7 Children injured on 12,000 children are injured each year on farms and ranches 40% of injured children are visiting An injury can, and often does, result in damages to farm & impacts insurance Owners/operators must ensure the safety of guests

9 Girl breaks ankle visiting farm A 14 year old girl was visiting a fruit stand on the side of the road There was a path from the driveway where they parked leading to the stand On the way back to the vehicle, the girl stepped in a hole in the path and broke her ankle Note: Similar incidents on PYO
10 What questions do you have? Did she stay on the path? Was the path clearly marked? Was the path inspected regularly for holes, garbage and other hazards? Was it dark? Was the path lighted? Was she paying attention?
11 What were the consequences? Patient sued the agritourism operation No follow up available on the lawsuit
12 Could this have been prevented? All walkways and paths should be smooth & level Check every day for new holes/hazards Inspect regularly for garbage/debris Clearly mark all walkways (signs)

14 Accident at Corn Maze Haunted corn maze Visitor paid enhanced admission fee to enter scarier half of maze Employee dressed as Jason with chainsaw Woman spooked by Jason broke her leg when she started to run & slipped in the mud
15 What questions do you have? Was there a sign posted with rules or any other signage? Was information provided that indicated what the scarier half of the maze entailed? Was the woman drinking or under the influence of drugs?
16 What were the consequences? Woman sued Lost the lawsuit She had paid to enter scarier part of maze It was obvious the ground was muddy Insurance Owner informed insurance of activity prior to incident Would have been covered if lost the lawsuit
17 1 Killed, 21 Injured on Hayride Jeep towing a wagon Jeep careened down a hill, the trailer jack-knifed and crashed into a tree Every person on ride was injured 17 year old girl killed
18 What questions do you have? How steep was the hill? Why did the jeep careen down the hill? How much driving experience does the driver have? Had the driver been drinking?
19 Other Questions Was the jeep properly maintained? What type of wagon was used? Was the wagon overloaded? Note: it was determined in follow up that there was a mechanical malfunction in the jeep.
20 Prevented? Hayride routes should avoid steep grades Tractor should be powerful enough to easily pull loaded wagon Experienced drivers only Regular maintenance of all equipment Tractors and wagons checked before every hayride Wagon should have railings and seating
21 Consequences Maine farm indicted in fatal hayride accident; owner files for bankruptcy Harvest Hill Farms is charged with manslaughter, aggravated assault, driving to endanger and reckless conduct. Driver and mechanic face misdemeanor charges.
22 10 Visitors Sickened at Petting Zoo Petting zoo and pumpkin patch Illness traced back to the farm Lab tests confirmed 5 cases of E. coli 5 others (mostly children) also suffered gastrointestinal symptoms after visiting Hand sanitizers were present next to animal area, but no handwashing facilities
23 What questions do you have? Were there signs posted warning visitors of the illness hazards? Was the petting zoo set up so traffic is one way? Were the buildings and stalls cleaned regularly? Were the animals kept clean?
24 Could this have been prevented? Petting zoo traffic flows in a one way pattern. Handwashing stations with soap and warm running water are available at the exit. Handwashing signs posted by the station. Buildings and stalls regularly cleaned and sanitized. Animals are clean, healthy and up to date on all vaccinations.
25 Prevented Signs at the entrance should warn visitors that there is no eating or drinking allowed. A garbage can is available to discard food and drink. Cups, bottles, pacifiers or toys should not be allowed in animal areas.
26 8 year old injured in fall 8 year old girl fell from a slide. She suffered a serious head injury.
27 What questions do you have? Was there ground cover? Not a sufficient amount/depth Was she playing on the equipment correctly? Was she being supervised closely? Her mother took her to the park. Unknown how closely she was watching her daughter
28 Could this be prevented? Adequate ground cover is installed and checked/replenished regularly. Signs should be posted with rules and appropriate ages listed Children need supervision in play areas
29 Play Areas should also Shaded areas for relief from the sun Warming shed, if open in winter Free from dust and wind hazards Distant from loud noises At least 75 feet from parking areas/traffic
30 Questions How do I know what to look for? How do I see it, when I walk by it every day? I found it, now what do I do about it? OR Do I need to bother with all this? After all, we have an agritourism liability law.
31 Protected by law? I posted the sign I m protected by the liability law, right?
32 Need more than a sign The law protects against inherent risks of agritourism activities doesn t protect willful or wanton disregard for safety of participant intentionally injures the participant
33 willful or wanton disregard Definition conduct committed with an intentional or reckless disregard for the safety of others such as by failing to exercise ordinary care to prevent a known danger or to discover a danger
34 Answers What does it mean to exercise ordinary care? Follow best practices What does it mean to discover a danger? Inspect for hazards What does it mean to prevent a known danger? Fix hazards &/or safety issues identified (signs)
35 Agritourism Health & Safety Website: Assist with identifying health & safety hazards on farms Provide resources to fix issues
36 Walkthrough A walkthrough refers to walking through or looking through a series of pictures to identify hazards and/or safety issues, or determine if safety items are lacking. Teaches how to identify safety issues by showing you what to look for and providing information about safety guidelines and recommendations.
