Mayor and Deputy Mayor Elect 2015/2016 Councillor Pip Ridout has put forward a Notice of Motion to select Councillor Sue Fraser as Mayor Elect for the municipal year 2015/2016. The motion is seconded by Councillor Rob Fryer. Neighbourhood Plan and Consultation documents The Neighbourhood Plan and supporting documents have been presented to its parent committee Town Development at an extraordinary meeting held on Wednesday 4th March All Members have been issued with their own copy of the plan and supporting documents, along with the working group and you are asked to use these for the period of the consultation. All stakeholders will be provided with a copy plus consultation documents and these will be issued following this meeting. 3 Warminster Neighbourhood Plan Consultation response form Warminster Neighbourhood Plan Flyer All documents outline where the plan can be viewed and how the public and stakeholders can respond. There will be a selection of exhibitions in which members of the Neighbourhood Plan Working Group will be available to discuss the detail contained in the plan. It is hoped that the preparation of the various information leaflets will give the public as much or as little detail as they need. For decision. 15. Wiltshire Housing Site Allocations Development Plan Document The informal consultation on initial site options, draft methodology and update on work to date document was posted to all members on 3rd February Unitary members had already received their copy direct from Wiltshire Council. Councillors Pip Ridout and Sue Fraser attended one of the workshops to establish any issues arising that might affect Warminster. A response is required to this consultation to outline that a Neighbourhood Plan is in preparation. Members are to formulate a response which the Clerk can submit. For debate and response. 16. Dog Warden Working Group Report for Decision (8) Minutes of the meeting held on 14th January 2015 to be adopted. Copy attached. Please see the attached report for decision. It is recommended, on the basis of value for money that should either Westbury or Warminster Town Council wish to pursue any activity in respect of dog fouling campaigns this is carried out by trained sub contractors on an ad hoc basis. For decision. 17. Magna Carta what s happening? Warminster Area Board has presented their plans at the March board meeting. It has outlined a community event taking place in Salisbury. 800th anniversary in 2015 One copy housed in Salisbury Cathedral Trowbridge have a series of events. Community areas are invited to take part in a modern day pageant, from Salisbury Market Square to the Cathedral Close on 15th June Members to decide if they wish to get involved as part of the community area. 18. Parishes Building for Service Delivery The Clerk applied for funding from the government s Our Place programme and received the sum of 6000 to use for consultant fees and training which will be paid in two instalments. The first stage payment has already been received. Members are considering the devolvement of services and in order to consider what capacity the council has and what skills it would need to take on services, consultants experienced in service delivery are to assist in the preparation of a development strategy. A proposal has been submitted by Local Community Solutions who have connections with DCK Beavers Ltd, the council s accountants. Please see the proposal attached which the Clerk wishes to develop with the grant funding available. There are agreed dates for completion of the draft plans of the strategy which is 31st March 2015 and then forward planning will be required to carry out the work thereafter. 3

Topics of discussion for proposed meetings with the local MP, Dr Andrew Murrison. Performance and Other Local Issues I have reviewed the crime for the area and we can see that there remains an increase in victim based crime for the Warminster Area. When I break the figures down into Town and Rural you can see that the majority of the crime is coming from Warminster Town Centre, and that the bulk of this is from offences of violence against the person and Criminal Damage On February 10th NPT officers, as part of the Safer Internet Day, gave talks to Key Stage II Primary Level (Juniors) children on the positive uses of technology and to explore the role we all play in helping to create a better and safer online community. Pc Withy and his team are leading pieces of work regarding a store watch program to tackle shoplifting Thefts. Support for this has been offered by Waitrose in the town and this includes an offer to host the meetings and provide loss prevention advice to smaller stores. PCSO Rice organised a training session for Warminster Sector covering dementia awareness to support the a dementia friendly town scheme. This was presented by the two area board managers from Warminster and Westbury and was well received by my officers. Police Cadets, Warminster police are to form a Police Cadet Unit for year olds. It is based on a pilot currently running at Cricklade. It is hoped it will be up and running by the 21 st June On the 8th of February the Rural Crime team supported by Royal Military Police and Tri Force Officers conducted an operation on Salisbury Plain Training area,. Promoting the lawful use of the Highways and Byways and dealing with those who were committing offences. In total 1 x Fixed Penalty Notice (FPN) was issued to a driver not in proper control (driving on a by way with his young child sat on his lap!!) Wiltshire Police years of public service 1

12 2x FPN s issued for illegal number plates 8 x FPN s issued for driving elsewhere than on a road 8 x Section 59 warnings issued in relation to section 34 On the 26 th February officers took part in a rural crime operation in the Warminster area targeting burglaries in the rural communities, this was largely unsuccessful as no burglars were caught. Welcome and Apologies Russell Hawker took the Chair in the absence of PM. Gordon King submitted his resignation from the group as he had not been able to attend any of the meetings and had other commitments today and in February. NOTED. 2. Minutes of Last Meeting Minutes of the meeting held on 3rd December 2014 were approved. 3. Actions Outstanding Contact Prosec and outline scheme and obtain possible quotation for contracting. Prosec have advised HA that they would be happy to assist with this project and would formulate something more formal if required. They would be able to provide SIA licensed individuals to carry out the work at a cost of per hour + VAT. Provide uniform and fund the cost of training. Cost of leasing a vehicle Cost of a small van, on a three year lease arrangement would be 700 deposit and monthly rental of 231. Average mileage 20,000. Cost of leasing mobile phone Any mobile on the high street at a cost of per month. Dependant on usage and contract. 4. Items for Full Council The working group members felt that sufficient information had been gathered to enable HA to prepare a report for both Councils regarding its findings. It was felt that another meeting was not required and this has been cancelled on 4th February. Comments to be considered were that if value for money was at the root of the service, contracting out to a company such as Prosec would be the most cost effective. This would allow both Councils 1

16 to be autonomous. All members felt that education was still an important part of the process. 5. AOB A new scheme from Keep Britain Tidy called we are watching you was discussed and members felt that this was something the principal authority would take up in view of the initial costs. Actions from this meeting: HA to prepare a report for both Council s on the findings of the working group. Meeting Closed at

17 REPORT FOR DECISION (8) Dog Warden Working Group Recommendation It is recommended, on the basis of value for money that should either Council wish to pursue any activity in respect of dog fouling campaigns this is carried out by trained sub contractors on an ad hoc basis. Purpose of the Report To provide information gathered by the working group and officers. Background Full Council agreed to set up a joint working group with Westbury Town Council by resolution at its meeting held on 24th June Membership of the group from Warminster were Councillors Davis, Batchelor, Macdonald and Dombkowski and from Westbury Councillors Tout, King and Hawker. Local Warminster expert Nigel Linge was also invited to join the working group. Wiltshire Council officers Paul Harris, Principal Highways Enforcement and Sebastian Williams, Dog Warden also attended two of the meetings and contact was made with the Senior Solicitor regarding legal matters. Four meetings have been held, the planned fifth meeting was deemed unnecessary as the group felt that sufficient information had been gathered for the respective Council s to make decisions. Initial discussions started to review what the process might be in employing a community dog warden across two towns and how this might work in reality. The working group wished to concentrate purely on issuing penalty notices and/or follow through with court prosecutions. This raised questions, some of the group felt that most dog owners are responsible, and both towns issued free dog bags, how many people would the dog warden find to prosecute. Would the post be full time, what need of equipment was required in addition to uniform and relevant training. Wiltshire Council s enforcement officer shared with the group the current toolkit which would be used. There are three wardens in the County, two full time and one four days per week. The Principal Authority has a statutory duty to deal with stray dogs and for this reason they expressed a wish that any person employed by the Town Councils did not carry the same title. This could be confusing for members of the public. Education and anti fouling campaigns are difficult to fit in and fall down the list of priorities. The team are keen to promote the Green dog walker scheme, which has been developed by Falkirk Council. Volunteers are involved and they wear suitable branded arm bands, carry poop bags and approach those owners who have allowed their dogs to foul and suggest in the polite way that they bag and bin the offending mess. The team outlined how difficult it is to catch offenders in the act. Should the Councils go ahead with employment of a person, they would wish to work closely with them to reduce duplication of effort. 1

18 Nigel Linge outlined his findings to the group and work carried out at Warminster Common and Salisbury Plain. He had been able to use small cameras in strategic points on the Plain and caught regular offenders. He felt that the situation worsened in winter and providing bins at regular pinch points for dog walkers was also a solution. For some reason many dog walkers hung their filled dog bags on trees or garden fences and gates. Options Considered Could additional service be purchased from Wiltshire Council - this was not possible. If a person is to be employed, a different title will need to be found as Dog Warden is used by Wiltshire Council and could cause confusion. Wiltshire Council solicitors will carry out legal work at a cost of 110 per hour. Opt to out source the work to a suitably trained contractor. Implications and Risks Financial and Resource Implications Finance from the respective Area Boards would not be available. Training course 400. Full time person salary 20,000 plus pension costs at 20.1% and national insurance at 7% Uniform Vehicle 3472 per annum x 3 years lease Fuel and insurance costs for running vehicle. Sign Writing approx 300 Mobile Telephone approx 40 per month PACE notebook Penalty notice issue and collection of fine. Recruitment 1000 Legal costs in pursuing offenders VAT per hour cost of employing outside contractor (Prosec). The company would provide the cost of training and uniform. Legal Implications and Legislative Powers The primary legislation the Clean Neighbourhood and Environment Act 2005 gives the parishes the powers to enforce the three county wide Dog Control Orders. The stipulation is that the officer carries a relevant authorisation letter and has undertaken the necessary training Keep Britain Tidy FPN issuing course. Warminster Town Council holds the General Power of Competence Principal Authority will agree to outside contractor being employed provided they undertake the necessary training and are considered suitable. The Principal Authority would require statistics to be provided on activity, penalty notices and prosecutions. 2

19 Environmental Implications Unknown impact of prosecutions and dog fouling in general. Risk Assessment Lone working policies to be observed. Which Council would employ the individual and who would cover holiday and sick payment requirements? How would need be established for anti fouling campaigns? Crime and Disorder Covert cameras would require special licences and this would not be advisable. The working group have advised that it is their objective to prosecute dog fouling offenders.
