9 Steps to be taken decisions to be made Actions by owner: - Appoint owners agent locally in this case this was crucial in order to get a good outcome - Look at different towage options as it was difficult to get foreign tugs into Russia to pick up the vessel - One set of tugs/icebreakers from anchorage position to Kirkenes - Owners were offered tugs via different broker channels that all promised that they could get permission to pick up the vessel in Russian waters. None of them delivered. - Which resources are available locally and which are we allowed to use? Fight between local controlled resources and resources controlled by Moscow. - Gosmorspassluzba operator AHTS Kapitan Martyskin. This company performs rescue operations in Russia. - Rosmorport operator i/b Dikson. This company performs ice-breaker assistance, manages port facilities in Russia. 9

10 Russian Rules: As I explained towage of Foresight it is a bit political question It is necessary to differ between ice-breaker assistance, which in accordance with the General rules of sailing and moorage in sea ports of the Russian Federation (RF Ministry of Transportation order 140) is obligatory for Rosmorport, and Towage of a vessel at ice conditions. In accordance with the order 140 Rosmorport arranges ice-breaker assistance for vessels sailing in/out of port to/from ice edge. (p. 173 of Rules). In this case in accordance with the Rules a vessel that is being assisted must be in running order : be in possession of actual ice class (p. 175 of the Rules), be able to follow an ice-breaker not deviating the arranged canal, not give speed ahead, be able to give full speed astern etc. (p. 176, 177 of the Rules). Arranging a towage at ice conditions as well as ice-breaker assistance out of the borders of ice edge sailing out of port is not obligatory for Rosmorport. Thus Rosmorport has no right to refuse ice-breaker assistance of a seaworthy vessel up to ice edge sailing out of port. However Rosmorport has a right to reject further assistance or towage of a non-seaworthy vessel. +++ While typing this message I have got call fm Rosmorport who proposed seems to be balanced and amicable solution!!!
