2 MEETING PROCEEDINGS OF THE ANNUAL GENERAL MEETING OF MOT, 25 th of April 2013 On Thursday, April 25, 2013, the 16 th Annual General Meeting of the Mission Opérationnelle Transfrontalière (MOT) was held in Strasbourg. It brought together its partners: French and neighbouring countries public authorities, States, cross-border cooperation structures, large private companies and various observers concerned by cross-border issues. To date, the association counts 69 members 1 among them 6 natural persons, and 4 founding partners. 6 Welcoming speech by Michel DELEBARRE, Former Minister of State, Senator and Mayor of Dunkerque, President of the Europe 2020 Monitoring Platform of the Committee of the Regions, President of MOT Michel DELEBARRE thanks first of all Nawel RAFIK-ELMRINI, Community counsellor of the Communauté Urbaine de Strasbourg and Vice-president of MOT, for the warm welcome at Strasbourg. He then welcomes the present members, and in particular the elected representatives of the MOT network and its European members, as well as representatives of the States. He also welcomed the new representative of the Caisse des Dépôts and Treasurer of the MOT, Frédéric SABATTIER, as Marthe STEFFANNN has retired. Michel DELEBARRE thanks all of the participants to be present in Strasbourg on the occasion of the 16th Annual General Meeting of MOT, which is held in an important moment, both at the European level and at the national level, with the development of the implementation framework for the cohesion policy (partnership agreement, European programmes) and the clarification of the role of cross-border cooperation stakeholders at all levels, from the local to the European. With regard to the partnership agreement, he assesses the quality of the programming process in France led by the DATAR and the ARF (Association of French Regions): thematic seminars of the INPAP (national authority for the preparation of the partnership agreement) are the opportunity for exchanges involving the representatives of the European Commission, departments and stakeholders on the ground. The technical team of MOT represents the network at most of the seminars in order to defend the interests of cross-border territories. In the French context, he reminds the vocation of the methodological guide book published by the MOT, which is to clarify the role of cross-border cooperation stakeholders. He adds that it will be up to the members of MOT who are present in the French Parliament to ensure that, in the discussions on decentralization laws, the cross-border dimension will not be forgotten. Michel DELEBARRE finally reminds the project to transform the MOT into a GIP (Public Interest Grouping). Its objective is to show the public multi-level vocation of MOT, to strengthen its European position and above all to facilitate its functioning on a daily basis. April 25, Paris - Page 6
7 Opening of the Annual General Meeting 1. Presentation of new members Michel DELEBARRE welcomes the new members who have joined the network since the last Annual General Meeting in 2012: the Agglomération Sud Pays Basque, the Alsace Region, the Electricité Réseau Distribution France (ERDF), the Pôle Emploi Directorate General and the Alzettee Belval EGTC. He excuses the representativee of the Agglomération Sud Pays Basque who is unable to be present this day and passes the word on to the Alsace Region: Regional Council of Alsace Jean-Marie BELLIARD, Counsellor of the Alsace Region and Vice-president of AEBR, stresses the importance of cross-border cooperation as one of the priorities of the current President of the Alsace Region, Philippe RICHERT. Integrated within the Upper Rhine Region, which represents more than 35 years of cooperation and 400 projects financed via Interreg programmes, the Alsace Region is partner of cross-border projects in many areas (economic development, environment, research and innovation, education, civil society). A membership in MOT means for the Alsace Region an opportunity to exchange experiences on cross-border cooperation with members on other borders, with the aim to improve their own practices. Electricité Réseau Distribution France (ERDF) Sylvie COURTIER-ARNOUX, Director of Political Studies Energy in the Public Affairs department of Electricité Réseau Distribution France (ERDF), explains that the interest of ERDF in cross-border action was raised by the arrival of Smart Grids. According to the local configurations in the border territories served by ERDF, these Smart grids can solve problems of cross-border congestionn (exceptional one-time consumption of one side of the border and surplus production on the other) ). ERDF has joined the MOT to raise the interest of this type of cross-border projects. Pôle Emploi Directorate General Ivane SQUELBUT, Territorial director of Pôle Emploi Bas Rhin and representative of the Pôle Emploi Directorate General, shows that the topics treated by MOT such as employment and economic development are priorities shared by its structure. Joining MOT is a way for Pôle Emploi to achieve one of its current objectives: become more present at the local level, especially by developing cross-border partnerships to improve the job finding and make it faster for the job seekers. Alzette Belval EGTC Daniel CODELLO, municipal counsellor in charge of cross-border policy of the city of Esch and member of the Alzette Belval EGTC Board, points out that the latter was created on 8 th of March 2013 to facilitate cross-border cooperation at the Franco-Luxembourg border and to give the cooperation a legal framework. As new member to the MOT, the Alzette Belval EGTC wishes to exchange with the members of the network, learn from their experiences and call upon the expertise of the MOT technical team. 2. Validation of the agenda and functioning of the MOT bodies The agenda is approved unanimously by the present members. The proposition, on the recommendation of the MOT Board, to send from now on the official invitation to the Annual General Meeting by normal letter and not by registered letter with acknowledgement of receipt, is approved unanimously. The proposition to fix the number of meetings of the Board of Directors at a minimum of two meetings per year is approved unanimously. 3. Approval of the meeting proceedings of the Annual General Meeting of April 4, 2012 The meeting proceedings of the 2012 Annual General Meeting are approved unanimously. April 25, Paris - Page 7
8 4. Annual report 2012 The content of the Annual report 2012, which has been sent to the MOT members before the Annual General Meeting, is not be presented in detail again. Many activities of MOT have furthermore already been presented during the Board of Director meeting earlier the same day. For more details see the annual report of MOT Financial report 2012 Results of the financial year 2012 Frédéric SABATTIER, Treasurer of the association, presents the accounts of the year 2012 and notes a surplus result of Own resources of the MOT now lie at a level of , which is reflecting the continuing efforts of the MOT team since 2010 to replenish the own funds of the MOT and so following the recommendations of the statutory auditor to reach own resources of more than Statutory auditor s report Frédéric SABATTIER presents the Statutory Auditor s report. 6. Debate and vote on the reports presented (including the allocation of the result for the year 2012) Debate and vote The Annual Report 2012 is unanimously approved by the Annual General Meeting. The Financial Report 2012 presented by Frédéric SABATTIER is unanimously approved by the Annual General Meeting. The Statutory Auditor's Report presented by Frédéric SABATTIER is adopted unanimously by the Annual General Meeting. The allocation of the 2012 surplus to the carry forward is adopted unanimously by the members of the Annual General Meeting. 7. 9 The MOT Board also suggests adding two new categories in the scale of membership fees, which are: "Members at maritime borders outside of France" for an amount of 3 000, Municipalities, groupings of municipalities and local authorities < inhabitants for an amount of Debate and vote The Annual General Meeting unanimously accepts the membership fees for the years , with the two new categories Members at maritime borders outside of France for an amount of and Municipalities, groupings of municipalities and local authorities < inhabitants for an amount of Presentation on transformation of the MOT into a Public Interest Grouping (Groupement d intérêt public - GIP) by Jean PEYRONY Jean PEYRONY recalls that the process of transformation of the MOT into a Public Interest Grouping (GIP). The executives of the MOT members confirmed in their majority this approach. He informs the Annual General Meeting that the French State is about to decide on an interdepartmental committee meeting on planning and territorial development (CIADT) which would be held in summer The transformation of the MOT into a GIP should be the agenda of the CIADT. The GIP could then be set up on the basis of the CIADT decision. 10.
