1 As a Member of the European Union, SES Regulations are binding and direct/ applicable to the Slovak Republic. As referred to in Article 7(2) of the Airspace Regulation (EC) o 551/2004 and Article 8 of Regulation (EC) o 2150/2005, and further to the formalised request of the Commission to EUROCOTROL dated 31 Jul 2008, Chapter 7 of SK LCP below fulfils the Slovak Republic's obligation to report to the European Commission on the application of the concept of the flexible use of airspace in respect of the airspace under its responsibilif for the period from 1 st Jul 2007 till 31 st December Director General General Directorate of Civil Aviation and Water Transport Chapter 7 - Annual Report on the Application of FUA FUA Level1 High Level Airspace See below Polic Bod: t has been processed b the inter-ministerial commission, created in accordance with the aviation law. This commission consists of representative of MoT, CM, ASP as well as MoD. t is responsible for national airspace management polic and evaluation of its effectiveness. To ensure the process of reliabilit of Slovak airspace usage, there are coordination meetings organised eve r month b chief of AMC (or his deput), with participation of all inter ministerial commission representatives and airspace users. Measures established to - ASM and ATFM: Y Procedures for AMC operations ensure consistenc between: - ASM and ATS: Y Procedures for AMC operations The State has notified the Commission the identified Y Date and persons/organisations responsible for all the tasks listed in Art. Reference of the 4.1 of the FUA Regulation: Communication: The State has ensured that the following tasks related to ASM Level 1 are performed b the responsible bod (referred to above): - Regularl review and address users' requirements Published principles for ASM of Slovak Republic - Approve activities which require airspace reservation or restriction Monthl coordination meeting resulted to minutes, which are mandator for AMC, AMC procedures within its approved rulebook. - Define temporar airspace structures and procedures to ofter multiple airspace reservation and route options AMC through their AMC procedures within its approved rulebook.

Establish criteria and procedures providing for the creation and use of adjustable lateral and vertical limits of the airspace We have in place onl fixed lateral and vertical limits - while our TSA and TRA allows to AMC define vertical limits when the TRAlTSA are allocated - Assess the national airspace structures and route network with the aim of planning for flexible airspace structures and procedures Done mainl with regards of route structure, For airspace plan ned for next ear - Define specific conditions under which the responsibilit for separation between civil and militar flights rests on the ATS units or on the controlling militar units 3 levels of coordination, which is declared b OAT sector (militar unit) and which is depending on the militar traffic nature: - onl militar unit is responsible for ensuring separation between GAT and OAT traffic. o specific conditions are established. 3 levels of coordination: Traffic with coordination (whole FR, militar is responsible for separation between OAT and GAT traffic) the all traffic information are provided top militar unit including the approval for descent, climb or vectoring the GAT traffic outside ATS route. Traffic with limited coordination (certain area of FR, same principie as above) o coordination (normal civil operation, with no OAT traffic), but the militar unit is provided with all data - Establish mechanisms to assess performance of FUA operations Based on feedback during coordination meetings there was no need for this mechanism. There is alread in place evaluation of activation and actual using of TSAlTRLZR, plan for establishment such a mechanism is for the next ear. o assessment has been performed while it is known that some TSAlTRA are used rarel, while planned to use frequentl - Based on the outcome of this assessment, periodicall review and revise as necessar, airspace procedures The review has not been performed et. - Establish mechanisms to archive data on the requests, allocation and actual use of airspace structures for further analsis and planning activities AMC based on their responsibilities has to keep and maintain manuall all statistics regarding requests for allocation and actual use of airspace structures. The State has abandoned application Y There are no permanent airspace restrictions in place if there is of permanent airspace restrictions: a requirement, and th en it has to be submitted to coordination meeting, and based on outcomes from this meeting restrictions are published via OTAMs. Changes since previous o changes FUA Level2 Airspace Management Cell-AMC: Joint Civil Militar Cell: Level 2 is executed b the AMC (Airspace management cell), which is responsible for collecting and analzing the AMC manageable airspace usage requests as well as AUP message publishing. The airspace is allocated in accordance with the conditions Partl, not all conditions are met. and procedures defined in Article 4.1: The established AMC (referred to above) is provided with adequate supporting sstems to perform and communicate the pre-tactical airspace management tasks: Y AFT, FAX, Recorded phones, LETVS Changes since previous o changes

3 FUA Level3 Y The AMC Unit: - collects information of activation, interruption and deactivation of AMC manageable airspace, - transmits actual information of AMC manageable airspace usage to civil and militar ACC, - publishes UUP message. The coordination between civil and militar ATC units is carried out according to Control and coordination letter of agreements. The State has ensured that the relevant ATS Units and controlling militar units: - establish coordination procedures and communication facilities to allow the real-time activation, deactivation or reallocation of airspace allocated at pre-tacticallevel: The coordination between Givi and militar ATC units is carried out according to Control and coordination letter of agreements and there is a direct phone line between the supervisors in dut on the ACC Bratislava and OAT sector, but there is no direct communications facilities between ATS Units and GC - establish coordination procedures to ensure the timel and effective exchange of an Y modification of planned airspace reservations and the adequate notification to all affected users: AMC procedures for publishing AUP and UUP, procedures published in AP, and OTAMs and procedures for real activation and deactivation i - establish coordination procedures and supporting sstems to ensure safet when managing Y interactions between civil and militar flights: The coordination between civi! and militar ATC units is carried out according to Control and coordination letter of agreements.oat sector is part of LPS SR (AS provider). - establish coordination procedures to permit direct communication of relevant information to resolve specific traffic situations where civil and militar controllers are providing services in the Y same airspace: Specificall - Position of aircraft radar data exchange and automatic flight plan data exchange : - Flight intention of aircraft Voice exchange between OAT sector and ACC Bratislava A airspace reservations are released as soon as activities having caused their establishment Y cease: Part of internal procedures of AMC, dut officer at AMC has to inform involved parties about status of airspace reservation.
