On Monday, Judge R. Bruce Long denied Potomac Timber s motion to delay the jury trial. The trial may take up to 3 days. In 2008, Potomac Timber filed a lawsuit after the town council rejected its site plan for 14 condominiums proposed for the Urbanna Yachting Center near the Urbanna Bridge. Potomac Timber attorney Patricia D. Ryan argued on Monday, June 27, that the town s financial records, which she requested on May 31, were seized by the Virginia State Police on June 10. She asked Judge Long to give Potomac Timber time to obtain the financial records from the State Police. Judge Long, however, did not waver from his March 28 ruling that the jury trial will start on July 26. Those records have been sit- ting there three years, he pointed out. Ryan alleged that a Potomac Timber principal, Ray Watson, said in a May 28, 2011 deposition that former town administrator and zoning administrator Lewis Filling approached him about being put on the payroll of the developers. This occurred over a period of several years, said Ryan, adding that all offers were rejected. Judge Long pressed Ryan to give him concrete evidence why the town s financial records were needed. Judge Long said if there was misconduct by Filling, in order for it to be relevant it would have had to affect the decisions of the town council and Urbanna Planning Commission. He noted Potomac Timber didn t get what they wanted from the two governing bodies. Filling is facing 5 counts of embezzlement from the Central Middlesex Volunteer Rescue Squad of Urbanna, and Judge Long noted (See Trial, page A3) Celebrate in Deltaville, Urbanna this weekend Independence Day celebrations take place all day in Deltaville on Saturday, July 2, and beginning at 5 p.m. in Urbanna on Sunday, July 3. Chowning For Bob Henkel, Johnny Fleet, Dolly Thrift, and others the dream of a new sports complex facility at Middlesex High School is all about giving the citizens of the county something to be proud of. All three are MHS graduates. Henkel graduated in 1951 and was a member of the first MHS (six man) football team. He was also a baseball star at MHS and went on to play some professional baseball. He had a successful career in banking and came home to Middlesex to retire. He played an instrumental role in the establishment of the Middlesex County Public Library 25 years ago. Fleet graduated in 1964 from MHS and played on the then Middlesex Saxons baseball, football and basketball teams. He went on to be a starting catcher for the University of Richmond Spiders. Today, Fleet is a successful businessman who was one of the driving forces in the building of the Middlesex Sports Complex at Locust Hill. He also is co-owner and helped develop the county s only golf course, Piankatank River Golf Club at Hartfield. Dolly Thrift graduated from MHS in She later married Syd Thrift, a former MHS baseball coach and teacher. Syd Thrift, who passed away several years ago, was a Minor League player in the Yankees organization, a Major League scout and climbed the baseball ladder to become general manager of the Pittsburgh Pirates and Baltimore Orioles. He is one of the most prominent sports figures to ever come out of Middlesex County. If it becomes a reality, the new sports facility at Middlesex High School will be named the Syd Thrift Sports Complex. Henkel, Fleet and Thrift know how sports can positively impact the lives of young people. Over the past few years, they and others have spearheaded a drive to bring Middlesex High School sports facilities up to 21st-century standards. In a recent letter to members of the Friends of Middlesex County Public Schools, Fleet provided an updated overview of the progress made to date. We have wrestled with design and layout configurations for quite some time including the acquisition of the Streetman property, which allowed for the current configuration, wrote Fleet. The portion of the Streetman property acquired is land that adjoins the back of the school property. We also worked with Bay Design on several proposals until we settled on the present plan, he said. Fleet noted that school officials and others have gone before the board of supervisors three times to offer a vision of the need for the Thrift Sports Complex, and have continued to seek its support. We thought the project to be a private/public funding partnership, but at this stage it appears the Board of Supervisors will have to align strictly with the Virginia Procurement Act, wrote Fleet. It will have to be underwritten entirely through Industrial Development Authority (IDA) bonds or other lower lending sources. We have made a commitment to raise a minimum of $500,000 [in private donations] toward the project and have suggested we could raise more, Fleet wrote. The total cost of the project is estimated at $3.5 million. Fleet noted that the private money can be directed into areas of maintaining the facility once completed, possibly outfitting the project (goal posts, bleachers, etc.) or going directly to athletic programs. The funds also could go directly to the project cost or a specific phase of the project. He also suggested that in the case of soliciting funds and fund raising that a Wall of Fame or Memorial Wall along the walkway be considered as a way to encourage financial support. Currently, local contractors are being encouraged to work toward solidifying the hard cost numbers as well as the development of a model 3D lay-out of the project to be used in fund-raising. Fleet said he hopes to have this ready for the board of supervisors to review at an August board meeting. 2 A2 Southside Sentinel Urbanna, Va. June 30, 2011 one woman s opinion Dog Days of Summer Urbanna, Va. Hot weather has arrived sooner than expected in Middlesex County. Summer heat or dog days as I call the season, is appropriately named. It s so hot even a dog has the sense not to move. My dogs, Lord and Lady, lie like the dead in this kind of weather even inside the house in air conditioning. I marvel that golden retrievers can spend so many hours without moving a hair. They seem to be asleep but always one eye, like Cyclops, can pop open at any new sound. I can almost feel dog brains assessing any new noise and figuring out whether it means something good is headed their way... Is she going downtown in the car and could I bum a ride? Is she headed for the cookie jar and might I get a cookie? Is she going on a bike ride and could I tag along? Is it time for my weekly bath and how can I dodge it this time? Has she got a blasted flea pill again and will she try to wedge it into my clenched mouth? Dogs! How cagey they are and so adept to learning every little detail of our day... what words mean, what mood we re in, and how to play us to their very best advantage. Do you think dogs understand English? Of course they do! They understand English better than an Oxford graduate! Every dog has his own vocabulary, but mine know take a walk so well that we had to start spelling W-A-L-K because they would jump up from sleep dashing for their leashes anytime we made the mistake of saying the word. The bad news is they soon learned what spelling W-A-L-K meant, and now we have to say stroll. It won t be long before we have to start spelling S-T-R-O-L-L. Other phrases the dogs know: Time for dinner, hamburger, hot dog, candy, cookie, treat. Let s take a ride in the car. Who wants the first bath? (both head for the bushes). Here comes a car. Cat in the garden. (The latter said with real fear Cat might hurt my latest nest of baby birds.) Phrases they don t like: No! Stay! Get down! Stop that! Bad dog! Stay home! And, time for bed. Phrases they do like: Good dog! Good boy! Good girl! I love you. Want to jump up on Mom s bed? Want to go for a swim? When Debbie comes to the Pineapple Palace to help me, all I have to say at the first sound of her car in the driveway is, Here comes Debbie! and they never stir from their sleep. They love Debbie. That simple phrase saves all of us a lot of wolfwolf at the front door. They also love their dog sitters, Katie and Amber. They can even spot Amber from across the street and I always know when they see her because a pair of long tails start wagging a mile a minute. Then, there s an adorable new golden retriever puppy named Lincoln down the street at Patsy s house. The puppy has taught my dogs a new phrase, I want a new puppy! When it s hot we slow down here in Urbanna. The garden goes unweeded, grass goes uncut, and walks with the dogs come early in the morning before the sun is too hot, or late at night when a cool breeze comes in from the river. Sometimes the dogs hit the river for a swim. Lady is happy wallowing in the shallows, but Lord swims along the marshes looking for action. He likes to surprise an egret or a turtle sunning on a log, and dares anything to hang around when he swims by. Afterwards I hose the dogs off and give them a rubdown with a towel. I give their ears a good cleaning too. Did you know that dogs cringe when their ears are being cleaned just like children? They dry off on the back porch in the sunshine as clean as whistles. Then we jump in the car and have a ride about town, their smiling heads hanging out windows, their ears flat back in the breeze. All this dog talk leads up to the fact that I m taking off July and August for a rest. I ll be busy this summer working at the law office a few hours every day but I ll be back after Labor Day ready to write this column again. County approves outdoor retail display amendment by Larry S. Chowning Board of Supervisors approved an amendment to the zoning code by a 4-1 vote on June 21 to allow, by special exception, up to 5,000 square feet of outdoor display and storage of merchandise for retail stores and shops in Village Community (VC) zoning districts. Previously, the Village Community zones did not allow outside display or storage of merchandise in connection with retail stores and shops. Outdoor displays were only allowed in General Business (GB) districts. Attorney Jimmy Ward, representing a golf cart business located just outside of Urbanna, said the new proposal by special exception would require setback areas from the highway and property lines and an approved site plan review. He also said there are no counties in the area that have VC zones, yet most surrounding counties allow businesses to have outside displays in mixed use zones. Lancaster County s closest comparable zone is a Rural Village Overlay District that does not prohibit outdoor storage and display, noted Ward. Essex County s closest comparable mixed use zone is Planned Unit Developments, which handles outdoor displays on a caseby-case basis via site plan approvals with required public hearings, said Ward, and does not prohibit outside display of merchandise. Gloucester County handles outside retail displays similar to Essex by requiring a site plan and setback requirements, said Ward. King and Queen County does not prohibit outside display in mixed zones but requires display areas to be shown on site plans, noted Ward. Mathews County has a Village Mixed Use District that does not prohibit outside display of merchandise, said Ward. After a public hearing on June 9, the planning commission voted 9-0 to recommend approval of the zoning amendment. Saluda District supervisor and board chairman Jack Miller said VC Districts have residential homes and commercial enterprises side-by-side, and he voiced concern that outside displays may interfere with the home-life of the residents living next to retail stores. Pinetop District supervisor Carlton Revere said that he was not going to stand in the way of a business trying to make a go of it. Our need to increase business activity in our county overrides those concerns, he said. Revere also said that it is a special exception matter which allows public input and for the board to address community issues surrounding each case. We shouldn t be hampering any business that is coming into our county, said Jamaica District supervisor Wayne Jessie. Revere, Jessie, Fred Crittenden and Pete Mansfield voted in favor of the outside display amendment. Miller voted against it. Trooper killed in 2-car crash Members of the Virginia State Police are mourning the loss of one of their own. Trooper Adam M. Bowen, 28, of Warsaw was killed instantly during a two-vehicle traffic crash on the evening of Friday, June 24, in King George County. According to the State Police, at approximately 6:45 p.m. on Friday, Trooper Bowen was responding to a call to assist a State Police agent. The trooper was traveling westbound on Route 3/Kings Highway. As the trooper entered the intersection of Route 3 and Madison Drive, his marked Ford Crown Victoria patrol car collided with an eastbound Hyundai Elantra. The impact forced the patrol car to run off the road and strike the traffic light pole. The patrol car split in half and the front end contin- (See Crash, page A3) DCA forms Jackson Creek Improvement Committee Recognizing the economic importance of navigable waterways to the Deltaville community and to Middlesex County, and the critical need to dredge the entrance to Jackson Creek, the Deltaville Community Association (DCA) recently established the Jackson Creek Improvement Committee (JCIC). The purpose of the JCIC is to communicate the importance of recreational boating to the economy and jobs in the area, to raise private funds to help pay for the restoration of Jackson Creek to navigable condition, and to share information with others who are concerned about the loss of navigability of their creeks. In its first formal action, the JCIC raised over $13,000 to meet the private funding needed for the pending maintenance dredge of Jackson Creek. None of these funds were derived from general or tornado-rebuild funds of the DCA, and all JCIC funds are being maintained in a separate DCA account. The committee has received a written opinion from an independent tax advisor that this funding activity is consistent with the DCA s 501c3 tax status, and that donations to the JCIC fund are tax-deduct- Jackson Creek in Deltaville continues to narrow and fill in at its entrance. ible. We must work with the county to solicit grants and other funding sources, and provide other means such as private donations, to keep our waterways open. Boating and water access are vitally important to Middlesex, with an economic impact of over $53 million per year plus almost 600 jobs. Kimbrough noted that in addition to the private funding, Deltaville Boatyard granted permission for the dredge contractor to use its facility to remove spoils. (Photo by Larry Chowning) Deltaville 5K is Saturday The first Deltaville 5K will be at 8 a.m. on Heritage Day, Saturday, July 2. The race is being sponsored by the Deltaville Community Association (DCA). All proceeds from the race will benefit in rebuilding and improvement of the DCA facilities that were damaged by the April 16 tornado. The race will begin and end at the Deltaville Community Center, taking the participants through the town of Deltaville. There will be T-shirts provided to each participant with the official race logo. Register on the day of the race for $30. Retiring old flags needed over a 30-day period for the current dredge will surely strain operations at the facility, this removal option reduces the cost of the project significantly compared to alternative spoil removal approaches. Contributions to the JCIC may be made to the DCA with Jackson Creek noted on the check. All funds not used for the current maintenance dredge will be applied to the next dredge needed, which is likely to be within the next year because the current project is only designed to curtail an emergency situation, not to return the creek to its charted specifications. Kimbrough@gmail.com. letters Keep local jobs in school system To the Editor: The Middlesex School Board and superintendent have just cut local jobs for people in this community people who have lived and worked here. I have seen them raise their children and support programs at the schools. But in its wisdom, the board has given those jobs to a custodial company whose workers will come from who knows where. I believe the board is overlooking these facts and does not have a grasp on its responsibility to local citizens whether it s those who have lived here and raised their families, or those who moved here with the intention of staying. After all, board members are elected by these same people. Well, it is time to help our small economy by keeping some of the better jobs filled with the people who live here and have proven their loyalty to the community. I believe there are other issues with the current way the school system is operating. Remember, all politics are local. Let s make sure our system is held accountable to all. Let s not look back at this time and say we should have paid more attention. 3 Condo development begins A groundbreaking was held Sunday for Oyster Harbor Urbanna Creek, a new 13-unit condominium development recently approved by the Town of Urbanna. The condos will be developed at the former Compass Quay Hotel at the foot of Virginia Street on Urbanna Creek. The driver and a passenger in the Elantra suffered minor injuries in the crash. They were both transported by ambulance to Mary Washington Hospital. The circumstances surrounding the crash remain under investigation, which is being conducted by the Virginia State Police Accident Reconstruction Team. Urbanna s 4th of July celebration will be held Sunday, July 3, at the Urbanna Town Marina on Urbanna Creek. Festivities start at 5 p.m. with food and ice cream, and a DJ providing the music. Ryan said her clients can t get a fair trial unless they review financial records to see if Filling might have secured funds fraudulently. Ryan said she wanted to look for a pattern of discrimination treatment by Filling. It is often what is not there that is important, she said. Filling dismissed John Conrad, who is representing the town in this case, pointed out that Filling was dismissed from Potomac Timber s lawsuit, and there is no mention of attempted bribery by Filling in the lawsuit that was filed in the summer of Conrad said there have been no pleadings about Filling before this one, which is based only upon a belief. He labeled the legal tactic a fishing expedition. Conrad noted that Filling, as zoning administrator, could make recommendations, but the final decision is up to town council and the planning commission. Conrad argued that under rules of law, attempts to discover evidence that the other party has must be completed no later than 30 days before trial, and Potomac Timber s attorney filed her discovery requests too late. Town attorney Andy Bury, who is assisting Conrad in the town s defense, testified at Monday s hearing that zoning records are still at the town hall. Bury said he was in the town office when police seized town financial records on June 10, and they did not want the zoning records. Judge Long ruled that the town records are open to Potomac Timber. However, Judge Long denied Potomac Timber s request to make the town s financial records available. Plaintiffs waited too long to ask for this information, he said. Class size is small, usually 5-6 students. If you register, please plan to attend and call in advance to cancel. So that we may celebrate our country s birthday, both branches of the library will be closed on July 2 and July 4. No items are due either day. Books may be returned in the book drop, but audiovisual materials, which are easily damaged, must be returned to the circulation desk. Great new books and books on CD continue to arrive. The latest Baldacci, One Summer, is certainly different from most of his novels, but I found it to be a wonderful, gentle story. Bay Aging received $1,164,800 in grant funding from the U.S. Department of Housing and Urban Development (HUD) to construct 12 one-bedroom apartments. Further funding was secured from the Virginia Department of Housing & Community Development ($173,800 in HOME funds, through the Affordable and Special Needs Housing Program), and from the Southeast Rural Community Assistance Project ($40,000 for water and sewer improvements). In addition, HUD awarded $122,100 in rental subsidies over three years to help keep the rent affordable for residents. Having public water and sewer available was one of the requirements to receive federal funding. The Town of Urbanna provides water to the project and the Hampton Roads Sanitation District provides the sewage treatment service. The contractor, E.D. Parker Corporation from Benson, N.C., completed construction in May. To reside at Port Town Village, persons must be at least 62 years old with a maximum annual income of $21,850 for one-person occupancy or $24,950 for two-person occupancy. No household will pay more than 30% of its monthly income for rent. Rent deductions are granted for certain out-of-pocket medical expenses and a monthly utility allowance is provided to each household. All 12 units are currently occupied. Residents have been busy settling into the second phase of this high-quality and energy efficient housing. Bay Aging s senior apartment complexes give area seniors a much-needed affordable housing option in highly desirable Middlesex County and just outside the Town of Urbanna. Additionally, residents may qualify for supportive services to assist them in maintaining their independence. Moving to Port Town Village II has been life changing for new resident Dixie Canter, who is a double amputee who knows all too well how difficult life can be without accessible housing. A spunky, independent woman, she was forced to sell her condo because it was not equipped to accommodate her wheelchair. She was fortunate to be able to move in with a family member, but, again, the home was not designed for wheelchair use. Each year, Bay Aging provides fans to senior adults in the Middle Peninsula and Northern Neck areas. With a grant from Dominion Virginia Power, Bay Aging will purchase a limited number of electric fans and window air conditioners and will distribute them to eligible senior adults. The fans are free to those who are eligible and become the property of the individual. Arrangements can be made for fans to be delivered to those individuals who are unable to pick them up from one of our offices. To qualify for Fan Care, a person must be: situation that presents a threat to the person s health and well-being. household income of no more than $16,335 for a household of 1; $22,065 for a household of 2; etc. Not all persons in the home need to be seniors to qualify for a fan, but their incomes must be counted.
