2 SUMMARY The proposal is to alter a recorded name, Lammerlaw Stream to an official name, Lammerlaw Creek, for a stream that flows south for approximately 8km into Lake Mahinerangi, approximately 50km west of Dunedin. The stream was named Lammerlaw Creek on plans and the NZMS 13 mapping series up until 1946, and then again on the second edition of the NZMS 177 in LINZ Mapping team has no record of why the generic term Creek changed to Stream. Evidence from the proposer supports that the stream was historically named Lammerlaw Creek, and he has provided evidence of support for the proposal. The stream appears to be well known in the local community as Lammerlaw Creek. There is no consistency in the generic terms of the other water courses that flow into Lake Mahinerangi: Waipori River, Nardoo Steam, North West Creek and Verter Burn. The associated geographic features, Lammerlaw Rock and Lammerlaw Top, may be approved as official geographic names under s.24 of the NZGB Act 2008, as there is unlikely to be public objection and there are no other known recorded or original Māori names for the features. Kāi Tahu ki Otago, who represent mana whenua, has advised that the traditional Māori name of another associated feature, Lammerlaw Range, is Whare Rawhiti. Therefore this name cannot be processed under s.24. Because the area is well known and used by the tramping community it may benefit emergency services to officially name the stream and the associated features. Lammer, which is Gaelic, literally means lambs, and Law is a local Scottish term for a rocky isolated hill in southern Scotland. SECRETARIAT RECOMMENDATIONS Recommendation 1 Accept the proposal to alter Lammerlaw Stream to Lammerlaw Creek, based on: - Kāi Tahu ki Otago, who represent mana whenua, advising that no traditional Māori name is known for the stream and they do not oppose the proposed change, - historical evidence that the stream was consistently named Lammerlaw Creek, - the stream being commonly known in the local community as Lammerlaw Creek, and - it being of benefit to emergency services to officially name the stream because the area is well known and used by the tramping community, Noting that Lammerlaw Stream is a known alternative recorded name for the feature, so the proposal cannot be processed through s.24 of the NZGB Act 2008, and Notify as a proposal to alter for one month in terms of Section 16 of the NZGB Act NZGB meeting 18 May 2017 Page 2 of 6
3 and Recommendation 2 Approve as official the associated recorded geographic feature names, Lammerlaw Rock and Lammerlaw Top, in terms of Section 24(2)(a) of the NZGB Act 2008, based on: - Lammerlaw Rock and Lammerlaw Top having appeared on at least two authoritative maps in the NZMS map series, - it being unlikely that there will be public objection, and there being no alternative recorded names for the features, - it being of benefit to emergency services to officially name the features because the area is well known and used by the tramping community, and - Kāi Tahu ki Otago, who represent mana whenua, advising that no traditional Māori names are known for the features, and Notify in terms of Section 21(2) of the NZGB Act OTHER OPTION Option 3 As per the Agreement between the NZGB and LINZ dated 13 November 2013, request that the Chairperson writes to LINZ s Mapping team to recommend that Lammerlaw Stream be altered to Lammerlaw Creek on NZTopo50-CE15 Waitahuna. Noting that because it would then be shown on two authoritative maps (NZMS 13, OT127 and NZTopo50-CE15) its status would be a recorded name, not official. This option avoids going through the full statutory notification process. SECRETARIAT ANALYSIS The proposal The proposer is seeking to have the recorded geographic feature name, Lammerlaw Stream, altered to Lammerlaw Creek. The proposer advises that: - the stream has been named Lammerlaw Creek from the time that gold was first discovered there in 1861, - the stream is of historical importance as it is the site of the first gold discovered on the Waipori goldfield and the site of the first Waipori township, and - Lammerlaw Creek is the name that is in common use by locals. The proposer has provided support for his proposal from the owners of the land the stream runs through, a descendant of a former landowner, and 32 descendants of goldminers who worked on Lammerlaw Creek. The proposer also consulted with local iwi who do not oppose the proposal. The significant, and at times controversial, Mahinerangi Wind Farm is adjacent to the stream. The generic term of the feature Whittow 2 describes a Creek as, a tidal channel in a coastal marsh or between estuarine mud-banks. However, in New Zealand the generic term Creek appropriately describes any type of small stream. Creek has been applied across New Zealand without necessarily adhering to the formal definition. There is no consistency in the generic terms of the other water courses that flow into Lake Mahinerangi: Waipori River, Nardoo Steam, North West Creek and Verter Burn. New Zealand Gazetteer and associated features Lammerlaw Stream is the recorded name for the stream. Lammerlaw Road runs horizontally to the stream near its confluence with the lake, and Hocken Collections 3 has an undated photo showing Lammerlaw Creek Bridge crossing Lake Mahinerangi. Lammerlaw Rock, Lammerlaw Top and Lammerlaw Range, which are recorded names, are associated geographic features. The NZGB may consider also approving Lammerlaw Rock and Lammerlaw Top under s.24 of the NZGB Act 2008, as they have appeared on at least two maps in the NZMS map series, there is unlikely to be public objection, and there are no known alternative or original Māori names for the features. Research, history and references to the feature The proposer has provided evidence from Papers Past ( ) that shows 168 results for Lammerlaw Creek, but none for Lammerlaw Stream. The proposer has also provided a number of documents as evidence that the feature was historically named Lammerlaw Creek. Reed 4 records that John Cargill and Walter Miller named the associated feature, Lammerlaw Range, after Lammer Law, the second highest peak in the Lammermuir Hills in the Scottish Borders region. 5 Consultation with iwi The proposer has provided evidence of consultation with Kāi Tahu ki Otago (KTKO), who represent the mana whenua, Te Rūnanga o Ōtākou and Hokonui Rūnanga. KTKO advised that no traditional Māori name is known for the stream and that they do not oppose the proposal. In December 2016 KTKO advised the NZGB that there is no known Māori name for the associated features, Lammerlaw Rock and Lammerlaw Top. However, Beattie 6 had recorded that the original/traditional Māori name for Lammerlaw Range is Whare Rawhiti lit. sunny house, house facing the east. Relevant section from the NZGB Act 2008 The NZGB has a function to make recorded geographic names official through s.24 of the NZGB Act 2008, which is a fast track process because no public participation is required. The NZGB needs to be satisfied that a recorded name is not likely to attract public objection, and that there are no known alternative recorded names for the feature. Lammerlaw Stream is the recorded name of the stream, so a proposal for Lammerlaw Creek cannot be processed through s.24 of the NZGB Act However, the recorded names Lammerlaw Rock and Lammerlaw Top may be approved as official geographic names under s.24 of the NZGB Act Policy from the NZGB s Frameworks v.8 relevant to this proposal Name Alterations: Where an alteration to a name is proposed, the Board will consider that proposal on its merits. The Board shall not generally alter a name, for example by correcting its spelling, if the incorrect form is in general public use and the alteration may affect a community. However, other criteria and legislative considerations may outweigh this policy. Early plans and maps, and the evidence the proposer has provided supports that the stream was historically named Lammerlaw Creek. Altering the name from Lammerlaw Stream to Lammerlaw Creek is unlikely to affect the local and tramping community. Generic Terminology: While a standardised and consistent approach is preferred, existing use, local practice, or exceptions are allowed. For example, instead of the preferred generic term Stream, other options such as Brook, Creek, and Burn may be more relevant. The proposer advises that the stream is well known in the local community as Lammerlaw Creek. A 2016 article in the Otago Daily Times describes gold being found in Lammerlaw Creek 7, and a report prepared for the Otago Regional Council describing mineral deposits in the region names Lammerlaw Creek 8. There is no evidence of Lammerlaw Stream being the name in common use for the feature, apart from the depiction on topographic maps since the mid 1900s. Agreement between the NZGB and LINZ dated 13 November 2013 As per the Agreement between the NZGB and LINZ dated 13 November 2013, the NZGB may request that the Chairperson writes to LINZ s Mapping team to recommend that Lammerlaw Stream be altered to Lammerlaw Creek on NZTopo50-CE15 Waitahuna. It would then be shown on two authoritative maps (NZMS 13, OT127 and NZTopo50-CE15) and its status would be a recorded name, not official. This option avoids the costly and 6 Beattie, H. 6 time consuming public notification process and applies to low priority names. Concerns or issues for emergency services The NZGB s member nominated by the Federated Mountain Clubs of New Zealand Inc has advised that the area is well known and used by the tramping community, so making the name official may be useful for emergency services. Online Dictionary of New Zealand Sign Language New Zealand Sign Language (NZSL) is an official language of New Zealand. Under the United Nations Convention on the Rights of Persons with Disabilities (UNCRPD) the NZGB is obliged to recognise the existence and importance of geographic names in NZSL. There is no standardised NZSL sign for Lammerlaw. The NZGB may consider recommending that if Lammerlaw Creek is assigned as an official geographic name, that it be added to the NZSL Dictionary.
