2 1.0 WHAT IS A PROTECTED STRUCTURE? A Protected Structure [formally referred to as listed buildig] is a structure that a local authority cosiders to be of special iterest from a architectural, historical, archaeological, artistic, cultural, scietific, social or techical poit of view. The protectio give to a structure applies to all parts of the structure, icludig the iterior, the lad lyig withi the curtilage of the structure, ay other structures lyig withi that curtilage ad their iteriors ad all fixtures ad features. Details of Protected Structures are etered by the authority i its Record of Protected Structures, which is part of the Developmet Pla. Each ower ad occupier of a Protected Structure is legally obliged to esure that the structure is preserved. Each ower ad occupier shall esure that the structure or ay elemet of it which cotributes to its special iterest is ot edagered. Ay perso who, without lawful authority, causes damage to a protected structure shall be guilty of a offece. It is importat to ote that whe a structure is protected it does ot mea that the structure must be preserved exactly as it is, rather, it allows for maaged chage through the plaig process, with the objective of retaiig the qualities of the structure which give it its special iterest. The additio or deletio of a structure is a reserved fuctio of the elected represetatives of the Coucil i their fuctioal area. 1.1 What is the goverig legislatio for a Protected Structure? Accordig to Sectio 10(2)(f) of the Plaig ad Developmet Act, 2000, a Developmet Pla shall cotai objectives for: The protectio of structure, or parts of structures, which are of special architectural, historical, archaeological, artistic, cultural, scietific, social or techical iterest. Sectio 51(1) of the Plaig ad Developmet Act, 2000 idicates the ratioale for providig a Record of Protected Structures, statig that For the purposes of protectig structures, or parts of structures, which form part of the architectural, historical, archaeological, artistic, cultural, scietific, social or techical iterest, every developmet pla shall iclude a record of protected structures, ad shall iclude i that record every structure which is, i the opiio of the plaig authority, of such iterest withi its fuctioal area. 1.2 How does a structure become a Protected Structure? A structure becomes a Protected Structure whe it is icluded i the Record of Protected Structures compiled by the plaig authority. A plaig authority must follow certai procedures if it proposes to deem a structure to be a Protected Structure. These ivolve otifyig the owers ad occupiers of the structure ad certai iterested bodies of the proposal ad also otifyig the public by meas of a ewspaper advertisemet. The ower or occupier of the structure, alog with ay member of the public, is etitled to mae commets o the proposal to the authority. These commets are tae ito accout before the plaig authority s elected members decide whether or ot the structure should become a Protected Structure. 2

3 1.3 What obligatios fall o owers ad occupiers to esure the preservatio of a Protected Structure? Uder Sectio 58 of the Plaig ad Developmet Act, 2000, each ower ad occupier must esure that a Protected Structure or ay elemet of a Protected Structure is ot edagered through harm, decay or damage, whether over a short or log period, through eglect or through direct or idirect meas. 1.4 Do special procedures apply to a Protected Structure uder the plaig system? Yes. Uder the plaig system, may mior wors to structures do ot ormally require plaig permissio. These wors are ow as exempted developmet. However, for a protected structure, such wors ca be carried out without plaig permissio oly if the wors would ot affect the character of the structure or ay elemet of the structure that cotributes to its special iterest. A ower may request that the local authority provide a Declaratio as to what is exempted developmet i each idividual case. Depedig o the ature of the structure, plaig permissio could, for example, be required for: Iterior decoratig such as plasterig or paitig Wors which ivolve the removal of origial material Wors which require the applicatio of ew material over existig (dry liig, etc) Reslatig without re-use of existig slates Replasterig i all cases Re-poitig i most cases Removal of reders to expose stoe New opes for doors ad widows Replacemet of etire widows ad doors All demolitio wors icludig outbuildigs Wors to boudary walls Wors which are liely to impact o the settig of the structure 1.5 How do owers or occupiers ow which wors require plaig permissio? A ower or occupier of a Protected Structure may request, uder Sectio 57 of the Plaig & Developmet Act, 2000, the local authority to issue a declaratio idicatig the types of wors that could be carried out without affectig the character of the structure or ay elemet of the structure which cotributes to its special iterest. These wors would ot require plaig permissio. A local authority will, i geeral, issue such a declaratio withi 12 wees of receivig such a request. 3

4 1.6 How does a ower or a occupier apply for plaig permissio to carry out wors to a Protected Structure? A plaig applicatio ivolvig a Protected Structure is geerally made i the same way as ay other plaig applicatio. However, because of the sesitivity of most Protected Structures to iappropriate wors, a plaig applicatio for wors to a Protected Structure will geerally be required to be more detailed. The relevat ewspaper ad site otice for the plaig applicatio must idicate that the applicatio relates to a Protected Structure. Additioal iformatio o how the proposed developmet would affect the character of the structure must be submitted with the applicatio. The local authority will cosult other bodies, icludig the Departmet of the Eviromet, Heritage & Local Govermet, the Heritage Coucil ad A Taisce before maig a decisio o the applicatio. 1.7 Are there ay measures i place to assist owers ad occupiers to preserve a Protected Structure? Yes. A scheme of grats, called Coservatio Grats Scheme, is operated by Laois Couty Coucil [ad all local authorities] to assist the ower or occupier of a protected structure udertae wors cosidered ecessary to secure its coservatio. The Coucil will prioritise applicatios for grat aid o the basis of the qualifyig criteria [as established by the Departmet of the Eviromet, Heritage & Local Govermet] beig satisfied. 1.8 Do local authorities have special powers i relatio to a Protected Structure? Yes. A local authority may: require a ower or a occupier of a Protected Structure to carry out wors if it cosiders that the structure is or may become edagered; require a ower or a occupier of a Protected Structure to carry out wors if it cosiders that character of the structure ought to be restored; acquire, by agreemet or compulsorily, a Protected Structure if it cosiders that this is desirable or ecessary i relatio to the protectio of the structure. 1.9 Are owers ad occupiers liable to pealties? Yes. Pealties for wrogdoig are striget. A fie of up to 12.7 millio ad 12,700 for each day of a cotiuig offece ad/or a term of imprisomet of up to 2 years ca be imposed o a ower or a occupier who: Edagers a Protected Structure or udertaes ay wors to a Protected Structure without the ecessary plaig permissio Fails to carry out wors, ordered by a local authority, to a Protected Structure 4

5 2.0 WHERE CAN ONE OBTAIN LEGISLATION IN RELATION TO A PROTECTED STRUCTURE?
