1 Borough of Carlisle Workshop Meeting Minutes April 4, 2018 Present at the meeting: Councilors Crampsie, Flower-Webb, Fulham-Winston, Guido, Landis, and Mayor Scott. Also present were: Borough Manager Candland, Assistant Borough Manager Armstrong, Police Chief Landis, Public Works Director Malarich, Planning/Zoning/Codes Manager Skelly, Finance Director Juday, Parks and Recreation Director Crouse, Fire Chief Snyder, Human Resource Supervisor Hamilton, Public Information Coordinator Taylor and Borough Secretary Stone. I. Call to Order & Pledge of Allegiance Mayor Scott called the Council Workshop Meeting to order at 6:04 p.m. II. Meeting Minutes: A. Borough Council voted 7-0 to approve the February 28, 2018 Workshop Meeting Minutes. (Fulham-Winston/Guido) III. Economic Development Committee: A. Borough Council voted 7-0 on a Resolution to permit the inter-municipal transfer of a Retail Restaurant Liquor License from the Borough of Shippensburg to the Borough of Carlisle. The location of the licensee (Sheetz, Inc.) is 1900 Ritner Highway, Carlisle, Pennsylvania. (Flower- Webb/Landis) IV. Presentation: A. Carlisle Urban Redevelopment Plan/Connectivity Project Update: Brian Emberg Carlisle s program manager with Herbert, Rowland & Grubic, Inc. (HRG) provided a PowerPoint presentation that explained the communication and traffic pattern plans for the Carlisle Connectivity projects. The PowerPoint document is attached to these minutes. Councilor Guido inquired if there has been consideration for traffic control during the car show events or I-81 shutdowns. Mr. Emberg responded that HRG has programmed into the schedule, blackout dates to cease construction during the car show events. He noted all I-81 shutdowns would be coordinated with emergency service and he will discuss alternate plans with the contractor. Additional concerns addressed by Mr. Embarg: Temporary loss of parking along North Hanover Street during construction will be communicated at the time construction takes place. Streets under construction will be capable of accommodating large trucks in the event of an I-81 diversion. At 6:35 p.m., Mayor Scott announced that Council will take a brief recess. Council reconvened at 6:43 p.m. 1

2 V. Public Safety Committee: A. Cemetery Avenue Speed Limit Ordinance: Public Works Director Malarich stated that due to concerns of alleged excessive speeds on Cemetery Avenue, a traffic study was performed. The study concluded a 15 mph speed limit is warranted on Cemetery Avenue. Borough Council voted 7-0 to direct the Borough Solicitor to draft and advertise an ordinance amending the Code of the Borough of Carlisle with respect to Chapter 244, vehicles and traffic, to establish a 15 miles per hour speed limit for Cemetery Avenue. (Guido/Flower-Webb) Councilor Landis inquired whether there is a way to take a strategic look at the speed limits of all alleys in Carlisle. There was discussion regarding the feasibility of studying a large number of alleys. Chief Landis recommended that speeding concerns be brought to his attention and then go on a case-by-case basis to determine if a speed limit sign is warranted. B. Civil Service Regulations: Borough Manager Candland provided revised civil service regulations that were approved by the Civil Service Commission. The document will be brought to Council for approval at the April council meeting. C. Pennsylvania State Police Memorandum of Understanding (MOU): Chief Landis noted a letter from the PA State Police giving Carlisle Borough police permission to perform inspections on commercial motor vehicles will be brought to the April Council meeting. VI. Public Works Committee: A. Dickinson College/Borough BMP Stormwater Project: Public Works Director Malarich noted construction on the Cherry and W. Louther Street stormwater project that is a collaborative effort with Dickinson College. The project is slated for the summer of The project will decrease the amount of stormwater that enters the Borough s storm sewer system with the use of sidewalk bump outs. Borough Manager Candland noted the project would also reduce flooding in the quad area at the college. Discussion ensued regarding the loss of parking spaces created by the project. Councilor Guido expressed concern that Dickinson College students could begin to encroach on residential parking during the project. It was noted that Dickinson College is looking into the parking space challenges and will make adjustments to the student parking. B. LeTort Interceptor Project Services Agreement: Public Works Director Malarich provided an update on a proposed agreement with HRG that will provide the Borough with construction phase engineering services for LeTort Interceptor Project. The agreement will be brought before Council at the April Council meeting. VII. Employee Relations/Citizen Participation Committee: A. Boards and Commissions Openings: The committee had nothing to report. VIII. Budget & Finance: A. Carlisle Borough Equipment Disposition: Finance Director Juday noted Borough surplus assets would normally be taken to the CapCog auction for disposition. This year the items will first be placed on Municibid, another auction resource provided to municipalities. If sold through Municibid, their commission charge is passed on to the 2

3 buyer, which will increase the Borough proceeds. He noted assets not sold through Municibid would then be taken to the CapCog auction. IX. Public Comment Mayor Scott noted that following the meeting, Council will hold an executive session to discuss a personnel matter and will not reconvene. X. 4 Liquor License Transfer Request Public Hearing Minutes April 4, 2018 Councilor Flower-Webb called the Public Hearing to order at 5:45 p.m. The purpose of the Public Hearing was for the consideration of a request by Sheetz, Inc. to permit the intermunicipal transfer of a Retail Restaurant Liquor License from the Borough of Shippensburg to the Borough of Carlisle. The proposed location of the licensee is 1900 Ritner Highway, Carlisle, Pennsylvania. Councilor Flower- Webb noted under the Liquor Code, only those persons who reside in the Borough of Carlisle should have the opportunity to comment on the liquor license transfer. Mr. Mark Kozar of Flaherty & O Hara Law Firm, 610 Smithfield St. Suite 300, Pittsburgh, Pennsylvania, spoke on behalf of Sheetz, Inc. Mr. Kozar stated in 2016, Act 39 language was changed to allow liquor to be sold at the same location that liquid fuel is sold. Sheetz presently owns over 600 stores in six states, which 256 of those stores are licensed to sell beer and or wine. There are 54 stores located in Pennsylvania that presently sell beer. Mr. Kozar provided the following details regarding Sheetz procedures for alcohol sales: All alcohol will be stored in a Beer Cave, walk in cooler Liquor sale hours o Monday through Saturday 7:00 AM to 1:45 AM o Sunday 9:00 AM to 1:45 AM All Employees would be certified in Response Alcohol Management Program (RAMP) All Employees will receive training for intervention procedures (TIPS) 100 % carding policy Mr. Kozar noted Sheetz also sells alcohol for on premise consumption. There is a limit of two beers per customer and they must purchase food as well. There are approximately 50 security cameras inside and outside the store, which are monitored by Sheetz Security Operations Center (SOC) in Altoona. Each employee has immediate access to the SOC if a questionable situation arises. Councilor Guido inquired if the on premise consumption option will allow drinking in the outdoor eatery. Mr. Kozar stated that drinking alcohol outdoors will not be permitted. Councilor Guido inquired if there are plans to remodel the store to allow the cashiers the ability to monitor the indoor eatery. Mr. Kozar noted that the security cameras will be monitored by the employees during in store consumption. Solicitor Brenneman asked Mr. Kozar if the client agrees to pay for the advertising, legal and stenographer fees associated with the public hearing. Mr. Kozar stated all invoices should be forwarded to his office. There being no public comment, the public hearing was adjourned at 6:04 p.m. Respectfully submitted, Joyce Stone Borough Secretary
