Summary The Gibraltar Port Authority (GPA) has prepared this Port Waste Management Plan in accordance with the requirements of the Merchant Shipping (Port Waste Reception Facilities) Regulations 2002, as amended (PWRF) and Directive 2000/59/EC on port reception facilities for ship-generated waste and cargo residues. The plan covers the provision and management of waste reception facilities for ship-generated wastes and cargo residues in the Port of Gibraltar and British Gibraltar Territorial Waters. This 2018 waste management plan is approved by the minister with responsibility for the port. The plan explains the responsibilities of all parties involved in the port waste management chain, including the ship, the ship s agent, waste contractors, GPA, the Gibraltar Maritime Administration (GMA), the Gibraltar Environment Agency and any third parties appointed to assist in the enforcement of the waste reception and handling plans. The plan describes the facilities available for the reception of all types of ship-generated waste and cargo residues that normally use the port noting the volume limitation in Gibraltar due to its limited geographical area and that most vessels calling at Gibraltar do so at anchor. The Plan also covers how the wider waste management system operates in the Port, including reporting, record-keeping, charging system, complaints, consultation and review process. The waste management system operating by the GPA is summarized in figure 1. Reception facilities for oily wastes, cargo residues, noxious liquid substances, sewage, garbage and other hazardous wastes are available for all ships visiting the Port. Appendix 1 contains a list of Port approved waste contractors for ship-generated wastes and cargo residues. All ships must notify GPA of the type and amount of waste they intend to land in the Port at least 24 hours before arrival via the GPA s Vessel Management System (VMS). Notification must be completed via the pre arrival waste declaration form and the shipping agent duly completing the VMS pre arrival notification. Once the vessel is cleared for entry by the GPA s Port Security Facility Officer the waste declaration form is sent automatically via the VMS to the GPA s contracted agents to ensure compliance with the Gibraltar Merchant Shipping (PWRF) Regs 2002, as amended. Ships without sufficient dedicated storage capacity on board to store current waste, and any additional waste generated until the next port of call must ensure that all waste is delivered into reception facilities before leaving Port. Regardless if ships have enough dedicated storage space, if there are good reasons to believe that adequate facilities are not available at the intended port of delivery, or if this port is unknown, and there is therefore a risk that the waste will be discharged at sea, the GPA shall take all necessary measures to prevent marine pollution, if necessary by requiring the ship to deliver its waste before departure from the port. 5 Ships should dispose of their waste in a responsible manner into the reception facilities provided by the GPA, in accordance with this waste management plan. Ship s agents brief vessels on waste reception arrangements in the Port and provide them with a port waste management summary information sheet (Appendix 2). All ship-generated waste must be delivered to operators that have been approved by the GPA, as they have submitted all relevant licenses for proper handling (treatment and final disposal) of the specific waste (Part 5A of the Public Health Act 1950) All ships except cruise liners, super yachts, ferries and exempted home trade vessels, which account for less then 1% of calls, must pay the GPA s Marpol fee which will entitle them to a free discharge service. The waste management charge covers all of the GPA s costs in running the port waste management system and partially subsidizes the reception facility provided. Ships, and their agents, are required to immediately report any inadequacies in the provision of waste reception facilities to the Port. This plan and waste management system will be monitored and reviewed on a regular basis by GPA management in consultation with port users, waste and other relevant regulators. Page 4 of 52

Introduction The GPA is the duty holder over the port estate and British Gibraltar territorial water it has amongst other responsibilities the duty to operate the port as an efficient maritime centre having due regard to internationally accepted standards of safety and environmental protection. The plan has been updated in order to reflect changes in the new Marpol tariff scheme that has been introduced to promote the discharge of waste form ships calling at the port. The plan ensures the implementation of the requirements of MARPOL 73/78, EU directive 2000/59/EU and 2007/71/EC on port reception facilities for ship- generated waste and the Gibraltar Merchant Shipping, (PWRF) Regs, 2002, as amended. The plan has also been prepared in accordance with the IMO Guide to good practice for Port Reception Facilities providers and users and the MCA Guide Guidance on the Merchant Shipping and Fishing Vessels (PWRF) Regs, 2003 and amendments. The overall objectives of this plan are to: promote the prevention of pollution from ships and to assist in the reduction of the amounts of waste entering the marine environment; fulfil the GPA s legal duties with respect to the management of ship-generated waste, including the requirements of MARPOL 73/78, the relevant EC Directives and Gibraltar Merchant Shipping Regulations, and other waste related legislation; describe the facilities available for the reception of all types of ship-generated waste and how the wider waste management system operates in the port, including reporting and record-keeping requirements, the charging system and the complaints procedure; explain the obligations and responsibilities of all parties in the port waste management chain, from ship to waste contractor; encourage the responsible use of reception facilities in the port and to promote the reuse and recycling of waste, where practical; consult with port users, waste contractors, regulators, and other interested parties on the implementation of the port waste management system. 3. Requirement for Port Waste Management Planning Port waste management planning in Gibraltar and worldwide is a further important step in reducing the impact of shipping on the environment. Ports are required to provide waste reception facilities which are adequate and do not cause undue delay to ships using them. Adequate means being capable of receiving all types and quantities of prescribed wastes from ships normally using the Port, taking into account the operational needs of the port users and the types of ships calling there. 8 The legal requirements for Ports to plan for the provision of waste reception facilities are set out in international and domestic legislation. The key legislation relevant to port waste management planning includes: the International Convention for the Prevention of Pollution from ships 1973, and its 1978 Protocol (MARPOL 73/78); EU Directives 2000/59/EC, 2002/84/EC and 2007/71/EC on Port Waste Reception Facilities for shipgenerated wastes; Gibraltar Merchant Shipping (PWRF) Regs 2002, as amended; European Waste Framework Directive 2008/98; Part VA of the Public Health Act 1950, as amended. 4. The Need for Waste Reception Facilities Gibraltar is a busy and growing port, with around 9000 vessels visiting every year. As a bunkering hub Gibraltar receives all types of commercial ships use the port. The GPA records the types and amounts of ship-generated waste landed in the port (Section 11). This information is analysed in order to determine the need for waste reception facilities and to ensure that the type and capacity of facilities available in the port match the requirements of port users. A summary of the type and capacity of waste reception facilities available in the Port is provided in Table 1. Details of the waste contractors available for ship generated waste and cargo residues are listed in Appendix 1. 9 5. Overview of the Waste Management System Key roles & responsibilities The port s waste management system consists of a number of essential steps and links. Successful transfer of waste from vessels to the waste carrier depends upon effective communication between each link in the waste management chain. A simple overview of this waste management system is shown in Figure 1 and each step is fully described in Sections 5 to 10 of the plan. The Captain of the Port is responsible for the implementation of this port waste management plan. A summary of the roles and responsibilities in the waste management system are described below The Gibraltar Port Authority It is the responsibility of the GPA to provide waste reception facilities that are adequate to meet the needs of all ships normally using the harbour without causing undue delay to the ships. As a key part in meeting this requirement, the GPA must prepare and submit to the Minister with responsibility for the port, a port waste management plan, which must be continually monitored and reviewed every two years. This plan and the waste system operating in the port must comply with the relevant international and Gibraltar regulations. In planning for the provision of waste reception facilities the GPA s responsibilities include: Operating a reporting system to receive, monitor and record information received from vessels on the type and amount of waste to be landed or retained on board (Section 6); Providing waste reception facilities for ship-generated waste landed in the Port (Section 7 & 8); Implementing a procedure for reporting, addressing and rectifying alleged inadequacies of waste reception facilities (Section 9); Levying a mandatory charge to all ships visiting the Port with respect to the provision of port waste reception facilities (unless vessels are exempt) (Section 10); Recording the types and amounts of waste landed/retained on board, as declared by vessels, and the amounts of waste actually landed in the port, as verified by waste contractors (Section 11); Providing information to port users (Section 13); Reporting vessels suspected of port waste infringements to Gibraltar Maritime Administration, VMS and Safe Sea Net, (Section 13); Consulting with regular users on the waste reception facilities provided and review of the port waste management plan (Sections 15 and 16). Reporting any reports of inadequacies with respect to reception facilities to the GMA; Informing the GMA of ships and reception facilities which fail to comply with provisions made under the PWRF Regs 2002, as amended specifically: Page 8 of 52

10 o Any inadequacies of port reception facilities that are reported by ships must be reported whether they are resolved or not as per Regulation 6(2) of the PWRF Regs 2002, as amended, using the form in Appendix 4. o Ships which have not complied with Regulation 12 (2); o Ships which have proceeded to sea without complying with Regulation 13 (1) and 13A (1). o Ships that the GPA has clear evidence have not discharged cargo residues to a waste reception facility in accordance with Marpol 73/38, Reg, 16 (1) Contracted agent to ensure compliance with the Gibraltar Merchant Shipping (Port Waste Reception Facilities) Regulations, 2002 A suitably qualified, private contractor will be contracted to act on behalf of the GPA fulfil the following tasks on the behalf of the GPA: Receive the ship waste information in the form prescribed by regulation 12(1) of the Gibraltar Merchant Shipping (PWRF) Regs, 2002, as amended from the ships agent and ensure the information received is complete, correct and complies with the PWRF Regs. Immediately inform the GPA and the GMA of any ship which fails to provide all the necessary Ship Waste Information within the times prescribed by Regulation 12(2) of the Gibraltar Merchant Shipping (PWRF) Regs, 2002 as amended. Liaise with the ships master or agent to make arrangements for the reception at Gibraltar of any Ship Waste (including delivery of the same to a service provider) when either: o The ship s master or agent requests to deliver any ship waste regardless of whether there is sufficient designated storage capacity on board the ship; o Ensure ships are subject to the GPA s mandatory discharge criteria; o Advise the GPA when there is insufficient designated storage capacity on board the ship for all ship generated waste that has been accumulated or which will be accumulated during the intended voyage of a ship to the next port of call and there are good reasons to believe that adequate facilities are not available at the intended port of delivery or the next port of call is not known to him. Inform the GPA and GMA forthwith of any ship which intends to or has left the Port without complying with any aspect of the PWRF Regs, 2002 as amended. Submit on a monthly basis the amounts and types of waste landed in Gibraltar of ships included in the Marpol Tariff scheme and any other waste landed from ships exempted from the scheme. 11 5.3. Ships Waste generated on board ships must be disposed of as required by the MARPOL convention and PWRF Regs In summary, it is the responsibility of the ship s master to: notify the port of the types and amounts of waste that will be landed in the port, and/or retained on board, at least 24 hours in advance of visit (Section 6); make advanced arrangements for the safe removal of any oily waste, noxious liquid substances, sewage and other hazardous waste with the ship s agent prior to arrival (Section 6); deliver their waste to port reception facilities before leaving the port or terminal(sections 7 & 8); a ship may proceed to the next port of call without delivering the ship-generated waste, if it follows from the information given in accordance with Article 6 and Annex II, that there is sufficient dedicated storage capacity for all ship-generated waste that has been accumulated and will be accumulated during the intended voyage of the ship until the port of delivery and the amount of dedicated storage space complies with the GPA mandatory discharge criteria. If there are good reasons to believe that adequate facilities are not available at the intended port of delivery, or if this port is unknown, and that there is therefore a risk that the waste will be discharged at sea, the GPA shall take all necessary measures to prevent marine pollution, if necessary by requiring the ship to deliver its waste before departure from the port. report any inadequacies in the reception facilities provided (Section 9); and pay the port s mandatory waste management charge to significantly contribute to the cost of port reception facilities, whether they use them or not (Section 10). The above requirements recognize that the ship s master is considered to be the producer of the waste and is therefore responsible for off-loading the waste in an environmental responsible manner to the appropriate waste reception facility and for covering the costs of the reception and disposal of those wastes Shipping Agents Shipping agents act on behalf of vessels and their participation is essential in the passing of information and making arrangements for the reception and disposal of waste. In summary, as the representatives of vessels, shipping agents are responsible for: providing ships that regularly visit the port with a copy of relevant parts of the port waste management plan Section 13); providing vessels with copies of GPA s waste declaration form and for ensuring that these forms are completed and returned to the port at least 24 hours in advance of the vessels visit. Assisting the contracted agents with waste delivery communications between service provider and vessel. Page 10 of 52

12 briefing vessels on waste reception arrangements in the port and providing them with a port waste management summary information sheet which explains the waste reception facilities available and how to use them (Section 13); reporting any inadequacies in the reception facilities provided (Section 9); 5.5. Waste Contractors Port operators handling waste must be registered with the Environment Agency and be in possession of a valid waste License. Port operators approved to handle waste are listed in Appendix 1. Waste contractors are encouraged to remain flexible and timely in their approach to ship s waste, having regard to the limited notice that may be given in some cases or the short period of time that ships may be in port. All waste contractors are responsible for the collection, transport and disposal of ship s waste in accordance with their relevant waste license as issued by the Gibraltar Environment agency. Waste contractors must maintain the physical segregation of waste as per the ships pre-arrival declaration of waste, the GPA and your waste licence from the Environment Agency requires you to complete a waste transfer note (Appendix 6) for every movement of waste when it is received and transferred to another licenced/registered carrier or licenced reception facility. The waste transfer note can be downloaded from these must be kept for a period of a year available for inspection if required Waste contractors handling waste for exempted vessels Marpol Tariff Scheme waste Waste contractors taking waste from ships exempted from the Marpol tariff scheme must report to the GPA the types and amounts of waste landed in Gibraltar by completing the GPA-Annex II waste carriers summary template which can be downloaded from the GPA website and ed to ehsa@port.gov.gi. Waste contractors working for the contracted agents responsible for the implementation of the Marpol tariff scheme do not need to supply the monthly summary as the contracted agents will be responsible for this. Waste contractors must also inform the Senior Port Officer (SPO) of any significant differences between the type and amount of waste declared by the ship and the type and amount of waste actually landed in the Port (Section 11) Waste Carrier service craft and barges All service craft/barge operators carrying out the collection and transportation of waste must ensure that they only collect waste streams for which they have been licenced for and that all waste collected is in accordance with that that has been declared on the ships pre-arrival declaration of waste. All movements of waste must be carried out as Page 11 of 52

13 per the licence issued by Environmental Agency under the provisions of the Public Health Act and accompanied with a waste transfer note thereby ensuring that on board segregation of waste is maintained throughout the complete was transfer process. The waste transfer note Appendix 6 can be downloaded from these must be kept for a period of a year available for inspection if required. Before leaving berth the vessel must be equipped with appropriate number and type of receptacles to cater safely for all segregated waste streams. When collecting waste from ships the person in charge must ensure that each waste stream is maintained segregated, that volumes of waste are in accordance with that which has been previously declared by the ship and that receptacles are not overloaded. In the event that the vessel does not comply with the declared quantities of waste or with the correct segregation of waste you must immediately report this to the Gibraltar Port Authority VTS Senior Port Officer 6. Notification of ship s waste by vessels All ships visiting the port must complete and submit the pre arrival waste declaration form (Appendix 3), at least 24 hours before their arrival, as soon as it is known that the ship is to call at Gibraltar or where the duration of the voyage is less than 24 hrs, at the latest upon departure from the previous port. The waste declaration form must be completed every time a ship visits the Port, whether it is landing waste or not. Information to be notified to the port includes, the type and amount of waste to be delivered, dedicated storage capacity, amount to be retained on board, the port at which the remaining waste will be delivered and the estimated amount of waste to be generated between notification and next port of call. Pre arrival waste declaration forms can be downloaded from The GPA s Website Alternatively, ships can obtain copies of the form from their agents. The waste declaration is to be completed by the Master of the ship and sent to their shipping agents in order to be introduced in the GPA s VMS system 24hrs before arrival. Ships should retain a copy on board for their own waste management records. Copies should be kept on board until at least the next port of call is reached and must be produced on request to the relevant maritime authorities in that port. The contracted agent monitors the waste management forms received on behalf of the GPA. If required shipping agents will be contacted to request any outstanding waste management declarations from vessels due in the Port. Waste contractors must inform the GPA and the contracted agent of any significant changes in the type and amounts of waste declared and landed. Page 12 of 52

14 Vessels who have submitted waste declarations with outstanding, incomplete, inadequate or inaccurate information and failing to meet the pre-notification requirements will be charged a 200 fee as per Regulation 12 2A of the Gibraltar Merchant Shipping (Port Reception Facilities) Regulations, 2002, as amended, and be reported to the GMA. The information notified to GPA by ships is stored, recorded and analysed by the GPA. The GPA s record- keeping and reporting system is described in Section Waste reception facilities Reception facilities for oil and oily mixtures, cargo residues, noxious liquid substances, hazardous waste, garbage, sewage wastes and wastes associated with air pollution systems are available at the GPA. The GPA provides a list of approved waste contractors (Appendix 1). The GPA s contracted agent for PWRF s will arrange waste discharge for all vessels included in the Marpol tariff scheme. Ships which have been excluded from the Marpol scheme and exempted vessels may make there own arrangements through their agents using approved waste contractors Garbage Wastes The GPA license s waste operators to provide reception facilities for ship generated garbage wastes which include the following: Plastic; Ground-down paper products, rags, glass, metal, bottles, crockery etc; Cargo residues, paper products, rags, glass, metal. bottles, crockery etc; Food waste (including International Catering Waste); Floating dunnage, lining or package materials; Incinerator ash. Garbage waste can be collected by waste contractors in suitable containers, which will be delivered alongside by barge or service craft or on the quayside. All garbage waste streams must be kept segregated to enable it downstream treatment i.e. recycling Oily Wastes Reception facilities for oily wastes are provided. Contact details for waste contractors licensed to receive and dispose of oily wastes are provided in Appendix 1. Ship-generated oily wastes include: Oily bilge water; Oily residues (sludge); Oily tank washings (slops); Page 13 of 52

15 Dirty Ballast Water; Oily mixtures containing chemicals; Scale and sludge from tank cleaning. Oily wastes may be collected by road tanker or by barge. Most waste contractors require at least 24 hours notice to collect oily waste. Any oil contaminated garbage, such as oily filters or rags, must be treated as a hazardous waste and collected by an approved waste contractor. These wastes must be collected in drums or bags Noxious Liquid Substances & Cargo Residues Cargo residues are the remnants of any cargo material on board in cargo holds or tanks which remain after unloading procedures and cleaning operations are completed, including excesses and spillage from loading or unloading. Reception facilities for cargo residues are arranged depending upon the type of cargo (hazardous or nonhazardous) and nature of the waste (such as sweepings, solid materials or noxious liquid substances). Contact details for waste contractors licensed to receive and dispose of cargo residues in the form of noxious liquid substances are provided in Appendix Sewage Wastes Sewage may be discharged at sea in accordance with Regulation 11 of Annex IV of MARPOL 73/78. Vessels do not need to notify information about sewage or land sewage if it is the intention to make an authorised discharge at sea. Contact details for waste contractors licensed to receive and dispose of sewage wastes are provided in Appendix 1. Sewage waste is collected from ships by road tanker and requires at least 24 hours notice Residues from exhaust gas cleaning systems and ozone-depleting substances Disposal of Marpol Annex VI wastes such as exhaust gas-cleaning residues, are arranged depending on the type of waste produced. Waste contractors listed in Appendix 1 are able to collect and dispose of these wastes Hazardous Wastes Hazardous waste is defined in section 192K of the Public Health Act 1950, as amended. They are any waste substances that are considered a threat to people or the environment by virtue of their hazardous properties, including explosive, flammable, oxidising, irritant, toxic, harmful, carcinogenic or corrosive properties. Hazardous wastes appear as an entry denoted with an asterix in the European Waste Catalogue. In addition to the oil wastes and noxious liquid substances described above, ship-generated hazardous wastes can include the following: fluorescent tube light bulbs; tyres; adhesives & resins; mercury dry cell batteries; lead batteries; nickel - cadmium batteries; drums containing oil or oily residues; oil contaminated materials; paint tins & paints; aerosols; coolants; acids ; materials containing asbestos; electrical, electronic equipment (telephones, monitors, televisions, etc.); ships pyrotechnics; expired ships medicine stores ; drums containing chemicals, such as cleaning products, detergents, degreasers etc with hazardous properties. 16 Hazardous wastes must never be placed in ship s garbage skips. The contact details for approved hazardous waste contractors are detailed in Appendix 1. All ships hazardous wastes must be managed according to Part VA of the Public Health Act as amended, which set out procedures to be followed when receiving, carrying and disposing of hazardous waste. The Master of the ship is responsible for obtaining and completing a waste receipt / transfer note before any hazardous waste is removed from a ship by an authorised waste contractor (see Appendix 1). Ship s crew are reminded that hazardous wastes must never be mixed with non hazardous waste streams and that all hazardous wastes must be segregated from each other and placed in clearly labelled leak- proof containers Recycling Facilities for Ships Waste Vessels visiting the Port of Gibraltar are encouraged to manage waste responsibly, including the following principles: Reduce (reduction of the amount of waste generated); Re-use (either for the same or a different purpose); Recycle (to recover value from the waste). The number of ships with waste treatment and minimization facilities on-board, such as compactors, oily separators, incinerators and sewage treatment plants, has increased greatly over the last decade and will continue to do so in to the future. 8. Delivery of waste Vessels calling at the Port of Gibraltar must ensure that all waste is delivered into reception facilities before the ship leaves the port. The only exceptions to this are as follows: 1. if the waste is sewage and it is the intention to discharge at sea in accordance with Regulation 11 of Annex IV of MARPOL 73/ the vessel has sufficient dedicated storage capacity available on board to store the current waste, and any additional waste that will be generated in the period until the ship reaches the next port of call where it can be landed and it complies with the GPA S mandatory waste discharge criteria( section 8.1). All ships pre-notify the GPA of the type and quantities of waste retained on board, the storage capacity for those wastes, the port where remaining waste will be delivered and the amounts of waste generated before that port is reached, as described in Section 6. All vessels should dispose of their waste in the facilities provided in a responsible manner, in accordance with this waste management plan. Ship s agents brief vessels on waste reception arrangements in the port and provide them with a port waste management summary information sheet (Appendix 2), which explains the waste reception facilities available. 17 If the provision of waste reception facilities has been inadequate in any way, vessels or their agents are encouraged to make a complaint (Section 9). Where the type and amount of waste actually landed in the port differs significantly from what the ship declared prior to its arrival, the waste contractor must inform the GPA s SPO who will investigate the cause of the discrepancy. 8.1 Mandatory waste discharge Vessels calling at Gibraltar for order, whose next port of call is unknown or next port of call is outside the EU will be subject to mandatory discharge of waste if they have less than the dedicated storage space table 2 below for the specified wastes: SHIPS FOR ORDERS, NEXT PORT UNKNOWN OR OUTSIDE EU Waste Type Annex I (Oily wastes) Annex V (Garbage) % Storage space remaining 75% 75% Table 2 Mandatory discharge criteria 9. Reporting inadequacies in waste reception facilities Vessels, and their agents, are requested to immediately report any inadequacies in the provision of waste reception facilities to the SPO and the GMA (see Appendix 2 for contact details). All comments or complaints will be investigated as they arise and any deficiencies rectified. Records of all observations and complaints on waste reception facilities are kept on record and are available for the GMA to access, as necessary. Complaints can be made by any means, in person, telephone, or fax. Vessels, and their Agents, are encouraged to make complaints using a waste reception facilities complaint form Appendix 4, alternatively the form can be downloaded via the GPA Website The complaints form should then be returned to GPA by on SPO@port.gov.gi or by fax on , for the attention of the SPO. Port users are informed of the complaints procedure and how it works by the following means: Waste management plan held by all ship s Agents (who are encouraged to copy the plan, or relevant extracts of it, to regular calling vessels). 18 In the event that a complaint is not successfully resolved by the GPA to the master s satisfaction and a vessel is unable to offload waste to shore reception facilities, the master should raise the alleged inadequacy directly to the GMA. Gibraltar and foreign flagged ships: Masters, ship owners and agents should complete the form in Appendix 4 and send it to the GMA (contact details in Appendix 2). IMO has developed an internationally agreed complaints procedure. This procedure requires the vessel s Master to complete a complaint form and submit it to their Flag State administration. The Flag State will then contact the IMO and the Port State. A formal complaint may be made as follows: Foreign flagged ships: Masters, ship owners or agents should contact their own flag, who should take the appropriate action through the International Maritime Organisation (IMO). 10. Mandatory Waste Management Charge Marpol Tariff Scheme The GPA is required to levy a mandatory charge to cover a significant proportion of the costs incurred by the Port in providing reception facilities for ship-generated waste. The GPA s mandatory waste management charge subsidizes the cost of waste reception facilities for ship generated waste in Port irrespective of the actual use of the facilities, such charges shall be of a level to: Ensure that each ship to which this regulation applies, in line with the polluter pays principle make a significant contribution to such costs: a) So that the part of the costs not covered by the Marpol tariff contribution, if any, shall be covered on the basis of the types and quantities of ship generated waste actually delivered by the ship; and b) To provide no incentive for ships to discharge ship generated waste into the sea. Cruise ships, ferries, super yachts have been excluded from the Marpol tariff scheme and will not be charged the Marpol tariff. Home trade vessels which have been exempted from the Marpol tariff scheme will also not be charged the Marpol tariff Marpol Tariff Scheme Unless excluded or exempted, all ships calling at Gibraltar must pay the Marpol Tariff irrespective of the use of the facility. The Marpol tariff will entitle ships to a free discharge amount of specified wastes depending on its tonnage bracket. The Marpol tariff per tonnage bracket is presented in appendix 2. Page 17 of 52

19 Free discharge of waste is limited to the western anchorage and at berth. Vessels wanting to discharge on the eastern anchorage will be charged barging fees according to the terms and conditions of the service provider. Appendix 7 details the terms and conditions of the contracted agents for waste discharge Ships outside Marpol Tariff Scheme Ships that are excluded or exempted from the Marpol tariff scheme must make their own arrangements for the delivery of waste through their agents using authorised waste contractors detailed in appendix Cargo Residues and Noxious Liquid Substances Cargo residues and Noxious Liquid Substances will not receive the Marpol discount as this waste is exempted by Article 10 of EC Directive 2000/59 EC Delivery of cargo residues. The master of a ship calling at a Community port shall ensure that cargo residues are delivered to a port reception facility in accordance with the provisions of Marpol 73/78. Any fee for delivery of cargo residues shall be paid by the user of the reception facility. 11. Record-Keeping and Reporting The information notified to the port by ships is automatically sent to the contracted agents to ensure compliance with the Gibraltar Merchant Shipping (Port Reception Facilities) Regulations 2002 as amended. The contracted agents must ensure the Port Authority receives a monthly summarized data set of the vessels calling at Gibraltar by means of an Excel Spreadsheet containing the declared ship generated waste and cargo residues aboard each vessel, how much waste was discharged if any and how many of these vessels have discharged waste in Gibraltar. The original Waste Declaration Forms are kept indefinitely by the VMS system and by the contracted agent for a period of 3 years. Waste contractors are to submit a summarised monthly summary as per appendix 8 to the GPA at ehsa@port.gov.gi. The submission of monthly summary reports by waste contractors and the information provided by the contracted agents detailing the declared amounts of waste to be landed from each vessel. A port waste management database including data on the type and amount of waste to be landed in the port and/or retained on board, as reported by each vessel visiting the Port, and the amounts of waste actually landed in the Port will be kept by the GPA to provide long-term records for the purposes of statistical analysis. All information held by GPA will be available for the GMA to access, as required. Every month the data in the waste management database is analysed, providing a monthly report containing the following statistics: Page 18 of 52

20 total number of vessel movements under the regulations per month total number of vessels returning waste declarations per month total number of vessels reporting that they are landing waste per month total number of vessels reporting that they are retaining waste per month total amounts of each category of waste landed in the Port, as declared by ships total amounts of each category of waste retained on board, as declared by ships total amounts of each category of waste actually landed in the Port by ships, as verified by waste contractors. The data from the monthly report is brought together to provide the annual information. 12. Vessels outside the Regulations The PWRF Regs 2002, and its amending legislation, do not apply to: War ships; Naval auxiliaries; Ships owned or operated by a Sate and used, for the time being, only on government non-commercial service. However should any of these vessels request the use of garbage reception facilities, appropriate facilities will be arranged. 13. Exemptions When ships are engaged in scheduled traffic with frequent and regular port calls and there is sufficient evidence of an arrangement to ensure the delivery of ship-generated waste and payment of fees in a port along the ship's route the Minister with the responsibility for the Port and Shipping may exempt these ships from the following obligations: Article /58 EC, Regulation 12 of the Gibraltar Merchant Shipping (Port Waste Reception facilities) Regulations 2002, as amended Notification; Regulation 13 of the Gibraltar Merchant Shipping (Port Waste Reception Facilities) Regulations, 2002, as amended - Delivery of ship generated waste; Regulation 14 of the Gibraltar Merchant Shipping (Port Waste Reception Facilities) Regulations, 2002, as amended Fees for ship generated waste; Ships requiring exemption must submit an application as per appendix 9 to the Gibraltar Port Authority for consideration. 21 The Gibraltar Port Authority shall cause a report under Regulation 15(6) to be provided to the GMA, at least once a year for submission to the Commission. 14. Information provided to Port Users All vessels calling at the Port of Gibraltar are represented by shipping agents. The port waste management plan is provided to all agents, who are encouraged to provide a copy of the plan, or extracts of it, to regular port users. In addition, vessels are briefed by their agent on arrival at the port. A port waste management summary information sheet (Appendix 2) should be provided to ships as this summarizes the reception facilities available, arrangements for their delivery and how to use them, together with a summary of the complaints procedure and contacts agents are also responsible for ensuring that all of their vessels are provided with copies of pre arrival waste declaration form and complaints form. Information is also available to port users, and other interested parties, on the GPA s website Copies of the waste declaration form and complaints form can be downloaded from the website. 15. Ship Compliance - Enforcement Any ship may be subject to an inspection by a GMA Port State Control Officer in order to verify that it complies with Regulations 13(1), 13A (1) and 16(1) of the Gibraltar Merchant Shipping (Port Waste Reception Facilities) Regulations, 2002, as amended. The Gibraltar Maritime Administration shall also ensure inspections are carried out in compliance with the Gibraltar Merchant Shipping (Port State Control) Regulations, 2011, as amended. Any vessels failing to comply with the requirements to notify the GPA within the prescribed 24hr period will attract a 200 fee. Any vessel that fails to offload ship generated waste, if required to do so, will be reported to the Gibraltar Maritime Administration. Such ships may then be subject to inspection by the GMA and destination ports will be informed of the vessel s suspected non-compliance. The Owner or Master of a vessel that fails to comply with the requirements may be guilty of an offence and liable on summary conviction to a fine. Any suspected port waste infringements are reported using the VMS which automatically shares data with other EEA states through the SafeSeaNet system. Page 20 of 52

22 16. Port Waste Management Plan Review The GPA s waste management plan will be subject to the GPA s annual 9001 internal audit. The plan will be reviewed no later than two years since the approval of the most recent plan or within a twelve month period if any significant changes in the operation of the port occur. 17. Consultation of Port Waste Management Plan The GPA s waste management plan has been distributed to stakeholders for comments and review. Any corrections, suggestions for amendments or comments on this plan received from consultees will be considered and addressed, as appropriate. As part of the port waste management plan s amendment procedure, any changes made will be notified and circulated to all plan holders.
