This service will be for use by all New York State employees of The Executive, Legislative and Judicial Branches of government including *New York State Public Authorities and Boards. Political subdivisions are eligible to utilize contract service only as agreed by individual bidders (see Attachment 1, Entities Previously Approved For Use of New York State Air Travel Centralized Contract). Some replacement air travel contracts may include the use of contract services by "Previously Approved Entities" at either the same or increased contract costs. Travel tickets are 100% refundable with no minimum stay or other purchase requirements and contract airfares are not subject to charges for exchanging tickets. * All New York State Public Authorities, Boards and other entities not utilizing the New York State Office of the State Comptroller designated payment mechanism are required to utilize the New York State Contract Travel Agent (Group 79005), or authorized travel agent participating in the NYS travel program, to schedule all contract travel. Unrestricted Fare Unrestricted fares (e.g., no Saturday night stay, etc.) are listed for all city pairs. These fares are available on a last seat availability basis with no advance purchase requirement or other restrictions (e.g. no Saturday night stay, etc.). These fares may be used for last minute travel or instances when other restrictions (e.g. advance purchase, minimum stay or Saturday night stay) are not conducive to business plans. Capacity Controlled Fare Capacity Controlled Fare shall mean fares with no advance purchase requirements, or penalties for changes and /or nonrefundable restrictions. Unrestricted guaranteed capacity shall be forty (40) percent per flight of available aircraft seats applicable to total aircraft capacity.

4 Group AIR TRAVEL SERVICES 2001 AWARD Page 4 The Air Travel contracts are intended to be utilized in conjunction with New York State contract Travel Agents available under Group or authorized travel agents participating in the NYS travel program. This service will be for use by all New York State employees of The Executive, Legislative and Judicial Branches of government including *New York State Public Authorities and Boards. Some contract airline fares are extended to "Previously Approved entities" (see attachment 1) at either the same or increased costs. * All New York State Public Authorities Boards and other entities not utilizing the New York State Office of The State Comptroller designated payment mechanism are required to utilize the New York State American Express Corporate Procurement Card (Group 79008) for payment and a New York State contract Travel Agent (Group 79005), or authorized travel agent participating in the NYS travel program, to schedule all contract travel. All rates are available for business use only. PROCUREMENT INSTRUCTIONS: A. Authorized entities will review the list of rates and services (city pair rates) that best fit their needs. B. We require agencies to contact (usually by telephone) one of the New York State designated travel agent contractors, or an authorized travel agent participating in the NYS travel program, for reservations. C. Agency shall provide the travel agent or airline with the necessary traveler and designated contract payment information. These orders are effective and binding on the contractor when presented. City Pair Use Instructions To determine contract information for air travel, lookup travel segment by Departure City (any city or airport noted in city pair may be utilized as a departure city). City pairs are arranged on the following pages alphabetically as indicated below: Primary alphabetization is by the New York State Departure City. Secondary alphabetization is by the Destination City. All fares are for one way travel.

"Aircraft" shall mean aircraft having nineteen (19) or more passenger seats with restroom facilities. C. "Airport Code" shall mean the three-letter code that identifies the specific points of origin and destination for each item. D. "Average Elapsed Flight Time" shall mean the average of the shortest flights for that city pair/item meeting the minimum number of flights per day. E. "Capacity Controlled Fare" shall mean fares with no advance purchase requirements, no penalties for changes and completely refundable under the computer reservation system code designated by the contractor. Unrestricted guaranteed capacity shall be forty (40) percent per flight of available aircraft seats applicable to total aircraft capacity. F. "Centrally Billed Account" shall mean the designated New York state centrally billed travel account(s), currently under New York State contract. The current designated Centrally Billed Account provider is American Express Corporate Travel. G. "Certificated Air Carrier" shall mean an air carrier holding a Certificate of Public Convenience and Necessity granted under Section 401 of the Federal Aviation Act. H. "Commuter Air Carrier" shall mean an air carrier under Section 204 or 298 of the Economic Regulations of the United States Department of Transportation carrying passengers on at least five round trips per week between two points according to its published schedules, but which does not hold a Certificate of Public Convenience and Necessity granted under Section 401 of the Federal Aviation Act. I. "Daily Flights" shall mean everyday from Monday through Friday. J. "Domestic" when applied to city pairs in this solicitation shall mean all city pairs within the fifty states, the District of Columbia, the United States Virgin Islands and the Commonwealth of Puerto Rico. K. "Eligible Travelers" shall mean employees of The New York State Executive, Judicial and Legislative Branches of government, The State University of New York, New York State Public Authorities and Boards, who are traveling on official State business, and whose travel expenses are paid by the official payment instrument. Specifically included are New York State Department of Health Board members when travelling on board business when travel is paid with the contract method of payment. Specifically excluded unless indicated by individual contractors (see previous page of this Contract Award Notification) are all contractors from government or private sector employed by New York State under cost reimbursable contracts; and persons travelling for New York State employment interview purposes at any eligible entity. L. "Excursion" shall mean round trip stay over Saturday night, ticket with at least 7 day advance purchase. In some instances advance purchases are made 14 or 21 days in advance in order to obtain better fare prices. M. "FAA" shall mean the Federal Aviation Agency. N. "Federal Aviation Act" shall mean the Federal Aviation Act of 1958 and any applicable statutory changes incorporated. O. "Invitation For Bid (IFB)" shall refer to this proposal and the resultant submission of a Contractor s bid for performance and later, the awarded contracts. P. "International" when applied to city pair routes in this solicitation shall mean a domestic city point and a foreign city point of destination. Q. "Kennedy, LaGuardia and Newark airports" shall mean New York City airport location for the City Pairs designated in the bid proposal form of this solicitation R. "Passenger Facility Charges" shall mean mandatory fees assessed by airports / or cities which airlines are mandated to collect for these entities. S. "Pre-Paid Ticket Charges" shall mean air travel contract service charges paid by a using entity at a site remote from the ticket pickup location.

"Y Class" shall mean unrestricted fare with last seat availability or other booking codes used by contractors to designate normal unrestricted coach class seats with no minimum stay or other purchase requirements and no additional cost for change or refund. U. "YCANY" Shall mean the New York State designation for Y Class fares under this contract. STATUTORY REQUIREMENTS: All contractors shall be a Certified Air carrier or Commuter Air Carrier recognized by the United States Department of Transportation and other applicable regulatory agencies. Any contractor offering a city pair shall have received United States Department of Transportation certification to provide scheduled service between the cities designated and shall have tickets for sale to the general public by the date and time of bid opening. SERVICE REQUIREMENTS: Travelers of eligible purchasing entities shall not be subject to any additional purchase or use restrictions except as noted under each category below. Contract passengers shall be provided all services and considerations which are provided to the general public including but not limited to toll-free reservations and ticketing, inter-airline agreements, standard free baggage allowance, food and beverage service and compensation for denied boarding. DAILY FLIGHT FREQUENCY: All domestic item/city pairs meets the minimum number of flights Monday - Friday in each direction between the hours of 6:00 A.M. and 10:15 P.M. in accordance with the estimated yearly use level indicated below: Estimated Yearly Travel Segments Minimum Number of Flights Per Day 900 or more or less 2 International Item/city pairs have one (1) minimum flight scheduled daily, Monday through Friday. Where no bids were received meeting daily flight frequency requirements New York State awards contracts to offers for city pairs with fewer scheduled flights or more stopovers. STOP-OVERS: Domestic city pair connecting flights shall have maximum two (2) hour cumulative stopover; and international city pairs shall have three hours (3) maximum cumulative stopover. RESERVATIONS AND TICKET SALES: Reservations and tickets shall be available through one of the New York State contractors of record on the NYS Travel Agent Services contract, or authorized travel agents participating in the NYS travel program. All item/city pricing shall include the total cost excluding Passenger Facility Charges (PFC), segment fees and other ancillary fees but including taxes, fees, commissions or prepaid ticket charges. Passenger Facility Charges (PFC) and segment fees or other ancillary fees assessed by political entities and collected by airlines normally passed through to corporate and public customers may be assessed at the time of ticketing.
