1 SEVENTY-FIRST WORLD HEALTH ASSEMBLY A71/31 Rev.1 Provisional agenda item May 2018 Status of collection of assessed contributions, including Member States in arrears in the payment of their contributions to an extent that would justify invoking Article 7 of the Constitution Report by the Director-General STATUS OF COLLECTION 1. In order that WHO may deliver the approved programme budget, contributions from Member States must be received in full and on time. Under Financial Regulation 6.4, all Member States are required to pay their contribution as of 1 January of the year to which it relates. 2. Contributions for 2017 were received, either in full or in part, from 151 of the 196 Members and Associate Members (compared with 139 Members and Associate Members in 2016). 1 Details of amounts assessed and collected are shown in Annex Unpaid contributions as at 31 December 2017 amounted to US$ 91.8 million and Sw.fr million (constituting a combined total of US$ million) with a further US$ 26.9 million due under special arrangements authorized by the Health Assembly (compared with US$ 65.9 million (combined total) and US$ 30.5 million (due under special arrangements), respectively, at 31 December 2016). Details of payments made as at 31 December 2017 under special arrangements are shown in Annex 2. MEMBERS CONTRIBUTIONS RECEIVED IN ADVANCE 4. As at 31 December 2017, some Members had made advance payments, either in full or in part, against their regular budget contributions for 2018 and future years. In total, contributions received in advance as at 31 December 2017 amounted to US$ 51.8 million (US$ 50.4 million at 31 December 2016). Advance payments are detailed in Annex 3. 1 For 2016 data, see document A70/41.
2 A71/31 Rev.1 MEMBERS IN ARREARS AND SPECIAL ARRANGEMENTS 5. Article 7 of the Constitution states that, if a Member fails to meet its financial obligations to the Organization, the Health Assembly may suspend the voting privileges to which a Member is entitled. If, at the time of the opening of the Health Assembly, a Member is in arrears in an amount that equals or exceeds the amount of contributions due from it for the preceding two full years, the Health Assembly takes a decision on suspension of the Member s voting privileges in accordance with resolution WHA41.7 (1988). 6. In accordance with previous Health Assembly resolutions, the voting privileges of the following four Member States continue to be suspended: Central African Republic, Comoros, Guinea-Bissau and Ukraine. Details of the amounts outstanding are provided in Annex 4. The suspension is to continue at the Seventy-first World Health Assembly (in 2018) and subsequent Health Assemblies until the arrears have been reduced to a level below the amount that would justify invoking Article 7 of the Constitution. 7. In accordance with resolution WHA70.8 (2017), if, by the time of the opening of the Seventy-first World Health Assembly, Gambia, Grenada and South Sudan are still in arrears in the payment of their contributions to an extent that would justify invoking Article 7 of the Constitution, their voting privileges shall also be suspended as from the opening. Details of the amounts outstanding are provided in Annex 4. The suspension will then continue at the Seventy-second World Health Assembly (in 2019) and subsequent Health Assemblies until the arrears have been reduced to a level below the amount that would justify invoking Article 7 of the Constitution. 8. Annex 2 lists the 11 Member States that currently have special arrangements for repayment of arrears approved previously by the Health Assembly. Payments amounting to US$ 4.1 million were received in 2017 (compared with US$ 5.0 million in 2016) in accordance with these special arrangements. Eight of the Member States concerned have respected their commitments under these arrangements. Three Member States, Afghanistan, the Central African Republic and Ukraine, are not respecting their commitments. Of those three Member States, the Central African Republic and Ukraine have already had their voting privileges suspended. In the case of Afghanistan, unless further payment is made by the opening of the Seventy-first World Health Assembly, it will lose its voting privileges. 9. As at 19 March 2018, eight Member States, namely Bangladesh, Cameroon, El Salvador, Libya, Niger, Niue, Suriname, and Venezuela (Bolivarian Republic of), were in arrears in the payment of their contributions in amounts that equal or exceed the amounts due from them for the preceding two full years, as listed in Annex 4. One Associate Member, Puerto Rico, was also behind with its assessed contributions. 10. Pursuant to resolution WHA41.7, unless there are exceptional circumstances justifying a different measure, the Seventy-first World Health Assembly may wish to adopt a resolution deciding that the voting privileges of the eight Member States mentioned in paragraph 9 will be suspended as from the opening day of the Seventy-second World Health Assembly, if at that time the Member States concerned are still in arrears to an extent that would justify invoking Article 7 of the Constitution. 2
3 A71/31 Rev Member States in arrears of payment to the extent referred to above are encouraged to submit proposals to the Health Assembly for repaying such arrears over an extended period. Such proposals for special arrangements are considered by the Programme, Budget and Administration Committee of the Executive Board, which subsequently makes its recommendations to the Health Assembly. To date, no new proposals have been submitted for consideration in ACTION BY THE HEALTH ASSEMBLY 12. No action is required by the Health Assembly in respect of those Members whose voting privileges have already been suspended under previous Health Assembly resolutions. 13. The Health Assembly may wish to consider the following draft resolution in respect of Bangladesh, Cameroon, El Salvador, Libya, Niger, Niue, Suriname, and Venezuela (Bolivarian Republic of), in accordance with the principles stated in resolution WHA41.7: The Seventy-first World Health Assembly, Having considered the report on status of collection of assessed contributions, including Member States in arrears in the payment of their contributions to an extent that would justify invoking Article 7 of the Constitution, and special arrangements for settlement of arrears; 1 Noting that, at the time of opening of the Seventy-first World Health Assembly, the voting rights of the Central African Republic, Comoros, Gambia, Grenada, Guinea-Bissau, South Sudan and Ukraine were suspended, such suspension shall continue until the arrears of the Member States concerned have been reduced, at the present or future Health Assemblies, to a level below the amount that would justify invoking Article 7 of the Constitution; Noting that Afghanistan, Bangladesh, Cameroon, El Salvador, Libya, Niger, Niue, Suriname, and Venezuela (Bolivarian Republic of) were in arrears at the time of the opening of the Seventy-first World Health Assembly to such an extent that it was necessary for the Health Assembly to consider, in accordance with Article 7 of the Constitution, whether the voting privileges of those countries should be suspended for Afghanistan at the opening of the Seventy-first World Health Assembly in 2018, and for the remaining eight Member States at the opening of the Seventy-second World Health Assembly in 2019, DECIDES: (1) that, in accordance with the statement of principles set out in resolution WHA41.7 (1988), if, by the time of the opening of the Seventy-second World Health Assembly, Bangladesh, Cameroon, El Salvador, Libya, Niger, Niue, Suriname, and Venezuela (Bolivarian Republic of) are still in arrears in the payment of their contributions to an extent that would justify invoking Article 7 of the Constitution, their voting privileges shall be suspended as from the said opening; and, in accordance with resolution WHA59.6 (2006), if, by the time of the opening of the Seventy-first World Health Assembly, Afghanistan is still in arrears in the payment of its rescheduled assessment, its voting privileges shall be suspended automatically; 1 Document A71/31 Rev.1. 3
4 A71/31 Rev.1 (2) that any suspension that takes effect as set out in paragraph (1) above shall continue at the Seventy-second World Health Assembly and subsequent Health Assemblies, until the arrears of Afghanistan, Bangladesh, Cameroon, El Salvador, Libya, Niger, Niue, Suriname, and Venezuela (Bolivarian Republic of) have been reduced to a level below the amount that would justify invoking Article 7 of the Constitution; (3) that this decision shall be without prejudice to the right of any Member to request restoration of its voting privileges in accordance with Article 7 of the Constitution. 4
