DELEGATIONS/PRESENTATIONS 6420 Ladner Trunk Road (A.01) Memorandum from Robin Pallet, Planner, dated January 29, 2016 regarding Rezoning, Development Permit and Subdivision at 6420 Ladner Trunk Road (Otter Farm & Home Co-Operative Inc.), File No. LU Delegation: David Longpre, Southborough Investments Ltd. Marcy Sangret, Deputy Director of Planning, introduced the delegation and advised the application presented is a revised development proposal for the property at 6420 Ladner Trunk Road. Ms. Sangret noted the Community Planning Advisory Committee reviewed the subject application in December, 2015 and at that time they did not support the proposed development in its current form. The Committee expressed support for a restaurant facility that could serve all types of customers in the neighbourhood, by providing seats and washrooms, and they had concerns about the proximity of the drive-through to residential properties and lack of indoor seating. Ms. Sangret noted the applicant has responded to the Committee s comments by revising the proposed design to introduce 8 to 12 interior seats and public washrooms for customers of the restaurant. Ms. Sangret added that the applicant has made efforts to respond to comments regarding the application, including those of the Community Planning Advisory Committee. The applicant has also included design features intended to mitigate noise, odours and emissions originating from the site to reduce the potential impacts on adjacent residents. Mr. Longpre gave a PowerPoint presentation (On File). In the course of the overview, and in response to queries from the Committee, Mr. Longpre noted: The previous application was for a walk-in restaurant with parking lot and drive-through service. This model is one of four Canadian corporate models developed by Tim Hortons. Tim Hortons has tried to establish a location in Ladner for many years and it has looked at different configurations and locations. The site is approximately 20,000 ft 2 in size. The west portion of the subject property contains a convenience store, gas bar and car wash facility. Community Planning Advisory Committee Page 2

3 Constraints faced include: A Corporation of Delta right of way on the east portion of the site for a sewer main. A BC Hydro right of way on the east portion of the site. No planting of trees on top of Delta s sewer main right of way or under BC Hydro lines. Delta s request to restrict left turning in and out traffic on Ladner Trunk Road. The need to accommodate adequate drive aisle widths, access for service vehicles, and minimum landscape widths. 27% of the site is dedicated to landscaping. Tim Hortons has its own garbage and recycling program specifications to be met along with passenger vehicle flow requirements. Tim Hortons makes every effort to ensure new sites have adequate car stacking on-site to reduce the impacts on local roadways and streets. Six years ago, Tim Hortons Canada implemented a policy whereby every location will utilize the double drivethrough, order menu system. This is included in the current application. Following the December 2015 meeting with the Community Planning Advisory Committee, the proponent met with Tim Hortons to discuss options for providing seating and washroom facilities. The revised application is a U.S. based free standing model which was approved by the Board of Directors located in Toronto, Ontario. Indoor seating of 8 to 14 seats will be accommodated and the restaurant envelope size is between 1300 and 1400 ft 2. The parking ratio and general exterior design of the building will remain the same as previously presented. Additional glazing will likely be provided in the north west portion of the building to allow more light into the seating area. A sloped roof design is proposed which complies with the area s architecture. The facility will cater to all types of consumers in the neighbourhood and washroom facilities will be provided for the public. A natural art concrete fence is proposed on the south property line to eliminate sound, light and odor transmission between the site and adjacent residential properties. 4 Landscaping is proposed in front of the natural art concrete fence. The order boards face east, away from any residential uses. The applicant met with neighbours including the closest resident and an overview of the application and natural art concrete fence was provided. The closest resident was interested in the use of the natural art concrete fence. The distance between the property line of Lot 93 and the edge of the drive-through aisle where cars would stack up is 2.3 m. The drive-through queue can use the gas bar area. The site can handle a stacking queue from the entry area of 16 to 17 cars. In accordance with Delta s bylaws, the natural art concrete fence will be a maximum of six feet in height. In response to Committee queries, the Deputy Director of Planning advised that Delta does not have a policy with respect to drive-through restaurants. Each application is considered on a case-by-case basis. The site is in the LV4 Ladner East Urban Development Permit Area which includes guidelines for the form and character of the development. One item in the guideline relates to building placement and siting buildings close to the street. The applicant considered this guideline and they are proposing to keep the building close to Ladner Trunk Road. In discussion, the Committee acknowledged the efforts of the applicant to work within the site constraints as well as address the concerns raised by the Corporation of Delta planning staff and the Community Planning Advisory Committee. Support was expressed for researching whether other Canadian municipalities have drive-through service policies and guidelines in place and whether there are any potential effects of drive-throughs on public health and neighbouring residences. -- Motion Endorsed MOVED By Firth Bateman, SECONDED By Duncan Macdonald, THAT the Community Planning Advisory Committee supports the application for Rezoning, Development Permit and Subdivision at 6420 Ladner Trunk Road (Otter Farm & Home Co-Operative Inc.).
