3 STAATSKOERANT, 8 FEBRUARIE 2013 No GENERAL NOTICE NOTICE 100 OF 2013 DEPARTMENT OF WATER AFFAIRS NATIONAL WATER ACT, 1998 PRELIMINARY ALLOCATION SCHEDULE IN TERMS OF SECTION) 46(1) OF THE NATIONAL WATER ACT, 1998 FOR THE JAN DISSELS RIVER CATCHMENT I, Deborah Gabaakelwe Mochotlhi, as the delegated authority in terms of section 63(1) of the National Water Act, 1998 (Act No. 36 of 1998) ["the Act "] after considering all the objections received to the proposed allocation schedule published in General Notice 780 in Government Gazette No dated 28 September 2012, set out in this Notice a preliminary allocation schedule for the Jan Dissels River Catchment in terms of section 46(1)(a) of the Act. In terms of section) 46(1)(b) of the Act, an appeal in respect of any unsuccessful objection to the aforementioned proposed allocation schedule and contained in the preliminary allocation schedule may be made no later than 30 days after the date of publication of this Notice, which in terms of the Interpretation Act 1957 (Act No 33 of 1957) must be submitted by 11 March Appeals can be submitted to the Water Tribunal at any of the addresses indicated below, addressed to the Acting Registrar for the Water Tribunal and marked for the attention of Ms. RP Tlhabadira. 1. (2) Allocations from surface water, particularly during the stressed months (Dec, Jan, Feb & Mar), may be lower than existing water use and demands. (3) A reasonable phase-in period will be allowed for adaptation due to curtailment or changes from current sources to different sources by existing users, depending upon the infrastructure and financial requirements. (4) The Cederberg Municipality's water use from the Jan Dissels River may be switched to the Clanwilliam Dam, between the start of December to theend of March. (5) The lower Jan Dissels River water users may be switched to the Olifants River, between the start of December to the end of March,where feasible. (6) The Taaiboschkraal River diversion may be returned to its natural course and to the Jan Dissels River, between the start of January to theend of March.
