Haar Executive Secretary Minnesota Public Utilities Commission 121 7th Place East, Suite 350 St. Paul, MN RE: Certificate of Need Notice Plan In the Matter of the Application for a Certificate of Need for the Sandpiper Pipeline Project in Minnesota from the North Dakota Border to the Wisconsin Border Docket No. PL6668/CN Dear Dr. Haar: In compliance with Minnesota Rule , Enbridge Pipelines (North Dakota) LLC, 1 ( EPND ) hereby files with the Minnesota Public Utilities Commission ( Commission ) its proposed plan for providing notice to all persons reasonably likely to be affected by its Sandpiper Pipeline Project ( Project ), as described below. Minnesota Rule requires EPND to file this plan for approval by the Commission at least three months before filing an application for a Certificate of Need ( CN ) under chapter 7853 of the Minnesota Rules. EPND intends to file CN and Pipeline Route Permit applications after receiving the Commission s approval of and implementing this proposed Notice Plan, pursuant to Minnesota Statutes Section 216B.243 and Minnesota Rule Chapter The application will seek approval to construct the Minnesota portion of the proposed 565- to 608-mile, 24-inch diameter Sandpiper Pipeline and associated facilities. Ultimately, the Project will transport crude oil from EPND s Beaver Lodge Station south of Tioga, North Dakota to an existing Enbridge affiliate s terminal in Superior, Wisconsin. The Project s initial capacity will be 225,000 barrels per day (bpd) into Clearbrook, Minnesota and 375,000 bpd into Superior, Wisconsin. The Project has a planned in-service date of first quarter Enbridge Pipelines (North Dakota) LLC is a wholly owned subsidiary of Enbridge Energy, Limited Partnership. 2 Under Minnesota Statutes Section 216B.243 and Minnesota Rule Chapter , a certificate of need is required for a pipeline greater than six inches in diameter and having more than 50 miles of its length in Minnesota used for the transportation of crude petroleum.

2 EPND is in the process of finalizing the Project route. To the extent practicable, EPND is attempting to have much of the route co-located within Enbridge Energy, Limited Partnership s existing pipeline right-of-way or other utility corridors in Minnesota. EPND is focusing on two general pipeline corridors. In Minnesota, both routes follow the EPND System from the North Dakota border south of Grand Forks, North Dakota to Clearbrook, Minnesota. Proceeding east, the northern route would follow the Enbridge Energy, Limited Partnership System ( Mainline ) corridor, traversing approximately 256 miles across Polk, Red Lake, Clearwater, Beltrami, Hubbard, Cass, Itasca, Aitken, St. Louis, and Carlton Counties in Minnesota, and terminating in Superior, Wisconsin. The southern route would depart from the existing Mainline corridor at Clearbrook, going south to Hubbard, Minnesota and then east, following parts of existing electrical transmission and railroad lines approximately 302 miles across Polk, Red Lake, Clearwater, Hubbard, Cass, Crow Wing, Aitkin, and Carlton Counties, Minnesota before terminating in Superior, Wisconsin. The Project will include three or four pumping stations in Minnesota, dependent on route selection, power availability and detailed hydraulic modeling, in addition to necessary valves, metering, and monitoring equipment. Attachments 1a and 1b depict the proposed pump station locations. The figures reflect a design along the southern route that utilizes three pump stations. A fourth station may be required pending hydraulic analysis. A location for a potential fourth station has not been determined at this time. The permanent right-ofway and temporary workspace land requirements will vary depending on the route selected. Table 1 includes the potential land requirements for the two route options. Table 1. The Project will transport growing production from the Bakken Formation in North Dakota to the Superior, Wisconsin terminal and then connect to various other pipelines, expanding access to refinery markets in the U.S. Midwest and beyond. The Project is a positive step toward North American energy security and independence that will increase access to a growing, long-term and reliable domestic source of energy and decrease reliance on crude oil imports from countries that are often unstable or unfriendly to United States interests.

INTRODUCTION Enbridge Pipelines (North Dakota) LLC ( EPND ) submits this Notice Plan for approval by the Minnesota Public Utilities Commission ( Commission ) pursuant to Minnesota Rule EPND is a wholly owned subsidiary of Enbridge Energy Partners, Limited Partnership ( EEP ), which is a Delaware master limited partnership headquartered at 1100 Louisiana, Suite 3300, Houston, TX Enbridge Energy, Limited Partnership, a wholly owned subsidiary of Enbridge Energy Partners, Limited Partnership and an affiliate of Enbridge Inc., owns and operates the U.S. portion of the existing Enbridge Mainline System. Collectively, these affiliated entities are referred to as Enbridge. EPND intends to file applications for a Certificate of Need ( CN ) and a Pipeline Routing Permit, seeking approval to construct the Minnesota portion of the proposed Sandpiper Pipeline Project ( Project ), a 565- to 608-mile, 24-inch diameter pipeline and associated facilities to transport crude oil from the company s Beaver Lodge Station south 1

7 of Tioga, North Dakota to an existing Enbridge affiliate terminal in Superior, Wisconsin. Initial capacity will be 225,000 barrels per day (bpd) into Clearbrook, Minnesota and 375,000 bpd from Clearbrook into Superior, Wisconsin. The Project will transport growing supplies of North Dakota crude oil to the Superior, Wisconsin terminal and then connect to various other pipelines, eventually providing refineries in the United States and eastern Canada with crude oil. The Project is a positive

8 step toward North American energy security and independence that will increase access to a growing, long-term and reliable domestic source of energy and decrease reliance on crude oil imports from countries that are often unstable or unfriendly to United States interests. The Project requires a CN under Minnesota Statues Section 216B.243 and Minnesota Rule Chapter 7853 because the proposed pipeline is greater than six inches in diameter and has more than fifty (50) miles of its length in Minnesota and will be used for the transportation of crude petroleum. Minnesota Rule requires a Notice Plan to be submitted for review by the Commission at least three months before filing a CN application for any pipeline under Chapter 7853 of the Minnesota Rules. Therefore, EPND submits this Notice Plan for the Commission s approval. II. SANDPIPER PIPELINE PROJECT Enclosed as Attachment 1a is an overview map showing the general location of the northern and southern proposed pipeline routes in Polk, Red Lake, Clearwater, Beltrami, Hubbard, Cass, Crow Wing, Itasca, Aitkin, St. Louis, and Carlton Counties, Minnesota. This map shows the proposed Project beginning at the Beaver Lodge pump station near Tioga, North Dakota and proceeding east to the existing Enbridge affiliate terminal in Superior, Wisconsin. The map depicts other components of the EPND system in North Dakota, including the existing EPND Line 81 as it extends from North Dakota to the Enbridge Clearbrook Station and Terminal Facility in Clearwater, Minnesota. The overview map also shows Enbridge s existing Mainline system, extending from the Canadian border near Neche, North Dakota to Superior, Wisconsin. The proposed notice area is defined as all properties within 700 feet (350 feet on either side) of the proposed centerlines for the northern and southern Sandpiper pipeline routes. This notice area was designed to provide sufficient flexibility for Enbridge to refine route options while ensuring landowners and members of the public in areas reasonably likely to be affected by the Project receive notice. Depending on final route selection, some landowners that receive notice will not be affected by the Project. Route maps illustrating the proposed northern and southern routes and the notice area are enclosed as Attachment 1b. EPND prepared the proposed Notice Plan as the initial step in the Certificate of Need application process. The Commission s Review and approval of the Notice Plan will ensure that interested persons have the opportunity to participate in the proceedings. 3

9 III. PROPOSED NOTICE PLAN EPND submits this Notice Plan to ensure that the appropriate notice is provided to interested parties. The notice consists of direct mail and publication, including: Attachment 2 Direct mail notice to landowners with property currently traversed by the proposed centerlines of the Sandpiper Pipeline Project routes. Attachment 3 Direct mail notice to landowners and mailing addresses that are not currently traversed by the proposed centerlines of the Sandpiper Pipeline Project routes but are within 350 feet on either side of the proposed centerlines. This also includes non-landowner mailing addresses that fall within 350 feet on either side of the proposed centerlines. These individuals could potentially be affected by the Project; however, some individuals that receive notice may not be impacted, depending on final route selection. Attachment 4 Direct mail notice to tribal, local, county, state and federal government officials. Direct mailing addresses for local government officials are enclosed as Attachment 4a. Attachment 5 General notice for publication in local and state-wide newspapers. A list of local and state newspapers is enclosed as Attachment 5a. A. Direct Mail to Landowners Minnesota Rule , Subparts 3(A) and 3(B) require EPND to provide direct mail notice (see Attachments 2 and 3) to all landowners and mailing addresses reasonably likely to be affected by the Project. EPND will provide direct mail notice to landowners with property in Minnesota that is traversed by the centerline of the proposed northern and southern Sandpiper Pipeline routes as well as to landowners or mailing addresses within 350 feet on either side of the proposed centerlines. The proposed notice letters are as follows: Attachment 2: Letter to landowners in Minnesota whose property is traversed by the centerlines of the northern or southern pipeline routes. EPND will rely on county tax records or mailing lists available from the United States Post Office to accurately identify such landowners and create its list of mailing addresses. Attachment 3: Letter to Minnesota landowners and mailing addresses located within 350 feet on either side of the proposed pipeline centerlines but which are not currently traversed by the proposed centerline of the northern or southern pipeline routes. As noted in Attachment 3, these landowners could potentially be affected by 4

10 the Project; however, some landowners that receive notice may not be impacted, depending on final route selection. EPND will rely on county tax records or mailing lists available from the United States Post Office to create a list of mailing addresses. B. Direct Mail to Local Governments. Minnesota Rule , Subpart 3(C) requires an applicant for a CN under Chapter 7853 to provide direct mail notice to tribal governments and to the governments of towns, statutory cities, home rule charter cities, and counties whose jurisdictions are reasonably likely to be affected by the Project. Direct mail notice (See Attachment 4) will be provided to tribal, city, township and county governments traversed by the proposed northern and southern pipeline routes, as well as state Senators and state Representatives and U.S. Senators and U.S. Representatives representing constituents in the public notice area. The list of local government officials receiving direct mail is provided in Attachment 4a. EPND will also include the governmental entities listed in Minnesota Rule , subpart. 6, which governs distribution of pipeline routing permit applications. C. Published Notice Minnesota Rule , Subpart 3(D) requires an applicant for a CN under Chapter 7853 to provide a published newspaper notice to members of the public in areas reasonably likely to be affected by the Project. The notice provided in Attachment 5, along with a black-and-white version of the Project map, will be published in the newspapers identified in Attachment 5a. D. Content of Notice Minnesota Rule , Subpart 4 identifies certain information that must be provided by an applicant for a CN in notices provided and described under this Notice Plan. Consistent with the rules, the notices will contain: maps depicting the location of the proposed northern and southern routes (Subpart 4a); a general description of the route location, as well as a statement that EPND intends to acquire property rights for the right-ofway that the proposed pipeline requires (Subpart 4B); a statement that the Commission must certify the pipeline expansion is needed before the expansion can be constructed (Subpart 4C), along with the Commission s mailing address, telephone number, and website (Subpart 4D), an explanation of how to get on the Sandpiper Pipeline Project Certificate of Need mailing list (Subpart 4E); and a statement that requests for certification of pipelines are governed by Minnesota laws and statutes (Subpart 4F). 5

11 E. Proposed Notice Plan Distribution The Notice Plan, along with a notification that comments on the notice plan must be received within twenty (20) days of the date of filing of the Notice Plan, has been served on the following agencies: Division of Energy Resources of the Department of Commerce; Anti-trust and Utilities Division of the Office of Attorney General; and U.S Army Corps of Engineers, St. Paul District. F. Notice Timing Minnesota Rule , Subpart 6, requires an applicant for a CN to implement the Notice Plan within thirty (30) days of its approval by the Commission. EPND requests that the Commission vary the requirements of Minnesota Rule , Subpart 6 to provide flexibility for the implementation of the Notice Plan. Enbridge is diligently working to assemble information for both applications, but does not yet know the exact date when the applications will be filed. Implementing the Notice Plan within thirty (30) days of acceptance by the Commission may result in notice being submitted well in advance of the actual filing date. Enbridge believes the public may benefit by making the notice and filing more contemporaneous. Accordingly, Enbridge requests permission to implement the Notice Plan within sixty (60) days of its approval by the Commission, as was allowed for Enbridge s recent CN application for Phase 1 of its Line 67 Station Upgrade Project. 1 The Commission has the authority to vary the requirements of Minnesota Rule , Subpart 6 through Minnesota Rule Under that rule, the Commission may vary the requirements of any of its rules upon the following findings: 1. Enforcing the rule would impose an excessive burden upon the applicant or others affected by the rule; 2. Granting the variance would not adversely affect the public interest; and 3. This variance would support the public interest instead of adversely affecting it: notice provided within a designated time frame of the filing of the CN application will keep the issue relatively fresh. Notice provided closer to the date of the application will be more effective. Finally, the thirty-day time frame is only required by Minnesota Rule , Subpart 6. Accordingly, granting the variance would not conflict with any other standard imposed by law. IV. CONCLUSION EPND respectfully requests that the Commission approve its Notice Plan with the revisions discussed above. A similar notice is being mailed to elected officials and community leaders within the project area.
