio operator, either of the following two types of arrangements is acceptable: (1) Each crewmember may be scheduled for a duty period of no more than 14 hours within which flight time may not exceed 9 hours. Each crewmember shall be given a rest period of at least 10 consecutive hours after duty period, and the rest period shall occur between the completion of the scheduled duty period and the commencement of the subsequent duty period. In the event of an operational delay, (i) The rest period subsequent to the duty period can be reduced to 9 hours if the actual duty time of the navigator, flight engineer and flight radio operator does not exceed the time limit of 14 (ii) hours. The duty period may be extended to no more than 16 hours. In that case, the 10-hour rest period subsequent to the duty period may not be reduced. (2) Each crewmember may be scheduled for a duty period above 14 hours but below 16 hours within which flight time may not exceed 12 hours. Each pilot shall be given a rest period of at least 14 consecutive hours after duty period, and the rest period shall occur between the completion of the scheduled duty period and the commencement of the subsequent duty period. In the event of an operational delay (i) (ii) The rest period subsequent to the duty period can be reduced to 12 hours if the actual duty time of the navigator, flight engineer and flight radio operator does not exceed the time limit of 16 hours. The duty period may be extended to no more than 18 hours. In that case, the 14-hour rest period subsequent to the duty period may not be reduced. Page 6

7 (b) If a crew includes two navigators, two flight engineers or two flight radio operators, either of the following two types of arrangements is acceptable. (1) Each crewmember may be scheduled for a duty period above 16 hours but below 18 hours within which flight time may not exceed 14 hours and each crewmember shall be provided with the chance to rest at the approved sleeping area. Each crewmember shall be also given a rest period of at least 18 consecutive hours after duty period, and the rest period shall occur between the completion of the scheduled duty period and the commencement of the subsequent duty period. In the event of an operational delay, (i) The rest period subsequent to the duty period can be reduced to 16 hours if the actual duty time of the navigator, flight engineer and flight radio operator does not exceed the time limit of (ii) 18 hours. The duty period may be extended to no more than 20 hours. In that case, the 18-hour rest period subsequent to the duty period may not be reduced. (2) Each crewmember may be scheduled for a duty period above 18 hours but below 20 hours within which flight time may not exceed 17 hours and each crewmember shall be provided with the chance to rest at the approved sleeping area. Each pilot shall be given a rest period of at least 22 consecutive hours after duty period, and the rest period shall occur between the completion of the scheduled duty period and the commencement of the subsequent duty period. In the event of an operational delay, (i) (ii) The rest period subsequent to the duty period can be reduced to 20 hours if the actual duty time of the navigator, flight engineer and flight radio operator does not exceed the time limit of 20 hours. The duty period may be extended to no more than 22 hours. In that case, the 22-hour rest period subsequent to the duty period may not be reduced. 8 CCAR Flight crewmember flight time limitations in days, weeks and years Each certificate, while arranging flight tasks for flight crewmembers, shall ensure that the total flight time (including operations under this part and other operations such as training, positioning flight, private and exercise flight) of each flight crewmember does not exceed: (a) 40 hours in any 7 consecutive calendar days; (b) 100 hours of total flight time in any 1 calendar month; 270 hours in total in any continuous 3 calendar months; (c) 1000 hours in any calendar year; Period Limit 7 Consecutive Calendar Days Calendar Month 3 Consecutive Calendar Months 40:00 100:00 270:00 Calendar Year 1000:00 CCAR Additional limitations for crewmember duty period and flight time schedule (a) A flight crewmember is not considered to be scheduled for duty in excess of duty period limitations if the flights to which the flight crewmember is assigned are scheduled and normally terminate within the limitations, but due to operational delays, are not at the time of departure expected to reach their destinations within the scheduled time. However, the extension cannot exceed 2 hours in line with and of this part. (b) A flight crewmember is not considered to be scheduled for flight time in excess of flight limitations if the flights to which the flight crewmember is assigned are scheduled and normally terminate within the limitations, but due to operational delays, are not at the time of departure expected to reach their destinations within the scheduled time. (c) In case a flight crewmember is on duty for several air carrier or in several kinds of operations, the total of his/her duty period and flight time shall meet the duty period and flight time limitation specified in this part. (d) The standby time of a crewmember due to a delay before takeoff is calculated as duty time. Page 8

9 CCAR Flight attendant duty period limitations and rest requirements (a) No certificate holder, while assigning minimum flight attendants specified in of this part, may not schedule a flight attendant on duty for more than 14 hours. Each flight attendant shall be given a rest period of at least 9 consecutive hours after duty period, and the rest period shall occur between the completion of the scheduled duty period and the commencement of the subsequent duty period. (b) Following requirements shall be met if a certificate holder assigns one or more flight attendants in addition to the minimum flight attendants specified in of this part: (1) Duty period may not exceed 16 hours If the certificate holder adds 1 flight attendant; may not exceed 18 hours If the certificate holder adds 2 flight attendant; may not exceed 20 hours If the certificate holder adds 3 or more flight attendants. (2) Each flight attendant shall be given a rest period of at least 12 consecutive hours after being on duty for more than 14 hours, and the rest period shall occur between the completion of the scheduled duty period and the commencement of the subsequent duty period. (c) A flight attendant is not considered to be scheduled for duty in excess of duty period limitations if the flights to which the flight attendant is assigned are scheduled and normally terminate within the limitations, but due to operational delays, are not at the time of departure expected to reach their destinations within the scheduled time. 10 CCAR Additional rest requirements for crew members (a) No certificate holder may assign any work to a crewmember in his/her rest period, nor may this crewmember accept any such assignment. (b) The rest period required under this chapter can be included in other rest periods. (c) A rest period can be reduced only in the event of operational delays in accordance with and , and no prior arrangement is permitted. (d) Each certificate holder shall arrange a rest period of at least 36 consecutive hours for a crewmember that has been scheduled for one or more duty periods within any 7 consecutive calendar days. (e) The time for other assignments given by each certificate holder to a crewmember can be calculated as or not as duty time. If the time is not calculated as duty time, the crewmember shall be given a rest period of at least 8 hours before the commencement of duty period. (f) If the time difference between the destination of the flight and the base of crewmember is 6 hours or more, the crewmember shall be given a rest period of at least 48 consecutive hours before the commencement of next duty period. The base in this paragraph is the place that the certificate holder designs as the domicile of the crewmember and the place where the crewmember is scheduled for duty. (g) The time spent on the way of the crewmember's being sent to the airport to begin his/her duty or to his/her domicile from the airport shall not be regard as part of his/her rest period. 11 Annex A Definitions Cabin Crew/Flight Attendant: For the sake of passenger safety considerations, by the certificate holders assigned to the crew in the cabin to perform duty tasks on the crew members. Calendar Month: Refers to the time in accordance with the coordination of the world or local time, from 00:00 the first day to 23:59 the last day of this month. Captain: A pilot who is ultimately responsible for the operation and safety of an aircraft during flight time, as specified by the certificate holder. Crew Members: Aircraft personnel who perform missions on an aircraft during flight, including flight crew members and cabin crews. Deviation: for the provisions of the rules clearly allow the deviation, the certificate holder in the appropriate reasons and to prove that the same level of security can be achieved, approved by the Bureau, you can not comply with the provisions of the corresponding provisions or to comply with the provisions of the alternative, conditions Or limited.
