1 Väljaandja: Majandus- ja kommunikatsiooniminister Akti liik: määrus Teksti liik: terviktekst Redaktsiooni jõustumise kp: Redaktsiooni kehtivuse lõpp: Avaldamismärge: Välisriigi lippu kandvaid laevu kontrolliva järelevalveametniku kvalifikatsiooninõuded ja laevakontrolli akti vorm Vastu võetud nr 94 RTL 2003, 74, 1086 jõustumine Muudetud järgmiste määrustega (kuupäev, number, avaldamine Riigi Teatajas, jõustumise aeg): nr 117 (RTL 2003, 89, 1321) nr 271 (RTL 2004, 6, 72) Määrus kehtestatakse «Meresõiduohutuse seaduse» (RT I 2002, 1, 1; 61, 375; 63, 387) 76 lõike 6 alusel, võttes arvesse Euroopa Liidu 19. juuni aasta direktiivi 95/21/EC koos parandustega ning Pariisi vastastikuse mõistmise 26. jaanuari aasta memorandumi. 1. Reguleerimisala Käesoleva määrusega kehtestatakse välisriigi lippu kandvaid laevu kontrolliva järelevalveametniku kvalifikatsiooninõuded ja laevakontrolli akti vorm (määruse lisa). [RTL 2003, 89, jõust ] 2. Järelevalveametniku kvalifikatsiooninõuded (1) Välisriigi lippu kandvaid laevu kontrolliva järelevalveametnikuna võib töötada Eesti kodanik, kes valdab inglise keelt kesktasemel ning kellel on: 1) piiranguteta 3000 või suurema kogumahutavusega laeva kapteni diplom ja vähemalt viis aastat laevajuhi tööpraktikat; või 2) 3000 kw ja suurema peamasinate koguvõimsusega laeva vanemmehaaniku diplom ja vähemalt viis aastat laevamehaaniku tööpraktikat; või 3) laevaehitaja või mõnel teisel merendusega seotud eriala inseneri diplom ja vähemalt viis aastat töökogemust oma märgitud erialal; või 4) kõrgharidus ja tunnistus laevakontrolli inspektorite ettevalmistuskursuste lõpetamise kohta. (2) Enne iseseisvat välisriikide laevade kontrollimist peab punktides 1 ja 2 nimetatud laevakontrolliinspektor töötama vähemalt ühe aasta ja punktides 3 ja 4 nimetatud laevakontrolliinspektor vähemalt kaks aastat Eesti riigilippu kandvate laevade ülevaatusel ja kontrollimisel ning vastavate konventsionaalsete dokumentide vormistamisel. 3. Rakendussätted Laevakontrolliinspektor, kes töötas laevakontrolliinspektorina enne 2. oktoobrit a, võib jätkata tööd laevakontrolliinspektorina. IMO gross number:..., tonnage:..., port of flag registry:..., state:..., type of date on which keel was ship:..., laid:..., owner:..., master:..., agents:..., classification society:..., berthed at:... has been detained in accordance with the provisions of 78 of the Maritime Safety Act of December 12, 2001, Regulation No 266 of Minister of Economic Affairs and Communications of December 29, 2003 «Procedures for Carrying Out Inspections of Ships Flying a Foreign Flag» on account of: one or more of the criteria for detention set out in Annex VI of Council Directive 95/21/ EC of June 19, 1995 (Official Journal of the European Communities No L 157); crew members being unable to provide proof of professional proficiency for the duties assigned to them as mentioned in article 11 of Council Directive 2001/25/EC of 4 April, 2001 (Official Journal of the European Communities No L 319); master or crew unable to comply with operational requirements as contained in the Conventions mentioned in 78 Maritime Safety Act; other deficiencies which, individually or together, are clearly hazardous to safety, health or environment; the fact that the Port State Control Officer was obstructed in the execution of his duty. In accordance with the provisions of 78 of the Maritime Safety Act it is prohibited to shift the ship to another berth without the prior consent of the Port State Control Officer, or to proceed to sea without a proper Notice of Release of ship from detention.
