64 Trading Charter Our commitment to you Prices Although e endeavour to reduce our basic brochure prices by ay of discounts etc. to act as a buffer for any later additional costs, your travel and accommodation arrangements are/could be subject to surcharge. This ould be for any increases in costs for Fuel, Currency in regard to adverse exchange rate variations and also for Government action such as increases in V.A.T. or any other Government-imposed increases. There ill be no change ithin 30 days of your departure. We ill absorb and you ill not be charged for any increase equivalent to 2% of the price of your travel arrangements, hich excludes insurance premiums and any amendment charges. You ill be charged for the amount over and above that. Should the price of your holiday go don due to the changes mentioned above, by more than 2% of your holiday cost, then any refund due ill be paid to you. Hoever, please note that travel arrangements are not alays purchased in local currency and some apparent changes have no impact on the price of your travel due to contractual and other protection in place. Where a surcharge is payable there ill, in addition, be an administrative charge of 1. If a major change becomes necessary, e ill inform you or your travel agent as soon as is reasonably possible if there is time before your departure. A major change is one that e make to your holiday arrangements before departure, that involves changing your UK airport(s), resort area or time of departure or return by more than telve hours, or offering accommodation ith a loer standard. You then have the choice of: (A) accepting the changed arrangements as notified to you; (B) purchasing another available holiday from us; or (C) cancelling your holiday. Note: With regard to the above, any refund relevant to distance, does not apply to the UK or the Resort areas here all coaches revert to Feeder status to avoid multiple drop-offs (could be mini bus/taxi). Clean Air Policy - Smoking/e-cigs is/are strictly forbidden in coaches and lodges. Pets - No pets of any description are alloed. Air conditioning, Audio/TV Systems There ill be NO COMPENSATION paid for loss of these systems General Conditions and Information Seat Dimensions and Larger Passengers (See also page 57 - Extra Seat ) The seats on our coaches are approximately 450mm ide, (17.71 inches). Larger passengers hose size exceeds these seat dimensions ill reduce the space available for the person sitting next to them. This reduction in space can cause a great deal of discomfort. Infants (0-23 months at time of return travel) Unless you tell us otherise, e may count an infant as the first child on your booking and allocate a coach seat and a luggage alloance. A Triple or 4-bedded room is usually a tin room or double room ith extra bed(s) added. This can make the room cramped in many cases. (a) All tickets and vouchers are issued by the Company subject to the condition that the Company shall not be liable to the passenger for any injury, loss, damage, delay or inconvenience caused to or suffered by the passenger hich may be occasioned either by reason or any defect in any vehicle, equipment or building provided by the Company or through the acts or commission or omission of any company, firm or person or any employee or servant of any such company, firm or person providing transport, accommodation, refreshment, insurance facilities or services in connection ith the said holiday. (b) Similarly the Company shall not be liable for any damage, losses or additional expenses incurred or suffered by the passenger as a result of delays or change in route by road or by sea as a result of sickness, quarantine, eather, ar, strike, lock outs, civil commotions or change of itinerary. (c) Similarly, if a delay affects other commitments, such as recommencement of ork or other appointments, the Company and the Insurance Company ill not indemnify the client and ill not be held responsible for any loss. Please accept that coaches can develop technical faults and require replacing as do certain on-board facilities, and remember if you do travel for business or pleasure, by land or sea or air, delays can occur for any reason hatsoever and should be anticipated. This does not effect your statutory rights (See also Club Class Facilities shon left). We provide financial protection for your money hen you buy a package holiday. If you buy other travel arrangements such as accommodation only this protection doesn t apply. 65 Your commitment to us 1. Booking Form and Payments (a) The company requires possession of the signed booking form plus the deposit stated thereon (including infants travelling free and children free/special price) and this amount is payable to the Company immediately. The acceptance by the Company of a deposit shall not imply acceptance of the reservation. Acceptance of a passenger's reservation as aforesaid shall be in riting and delivered to the passenger by pre-paid letter post at the address appearing on the booking form or to the passenger personally, errors and omissions excepted. (b) The company shall not be liable to the passenger for any loss or damages suffered hether direct or indirectly as the result of the Company's failure to accept a reservation or for errors and omissions. (c) On acceptance of the reservation by the Company the deposit shall be deemed to be in part payment of the tour departure date appearing in the booking form and is not refundable. (d) The balance of the said tour price shall be received by the Company not less than eight clear eeks before the tour departure date appearing in the booking form (unless advised otherise on that form). In the event of non-payment of the said balance as aforesaid the reservation shall be deemed to have been cancelled by the passenger and the Company shall be at liberty to forfeit the deposit and any monies paid on account of the price. (e) Any money paid by you to a travel agent is held by the agent on behalf of Siesta International Holidays Limited. (f) It is the client's responsibility to check all invoices/tickets etc. for any human or mechanical errors in respect of the accommodation and travel in order to give the company the opportunity to rectify the same. (g) Self catering deposit for Cleaning (excluding BBQ) - See clause (a) belo right. (h) Self catering deposit for Contents Accidental Damage - See clause (b) belo right. 2. Cancellation by you A cancellation can only be accepted in riting from the person ho signed the booking form. The cancellation ill be effective from the date it is received at our offices. In the event of a cancellation either for one or all persons named on the booking form, e ill levy our scale of cancellation charges, hich is based on the estimated expenses and losses suffered by us as a result of cancellations. Cancellation charges occurring ithin the scope of the insurance may be reclaimed direct from the insurance Company hen cover has been affected. Airport Transfers - Cancellation of airport transfers more than 56 days before travel ill incur an administration charge of 40. Any overpayment (excluding holiday deposit) ill then be refunded. Within 56 days of travel, the above cancellation charges ill apply. 3. Alteration by you If, after your booking has been confirmed, you ish to change to another of our holidays ithin this brochure or alter your booking in any ay e.g. by changing your departure date, accommodation, mode of travel (including changes to airport transfer arrangements) e ill do our utmost to make the changes, provided ritten notification is received at our offices from the person ho signed the Booking Form, at least eight eeks before your departure date. This must be accompanied by a minimum payment of.00 per person (maximum per booking per change) to cover our administration costs. N.B. Any alteration by you ithin eight eeks of departure ill be treated as a cancellation of the original booking and ill be subject to the cancellation charges set out above. Any ne arrangements made ill be treated as an entirely ne booking. Re-ticket charge Re-invoice charge.00. If your booking changes because someone in your party cancels, e ill recalculate your holiday cost based on the ne number of people going. If feer people share the accommodation then the cost for them may go up. This extra cost is not a cancellation charge, and is not covered by your holiday insurance. Your Accommodation is available for use only by those persons accepted by us and named on the booking form in riting. 4. Cancelling your coach seat Cancelling your coach seat outside 8 eeks before departure ill incur an administration fee of per seat. Inside 8 eeks, cancellation fees ill apply (excluding FREE seat) - See Clause Channel crossing The client accepts and agrees this could be by Eurotunnel OR Ferry at the Companies discretion (see page 6). (1) Bring it to the attention of our representative at the time hen he/she should try to rectify it (2) If nothing can be done about it then, complete a client report form signed by our representative at the resort or on the coach (hich ever is relevant). (3) If you intend to complain, forard your complaint in riting to our Customer Relations Manager at our Middlesbrough office ithin 28 days of your return. N.B. No verbal complaint ill be handled in the UK. Please note: All these points 1, 2 and 3 are conditional for any complaint consideration. 7. Travel documents and other foreign requirements See passport, visas, health and FCO advice on opposite page. It's also the passengers sole responsibility to be aare of and comply strictly ith all las and customs documentation including passports and foreign exchange requirements of the countries to be visited and in default the Company reserves the right to repudiate this contract. See Clause 11 - luggage - Customs and Excise section. 8. Part Deposit Assistance Oing to administration restrictions, this can only be available for clients booking directly ith Siesta. Stage 1 Bookings from p.p. (taken 15th May to 31st October). Balance of deposits to be paid before 31st October. Accom-Only, Apartments, Siesta 4 s and Chalet 5 s require a minimum deposit of per accommodation. All other Lodges require a minimum deposit of per accommodation. Stage 2 Bookings from p.p. (taken 1st November to 28th February) subject to the minimum deposits stated above. Balance of deposits to be paid before 28th February. Part Payment Options You can choose to pay the balance of your holiday in instalments at any time. Balance must be fully paid not less than 8 eeks prior to UK departure. Deposits are non refundable. Balance of deposit must be paid in full by dates stated above. n.b. no prior reminders ill be sent. After this date, bookings ill be cancelled ith loss of all monies paid. 9. ARRIVAL AT RESORT - Check-in from 4.00pm. Check-out from 9.00am. (These times could vary, please check on site) 1. late arrival/early departure charge - 30 per unit (as detailed on page 63 of our Self Catering brochure). 2. Deposit payments - These are both refundable on departure, less any deductions:- (a) House Keeping Deposit - (excluding BBQ) is 50 per unit - payable by cash not cheque. (b) Contents Deposit per unit - payable by cash not cheque OR the folloing option:- Contents Accidental Damage Waiver - costs 15 per unit, this avoids the need to pay 200 per unit deposit in resort. We ill add the 15 premium (nonrefundable) onto your final holiday balance unless requested otherise, at time of booking (see important information on pages of our Self Catering brochure). In the event of any significant damage the first 50 must be paid in resort, any extra is covered up to a maximum of 500. N.B. The above covers accidental damage to 'CONNTS' only. Your actual holiday accommodation must be covered by your Personal Travel Insurance.. Client conduct - Disruptive behaviour - adhering to conditions of booking The company reserves the right to terminate the contract ith any client(s) hose unacceptable conduct disrupts or affects fello holidaymakers or staff, or for non adherence to our conditions of booking including SMOKING (including e-cigs) in coaches, mobile homes and lodges, foul and abusive language and threatening or aggressive behaviour toards staff or guests enroute or abroad. In the event of such contract being terminated their alternative transport or accommodation becomes their on responsibility and the Company could further pursue for costs.
