2 Background per the Fairfax County Park Authority The Fairfax County Park Authority owns approximately 23,000 acres and maintains 425 park facilities 500 plus full time employees, 2300 plus seasonal employees Facilities range from neighborhood parks to major parks, a family water park, RECenters, nature and historic sites, miniature golf and golf courses. Public usage varies from camping, picnic & boat rentals, and classes to day trips & tours, equestrian activities, fitness, gardening, fishing and sports and leagues County is 407 square miles BIG and has a population of approximately 1.2 to 1.3 million residents Setting is urban/suburban Fairfax was the first U.S. county to reach a six-figure median household income and has the second-highest median household income of any local jurisdiction in the U.S. 2

4 FCPA tasked with confirming over 600 violations at 18 Park Authority facilities!!! Agency director orders a DOJ team formation to include Administrative Support document (maintain financials/organize facility documentation) Park Operations staff estimator assists ADA Coordinator Trades staff assigned to assist (carpenter/plumber/electrician) County funds fixes 4

7 Fairfax County Park Authority DOJ Audit Waiver Request 01/24/2012: Burke Lake Park C Picnic Shelter c (1) Although the parking lot for Picnic Shelter C has a total of 102 parking spaces, an inadequate number of spaces are designated as reserved for people with disabilities and not all of the cross slopes of the parking spaces and access aisles are 2% or less. 21 Spaces Dispute: The Picnic Shelter C parking lot contains 66 parking spaces (in addition to the 2 accessible parking spaces), not 102 parking spaces as previously assessed by DOJ. Resolution: Whereas 102 spaces would require 5 accessible parking spaces according to the 2010 ADAAG (208.2), the FCPA will add one additional accessible parking space to meet the required number of minimum spaces (3) for parking lots with 51 to 75 total spaces. In addition, the cross slopes of the original 2 accessible parking spaces and access aisle will be retrofitted for compliance. 7

9 Fairfax County Park Authority DOJ Audit Dispute Request 05/26/2011 Clemyjontri Park Issue: 12-3 Playground 12-3a. The walkway is inaccessible because there are various playground area elements which protrude into the walkway and would not be detectable to a blind person using a cane. Dispute: FCPA respectfully disagrees with this assessment. All playground elements are located off the primary accessible route and do not protrude into walkways. Secondly all ground level elements maintain a leading edge below 27 (per ADAAG 307.1). 9

11 Fairfax County Park Authority DOJ Audit Waiver Requests 04/16/2011: Racquetball Courts - Door Hardware: Providence RECenter b Racquetball Court # b (1) The door to the racquetball court is inaccessible because it has an opening width of only 27 and has knob hardware Justification: Alternative solutions are not available; safety issues (protrusion) arise for all customers participating in the sport on the interior side of the door. 11

14 DOJ Audit/Issue: Oak Marr Golf Course f (2) The Driving range is inaccessible because it there is no accessible route to the upper deck. 14
15 Background The FCPA utilizes a system of golf car passage as the guiding principal for course accessibility at our seven facilities. While 2 of these pre ADA facilities were flagged non-compliance in the DOJ audit (accessible route issues), Oak Marr Golf Course is the only facility that contains an upper deck/second story. Laurel Hill Golf Course, open to play in 2005, was designed in the spirit of the ADA using the guidelines for recreation facilities (Alternative Golf Car Passage) while additionally incorporating accessible routes to the practice putting green, driving range, bag drop area, and golf cart rental area. Proposal The driving range contains fifty-six (56) ground level tee boxes with one (1) currently accessible to single rider carts. Of the ground level tee boxes, thirty-five (35) are covered by the second level of the facility. In lieu of providing second story access, which contains twenty (20) elevated tee stations, the FCPA, via the use of equivalent facilitation, proposes to retrofit ten percent (10%) of the total number of the ground level tee stations, in accordance with ADA accessibility guidelines (Teeing Stations at Driving Ranges and Practice Tee Grounds), for priority access by single rider carts and/or persons with disabilities. Priority access, along with posted signage, is self-initiated by the customer or management, upon request, when all ground level tee stations are at maximum usage or inclement weather makes uncovered accessible tee stations to be unusable. 15

18 DOJ Audit Status? By FY18 we will have completed the retrofitting of the remaining facilities: South Run RECenter family changing room; Burke Lake Clubhouse, Lake Fairfax Park Restrooms A&C; and the design phase of the Mt. Vernon RECenter facility renovation (actual construction likely FY19). 18

Note that the audit agreement required us to develop a formal transition plan 60 facilities assessed Used the same format as the audit Plan of attack centered around those large/heavy usage facilities working down to the little guy eventually County funded the TP for the last 3 years FY16,17 & 18 to infinity and beyond!!?? 19
