1 Bus Services Framework for subsidised local bus service contracts Committee Chair s Date of meeting 28 November 2014 Date of report 26 November 2014 Report by Assistant Chief Executive (Operations) 1. Object of report To recommend the Committee agrees to the establishment of a framework agreement for the procurement of subsidised local bus services and to the appointment of a number of transport providers to it. 2. Background One of the key activities of SPT s Bus Operations department is the tendering of subsidised local bus service contracts. This is carried out in accordance with standard EU procurement regulations, which, in view of the protracted timescales involved in the process, are cumbersome and not best-suited to the dynamics of the local bus service market, in which a local transport authority can have as little as 8 weeks to carry out all of the steps involved in replacing a commercially-provided bus service which is to be withdrawn. In order to be able to respond more quickly to developments in the bus market and to develop greater flexibility, it is proposed that a framework agreement be established for the secural of subsidised bus service contracts. 3. Outline of proposals On 16 September 2014, SPT issued an OJEU Notice and Invitation to Tender (ITT) for a Bus Services Framework. A total of 36 tenderers expressed an interest in respect of the 12 Lots (which are defined by local authority area) Details of the Lots and the tenderers for each are given in Appendix 1 to this paper. The tenderers seeking appointment to the framework were evaluated on quality-based criteria incorporating economic and financial standing and technical / professional ability. The evaluation process was conducted by staff from the Bus Operations and Bus Development sections of SPT. Tenderers were notified that, if successful in being appointed to the framework, the award criteria for future tendering exercises would be on the basis of the Most Economically Advantageous Tender ( MEAT ) and would be evaluated on a Price 70% / Quality 30% split. Each service subsequently advertised under the Framework will be the subject of a follow-on mini competition via Public Contracts Scotland, using the quick quote facility. 2 Following evaluation, it is recommended that 36 tenderers evaluated are accepted on the approved list of suppliers. 4. Committee action The Committee is recommended to agree to the establishment of an SPT framework for the secural of subsidised local bus service contracts and for the appointment of the transport providers identified in Appendix 1 to the various Lots. 5. Consequences Policy consequences: Legal consequences: Financial consequences: In line with Regional Transport Strategy. All awards of contracts following mini-competitions in terms of the framework will be subject to SPT s terms and conditions for transport contracts. No financial consequences at present.
