1 APPROVED MINUTES MINUTES OF THE BROOKLYN PARK PLANNING COMMISSION REGULAR MEETING November 09, 2016 Approved Minutes 1. CALL TO ORDER The meeting was called to order at 7:01 p.m. 2. ROLL CALL/ PLEDGE OF ALLEGIANCE Those present were: Commissioners Fletcher, Hanson, Jacobson, Kisch, Morton-Spears, Stuewe, West-Hafner and Vosberg; Senior Planner Larson; and Planning Director Sherman Those not present: Commissioner Schmidt 3. EXPLANATION BY CHAIR 4. APPROVAL OF AGENDA MOTION HANSON SECOND JACOBSON TO APPROVE THE NOVEMBER 09, 2016 AGENDA. 5. CONSENT A. None 6. PUBLIC HEARING 6A. Twin City Twisters- Case# Conditional Use Permit for a gymnastics facility At Xylon Avenue North/NorthPark Business Center Planning Consultant Michael Palermo stated that the applicant will be moving into the NorthPark Business Park. Because that is zoned Business Park with a Planned Development Overlay, a Conditional Use Permit is required. They will be the second tenant in that building. The site is thirteen acres and they will have a combined building area of 200,000 square feet. The tenant space will take up about 20,000 square feet of the building. Sixty eight parking spaces will be required for their use and there is the opportunity to stripe on the back side of the building an additional twelve parking spaces where the loading dock will be if needed. There was also a proof of parking plan submitted that shows an additional forty eight spaces in case parking does Page 1 of 6

2 become an issue down the line. The bulk of their business will be during evening and weekend hours, which is complementary to the other types of business that will be in this building. The applicant anticipates about eighty people on site at any given time. They offer parties, gymnastics classes and such. They will add a vestibule for dropping off children and an office of about 2,000 square feet. The rest of the space will be open for gymnastics equipment. Seeing no one approach the podium, she closed the public hearing. Commissioner Jacobson asked about parents dropping children off and if parents will be staying. The applicant, Mike Hunger, rd Avenue North in Champlin, approached the podium. He stated the waiting area OF 200 SQUARE feet is actually larger than what they have at their current facility in Champlin. Commissioner Morton-Spears stated that she has a student that has gone to Twin City Twisters and she commends the applicant for what they do. MOTION JACOBSON, SECOND HANSON TO RECOMMEND APPROVAL OF CONDITIONAL USE PERMIT TO ALLOW A 20,204 SQUARE FOOT HEALTH AND EXERCISE FACILITY TO BE LOCATED AT XYLON AVENUE NORTH SUBJECT TO CONDITIONS IN THE DRAFT RESOLUTION. 6B. GameFace Training/Deventri Jordan Case# Conditional Use Permit for a sports training facility at 7601 Northland Drive Suite 120 Planning Consultant Michael Palermo stated that this case is for an exercise facility that wants to move to a different part of the building they currently have their business in. Because it is a Business Park district, they will need a Conditional Use Permit. The tenant space would be about 10,000 square feet, which would require about 38 stalls for parking. This facility will have small group personal trainers, one on one or small groups of six, and they work with high schools all the way through professional athletes. They will be adding a bathroom and there is a very small vestibule. There will be a ramp outside at the entry to the business. Seeing no one approach the podium, Chair West-Hafner closed the public hearing. MOTION HANSON SECOND KISCH TO RECOMMEND APPROVAL OF CONDITIONAL USE PERMIT TO ALLOW A 10,555 SQUARE FOOT HEALTH AND EXERCISE FACILITY AT 7601 NORTHLAND DRIVE NORTH SUBJECT TO CONDITIONS IN THE DRAFT RESOLUTION. Christ the Redeemer Church/Ministry- Case# Conditional Use Permit for a religious facility at 8408 Xerxes Avenue North Senior Planner Larson stated that the church would occupy about eight hundred square feet with a seating capacity for about 56 people. They will be taking out an office and putting in a second exit which is a requirement. Staff is recommending approval. The owner is working with Code Enforcement on some property maintenance issues and they have resolved some of those staff has identified, such as the striping of the parking lot. Seeing no one approach the podium, she closed the public hearing. Commissioner Vosberg asked about the language in the staff report stating that the building owner will need to work out parking arrangements through its lease for church use during regular business hours with other tenants in the building if parking becomes a problem. She asked staff if this is being totally left up to the church and the people in the building. Senior Planner Larson stated that the main operation of the church is on Sundays but they have indicated that they may do some things during the week in the evenings. He stated that if the lot is filled beyond capacity in the evening during the week then the property owner and the tenant need to work that out. From what staff has been told, it should not be a problem. Commissioner Kisch asked staff about the second exit. Senior Planner Larson showed on the plans where it was to be located. Due to an inaccuracy on the plans, Commissioner Kisch asked that the correct plans be submitted to the City Council. Senior Planner Larson stated that they would have to meet building code so it could be changed at that time. Commissioner Jacobson asked what it would potentially mean that they would work out a parking issue if there was one since they are located on Xerxes Avenue and there are not options for parking there. She stated she is concerned about people coming to an event at the church and not having any place to park. Senior Planner Larson stated that if staff receives complaints, they would call the applicant and the building owner and advise them that something needs to be done. Bill Franke, rd Ave NW in Elk River, stated that he is the owner of the building. He stated that they have had the north end of the parking lot striped, which has never been striped for parking. During the evening there is very minimal business on the west side of the building. After 8:00 pm there is no business on Page 3 of 6

4 the west side. On the north side, there is just a barbershop so that side is no problem for parking. On the east side, there are just garage entrances and if there ever was a parking problem, they could stripe that if they had to. Commissioner West-Hafner stated that she went by to see the site prior to the meeting and saw trailers from one company in the lot as well as trailers parked behind in the area where they could stripe on the east side. There were very few parking spots available at about 6:00 pm. Senior Planner Larson stated that the Duc Thanh Center does have a cross-access agreement with this building, though they may not have a parking agreement. That could possibly also be a remedy to any possible parking issues. Commissioner West-Hafner stated that she thinks this parking issue needs to be figured out before it goes forward so she is not supporting this. Commissioner Fletcher asked staff if condition 1.02 is just for the tenant space or are they being asked to get caught up to the rest of the building as well. Senior Planner Larson stated yes, it is just for the tenant space. Commissioner Morton-Spears stated that capacity for the tenant space is shown at 56. She asked if they plan to grow the congregation, because if they do, the parking will become a problem. The applicant, Arthur Beer, th Avenue NW in Coon Rapids, stated that their current attendance averages in the twenties and they never have more than thirty adults there. He stated that if they start to over-grow that space they will look for a new space. MOTION FLETCHER, SECOND JACOBSON TO RECOMMEND APPROVAL OF CONDITIONAL USE PERMIT FOR A RELIGIOUS INSTITUTION AT 8408 XERXES AVENUE NORTH SUBJECT TO CONDITIONS IN THE DRAFT RESOLUTION. MOTION CARRIED 7-1 6D. NorthPark Business Center- Case# Site Plan Review for construction of Building Four at 8111 Oxbow Creek Drive Senior Planner Larson stated that this application for construction of Building 4 rounds out the first phase of the NorthPark Business Center. The site is about fourteen and a half acres and the building is about 231,000 square feet. It will have some similarities to the other buildings, but will have its own identity. The architects have heard the comments that came up with the last few buildings and are hoping these plans reflect that. There are some varying roof heights and articulation in the walls and various building materials. This will be a very typical office/warehouse type building. The parking will be in the front of the building on the north side, Page 4 of 6

5 with a couple of driveways off Oxbow Creek Drive, one of their own, and one shared with building three. On the west side of the building, there will be additional parking that is not intended to be constructed with the original construction of the building, but it will show proof of parking in case they have a higher than typical demand for parking, which is possible with this type of building. On the south side will be the truck court and some trailer parking and this is where staff has the biggest concern. They show putting up a fairly good-sized berm up to about eight feet in height to screen the building but it does drop into the drainage area. Even though there is a pretty robust landscaping plan for this area, eventually Xylon Avenue will get extended across the Three Rivers Rush Creek Regional Trail and extend south to 101 st Avenue. The trail will be sunk just a little bit and Xylon Avenue will be raised a bit and visibility of the building from the residential area is a concern. A rooftop screening diagram has been provided for the meeting, as well as another perspective of the building. Staff is recommending approval. Dan Salzer of Scannell Properties stated that they would like to have this project approved now because they have two possible users interested in anywhere from three quarters of this building to the entire building and they want to be well positioned to be able to move quickly in the spring. Seeing no one approach the podium, Commissioner Chair West-Hafner closed the public hearing. Commissioner Kisch stated that he does have a few design comments pertaining to the design guidelines. There is a section in the design guidelines that relates to any public right-of-way and looking at this building on the western edge along Xylon Avenue, that is a large uninterrupted façade that he stated he does not believe meets the intent of the city design guidelines. He stated that he understands that this side is not an entrance and it would be hard to articulate it. However, that side is basically one long interrupted plane with just a change in color. He stated that he thinks there are ways to break down the feel and the scale of that with landscaping. If the sidewalk along Oxbow Creek Drive to the south was shifted to be in a line, it would give more planting space for trees to soften the feel of the façade, which would help. He stated that another thing to look at would be to extend the parapets at the corner of the building on that side so it would become a larger expression on that western edge and break down the scale a little bit. Mr. Salzer stated that they are willing to look at that. Commissioner Stuewe stated that she had been hoping to see an updated Master Pan. She stated that she brought her original Master Plan with her and was trying to piece it together herself but if building continues here she really wants that full visual. With previous conversations about pervious to impervious and some of the ratios being seen she thinks that as this continues to get developed, attention needs to be paid to those things. Planning Director Sherman stated that the applicant did provide this information and this is a staff issue as it just did not make it into the packet. Senior Planner Larson showed the updated version of the Master Plan for this business park. Page 5 of 6

6 MOTION KISCH, SECOND JACOBSON TO RECOMMEND APPROVAL OF THE SITE PLAN REVIEW FOR THE MULTI- TENANT/OFFICE WAREHOUSE MANUFACTURING BUILDING 8111 OXBOW CREEK DRIVE SUBJECT TO THE CONDITIONS IN THE DRAFT RESOLUTION ADDING 4.12 SPECIFYING THAT THE APPLICANT WILL PROVIDE UPDATED VISUALS SUPPORTING BOTH SITE PLAN AND ELEVATIONS OF THAT FAÇADE AROUND XYLON FOR CITY COUNCIL REVIEW. 7. DISCUSSION ITEMS A. None 8. OTHER BUSINESS A. Approval of September 14, 2016 Minutes MOTION WEST-HAFNER, SECOND FLETCHER TO APPROVE THE MINUTES FROM THE OCTOBER 12, 2016 MEETING. 9. INFORMATION ITEMS A. Commission Comments/Updates Commissioner Vosberg stated that there is a meeting of the Bottineau transit station on November 17 th. It is an open house at the new library. Planning Director Sherman stated that staff has set up a meeting and contacted all of the residential property owners along the corridor to talk about fencing. It will be kind of a mini meeting outside of the public open house. Commissioner Kisch said he is unable to attend the November RPAC meeting and was looking for a sub.
