2 A first response to the Inspectors Actions arising from the stage 1 hearings was sent to the Inspectors on 14 th December Remaining responses to actions are detailed below. Hearing Day 1 24th October 2017 Council s Actions 1. Confirm in writing, the base dates of the viability work which contributed to the adopted Core Strategy (Core Document CD2/1) and Community Infrastructure Levy (Core Document CD6/42). 2. Provide Inspectors with list of sites where landowners have indicated a preference for housing rather than employment/office as identified /proposed to be allocated in the Plan. 3. Reference was made to the Inclusive Growth Strategy at the hearings. The Council informed the Inspectors of errors within it. The Council to liaise with Thorp Arch Trading Estate (TATE) to establish the status of the Inclusive Growth Strategy in respect of the trading estate. 3a. Although any discussion was deferred to Stage 2, a Statement of Common Ground in relation to the status of the Inclusive Growth Strategy, between the Council and TATE, would be welcomed, before the beginning of the Stage 2 Hearings. 4. Provide information to Inspectors, which illustrates the effect of the safeguarded HS2 route in relation to proposed designated Green Space. 5. Matter 4 Green Space Statement of Common/Uncommon Ground was requested by the Inspectors between the Council and Mr McKinnon. A Statement of Common Ground is included on the Examination Documents list as STA6. 6. Council to consider how the policy relating to Green Space could be clarified to ensure consistency in interpretation for future decision makers and readers of the Site Allocations Plan especially relating to large sites where car parks and spaces between buildings are proposed to be designated for Green Space. Confirm to Inspectors whether areas of land covered by East Leeds Orbital Route is included in surplus / deficiencies of Green Space calculations, including whether this has implications for the delivery of green space 8. Council to consider whether to amend the Site Allocations Plan to refer to the provision of off-site Green Space in accordance with local needs information where available through Neighbourhood Plans and whether a Main Modification would be necessary. 9. Prepare a note for Inspectors explaining why the proposed Further Modification 36 (EX9) regarding Green Space G1718 which seeks to reinsert the site omitted from the Submission Draft Site Allocations Plan (CD1/1) may be required to make plan sound 9a.To agree landownership and boundaries of G1718 through a Statement of Common Ground (with Chartford Homes) A Statement of Common Ground will be submitted separately. 10. Submit relevant Development Plan Panel reports as part of evidence base and signpost Inspectors to relevant paragraphs where decisions on proposed or discounted employment and office allocations were made Appendix 1 is a full list of Development Plan Panel, Executive Board, Full Council and Scrutiny meeting dates with details of what the report covered and links to the reports and minutes on the Council s website. This will be added to the Core Document list. 5 Hearing Day 2 25 October 2017 Council s Actions 1. Confirm to Inspectors whether the amendments proposed to the Infrastructure background paper (in relation to highway requirements) as set out in Paragraph 3.6 of the Statement of Common Ground with Highways England) will be carried through to the Site Allocations Plan. 2. Provide Inspector with list of updates to the Infrastructure Delivery Plan schedule since submission of the Site Allocations Plan. 3. Council to consider whether the Site Allocations Plan adequately signposts developers to the Infrastructure Delivery Plan, and the need for them to consider it when submitting planning applications for allocated and identified sites. 4. Provide Inspector with a list of all employment sites, indexed by identified and allocated employment sites, their current status and any extant planning permissions. Page 5 of 18

Confirm to the Inspectors the most recent date that each individual allocated and identified employment and office sites were assessed in the Employment Land Assessment against deliverability. To be provided in a schedule. 4. Confirm to Inspectors in relation to the Employment Land Assessment whether the Natural Resources and Waste Local Plan have formed part of site assessment and where this information is recorded. Inspector s Actions 1. Provide details of work needed in respect of the Council s justification for the requirement in Policy EG3 (bullet 2) for a wider area Supplementary Planning Document than the site allocation (within 21 days). The Inspectors have now provided this information (available on the Examination website) and given the Council 28 days to respond. The Council provided a response on 15 th December. The Inspectors sent further follow up questions on the 17 th January. The Council provided a further response on the 31st January Page 7 of 18

8 Site Allocations Plan Hearing Day 4 27 October 2017 Council s Actions 1. Insufficient sites are proposed to address the identified need for Gypsy and Traveller accommodation over the full plan period. Council to confirm how this shortfall will be addressed and when. 2. Confirm to Inspectors whether the Council considers a car Showroom use contributes to employment land supply and where this is set out in the evidence. 3. The Council explained at the hearing that any planning applications for development on the identified UDP sites carried forward would be assessed against the relevant UDP policies. The Inspectors suggest this is not clear from reading Policies EO1 or EG1. The Council clarifies that the UDP sites identified within the SAP are retained as allocated sites within the saved UDP. They are identified within the SAP in order to evidence how the total Core Strategy employment target is to be delivered. In response to the Inspectors concerns, the Council acknowledge that modifications to the Plan are required to clarify this, as follows: EO1 Paragraph 2.85 of the Plan (CD1/1) the Council have already proposed a modification (Pre-Submission Change No. 40, CD1/6 Schedule of Pre-Submission Chnages, February 2017) to state Policy EO1 applies to identified sites for office use. For purpose of ease and reference this is repeated for each HMCA in Section 3, with the relevant list of sites which form part of the policy. In addition to the above, the Council now propose a further modification, for the purposes of clarity, to continue this paragraph to state (immediately after the above pre-submission change): UDP allocations which have not yet been fully developed are to remain as identified allocations within the saved UDP. Policy EO1 lists all identified sites comprising: saved UDP allocations and sites with planning permission / recently expired permission. Column 2 in the table of sites within the policy identifies the UDP reference retained, where applicable. Any site requirements identified in the UDP under this reference are also retained (see Appendix 1), and planning applications should have regard to these. EG1 Paragraph 2.88 of the Plan (CD1/1) the Council have already proposed a modification (Pre-Submission Change No. 44, CD1/6 Schedule of Pre-Submission Chnages, February 2017) to state Policy EG1 applies to identified sites for general employment use. In considering this question the Council has noted that some UDP references in column 2 of Policies EO1 and EG1 (CD1/1) are not detailed due to a database error. The Council will remedy this through further proposed modifications in due course. The Inspectors question relates to policies EO1 and EG1. As the concern applies equally to identified housing sites the Council also proposes to put forward a modification to Policy HG1 of the Plan (CD1/1) in due course. 3(a). Council to confirm how this relates to the Saving Direction relation to the UDP. The Planning and Compulsory Purchase Act 2004 (as amended) repealed the legislative framework from which pre-2004 Act development plans (including the Old Plans) derived their statutory force. The effect of that repeal is that, subject to the saving provisions contained in Schedule 8 to the 2004 Act, the Old Plans ceased to have any meaningful legal existence. Schedule 8 effectively provides that, notwithstanding the repeal of the parent legislation, the Old Plans remain part of the statutory development plan for as long as they are within the terms of para 1(2) of Schedule 8 which states: The transitional period is the period starting with the commencement of section 38 and ending on whichever is the earlier of (a) the end of the period of three years; (b) the day when in relation to an old policy, a new policy which expressly replaces it is published, adopted or approved. The Secretary of State s Direction for Leeds is contained in two letters. The first, in relation to the UDP (2001) received in 2007 and contained at Appendix 2. The second, in relation to the UDP Review (2006) received in 2009 and contained in Appendix 3. Appendix A in both letters states: The Secretary of State for Communities and Local Government in exercise of the power conferred by paragraph 1(3) of Schedule 8 to the Planning and Compulsory Purchase Act 2004 directs that for the purposes of the policies specified in the Schedule to this direction, paragraph 1(2)(a) of Schedule 8 to the Planning and Compulsory Purchase Act 2004 does not apply. The effect of the Secretary of State s Direction (as contained in the two letters read together) was to enable the saved policies to remain part of the development plan Page 9 of 18

10 until such time as they are superseded as per Schedule 8 Para 1(2)(b). The SAP proposes to supersede some policies within the UDP. These are identified at Appendix 1 of the SAP (CD1/1) pursuant to Regulation 8 of the Town and Country Planning (Local Planning) (England) Regulations 2012, however, the UDP policies which incorporate the identified sites are not being replaced or superseded by the SAP and as such remain saved policies and part of the statutory development plan. 3(b). Council to confirm how decision makers will know what the relevant site requirements relating to identified Unitary Development Plan allocations are. The proposed modifications to the Plan as detailed above, at paragraphs 2.29 and 2.85 of the Plan (CD1/1) will ensure decision makers are made aware of any UDP site requirements as it directly cross references the reader to the UDP reference set out in Column 2 of the relevant SAP policy. Appendix 1 of the SAP (CD1/1) also lists the UDP policies and the effect of the SAP upon them i.e. superseded or saved. The Council will update Appendix 1 of the SAP (CD1/1) to make explicit where saved UDP policies contain site requirements and whether any of these have been superseded by CS policies. This will be proposed as a modification in due course. 3(c). Council to confirm whether the site requirements remain necessary in each case having regard to the adopted CS and the SAP. In general the site requirements of saved UDP sites remain necessary in each case having regard to the adopted CS and the SAP. In some cases site requirements may be superseded by Core Strategy policies. In line with Schedule 8 to the 2004 Act, where this is the case, these will be noted in Appendix 1 of the SAP (CD1/1), as noted above in 3(b). Schedule 8 gives no mechanism to consider the relevance of site requirements affected by the passage of time. Where this is the case (e.g. where contributions to specific infrastructure are identified, but the infrastructure has since been completed) such requirements of saved policies will be given no weight at decision taking stage. 4. Confirm to the Inspectors what is meant by recently expired permissions (i.e. confirm what the base date is). 5. Provide to Inspectors a list of sites which include site requirements relating to non-designated heritage assets. HG2-155 Joseph Priestley College (Outer South West HMCA) 7. HG2-158 Tingley Mills (Outer South West HMCA) 8. EG2-19 Land off Topcliffe Lane, Capitol Park (Outer South West HMCA) 9. 11 As a consequence of considering this question the Council has also proposed further modification to the Plan to clarify the legibility of heritage requirements in general. These will be detailed in a separate response of further modifications in due course. 6. Reassess the area north of identified sites EG1-35 / 36 given the impact the safeguarded HS2 route has on it. The impact of HS2 on sites EG1-35 and EG1-36 (collectively known as North Newhold ) was raised at Publication Draft (see Appendix 1 of Site Allocations Plan Consultation Outcomes and Proposed Changes, Development Plan Panel, Tuesday 28th June 2016). In response, the Council made a series of pre-submission changes (CD1/6) (571 and 572) which omitted the land safeguarded for HS2 from the site areas and site capacities. The submission document Note on HS2 and potential effect on sites (EX7) explains the Council s approach to EG1-35 and EG1-36 in light of HS2 (see para. 2.5). The Council is satisfied pre-submission changes 571 and 572 constitute an appropriate level of response to the impact of HS2 and that no further changes are needed. As requested by the Inspectors at the Stage 1 Hearing Sessions, the Council has considered whether HS2 sterilises the land to the north. Whilst the Council recognises that access to this part of North Newhold might prove challenging, the Council has not been presented with any evidence to show it cannot be achieved. It would be a matter of negotiation between the landowner/developer and HS2 to see whether an access road could be provided. Indeed, a public right of way exists along the western boundary of North Newhold and, in the event of HS2, there would be an obligation for it to be reinstated. There might be opportunities to negotiate for a road access which can serve the northern part of North Newhold. Furthermore, the impact of removing the northern part of EG1-35 and EG1-36 would mean it would essentially become white land as there is no scope in the SAP to reintroduce land into the Green Belt. The risk with land being white land is that the Council would have difficulty preventing inappropriate, or undesirable, uses. The site is well suited for employment since it close to the motorway and in an area of employment. If access was possible, employment would be the preferred use and on the basis of all of the above the Council remains of the view the allocation as submitted is sound. 7. The Council to clarify the position regarding allocated site EG2-23 in respect of the assessment of its capacity and site area taking into account the limit placed on floorspace provision under the extant planning permission Page 11 of 18
