14 Regional Population Access 13 By the time the Sports and Entertainment Centre opens in 2016/2017, access will be enhanced with: Bridges with 9 lanes over the Athabasca River Completed interchanges on Hwy 63 Direct access to Highway 63 from Franklin Avenue Designated bus lanes on major roads and Hwy 63 Integrated transit system with Franklin Avenue Transit Way Prairie Loop Boulevard with additional east-west access Enhanced road connections in City Centre Enhanced streetscape and corridors
15 Parking Strategy When the Sports and Entertainment Centre opens in 2016/2017, parking will be improved with ongoing strategies to: Maintain on-street parking Enforce bylaws to prevent vehicles parking for extended periods of time Replace surface parking with parking structures in new developments to meet demand Develop new multi-level parking structures Share parking between land uses and activities at different times of day A phased parking demand and supply analysis prepared by IBI Groups informs ongoing parking solutions 14

19 Land Expropriation Negotiated with owners to purchase properties at market value Acquired several properties but unsuccessful to negotiation with some parties Notices of Intention to Expropriate were served to property owners, tenants and all other parties with registrations on title 6 parties objected to expropriation, including 2 owners and 4 tenants related to 3 of the properties Provincial Ministry of Justice and Attorney-General appointed an inquiry officer for an inquiry hearing held March 4-8,
20 Objective of Inquiry Hearing To examine whether the intended expropriation by the Municipality is fair, sound and reasonably necessary for the achievement of the objectives of the Municipality. 19
21 Findings of Inquiry Officer 1. Required fairness in advising owners and other interested parties of public hearings with respect to the intended use of the lands and providing to them sufficient information about the project and land requirement The Municipality was not in the position to interfere in the landlord and tenant relationship The Municipality has satisfied the requirements of Municipal Government Act and Expropriation Act 20
22 Findings of Inquiry Officer 2. Details of the proposed project are not sufficiently advanced for the Municipality to make a reasoned decision as to the appropriateness of the project and the identification of the required lands Construction of a Sports and Entertainment Centre is a proper municipal purpose for expropriation Used the CCARP to inform the location of the Centre The Municipality has conducted necessary feasibility analysis to select a location 21
23 Findings of Inquiry Officer Suggested that expropriation is not required at the stage of issuing a Request for Proposal Recommended by PricewaterhouseCoopers to pursue the procurement process with a specific site secured Issuing RFP is a crucial step for the construction of the Centre 4. Adequate provisions are not made to provide access to Nomad Hotel parking and for deliveries to the Keg Restaurant A parking options plan was created to evaluate various parking alternatives for affected parties Shared Access Easements are proposed to provide access
24 Key Considerations The Report prepared by the inquiry officer concludes his findings based on the hearing. It is not a binding decision and Administration does not agree with the conclusion. Decisions on compensation will be made by Land Compensation Board if the parties cannot agree. Administration will continually comply with legislative requirements to ensure an open and transparent process. 23
25 Recommendation Complete the land expropriation process securing a site for the Sports and Entertainment Centre. Release the Request for Proposals, upon the completion of land expropriation, to the four shortlisted proponents. 24
