3 4. Stakeholder consultation Iluka is committed to ongoing consultation with its stakeholders to achieve sustained mutual benefits for the life of the project. Ongoing consultation has and will continue to occur with Iluka, residents and communities, government (State and Local), development boards, Indigenous groups and local business owners and operators. Consultation is an integral part of Iluka s social licence to operate. Consultation activities will continue to be implemented during operations by dedicated Community Relations and Indigenous Relations resources. The quality and transparency of Iluka s consultation with key stakeholders has been a key underpinning for the continuation of Iluka s mining and processing operations throughout Australia and in establishing its credentials in new areas of operation. It will undertake its engagement activities in accordance with the following priorities: Communication: open and meaningful engagement Transparency: provision of clear, timely and agreed information Collaboration: support of community initiatives to reach beneficial outcomes Inclusiveness: early recognition to understand and involve our stakeholders Integrity: conduct engagement in a manner that fosters mutual respect and trust. 4.1 Consultation objectives The objectives of Iluka s stakeholder consultation process are: inform stakeholders of the operations explore concerns and reactions gauge and/or gain public support implement and maintain a process through which residents and other stakeholders can communicate effectively with the company and encourage the use of this process ensure that all issues and disputes are dealt with in a timely manner and followed up effectively; and incorporate stakeholder input into the design, operations and management of the project. To meet these objectives Iluka has: identified key stakeholders, determined their communication requirements and established appropriate consultation tasks (e.g. regular meetings) identified stakeholders issues and concerns, and their interest in the project provided stakeholders with an understanding of the constraints and opportunities of the development; and established a framework to obtain, consider, respond to and document stakeholder comments, issues and concerns. 4 4.2 Stakeholder analysis The following stakeholders have been determined to be important stakeholders for the project and have been included in ongoing consultation: Local community members District Council of Ceduna Eyre Regional Development Board (ERDB) Department of Primary Industries and Resources South Australia (PIRSA) Department for Environment and Heritage (DEH) Department of Water, Land and Biodiversity Conservation (DWLBC) Alinytjara Wilurara Natural Resource Management Board (AWNRM Board) Department of Transport, Energy and Infrastructure (DTEI) Environmental Protection Authority (EPA) Landowners and managers within and adjacent to the Project area Business owners in the region Local Aboriginal groups Non-Government Organisations (NGO s) and special interest groups (e.g. The Wilderness Society). Other stakeholders will be identified throughout the life of the project through ongoing consultation and involvement within the local community. 4.3 History of consultation To ensure both stakeholders and the community are accurately informed about the project Iluka has been consulting with stakeholder and community groups on an ongoing basis. An overview of the consultation undertaken prior to the submission of this MARP(Ops) is provided below) Public consultation on mining proposal As previously outlined Iluka has made an application under the Mining Act 1971 for a ML and associated MPLs for the Jacinth-Ambrosia Project. The document Jacinth-Ambrosia Mineral Sands Mining Proposal, Supporting Documentation for Mining Lease Application submitted by Iluka in support of their application describes the type of operation as well as the environmental management measures to be undertaken to rehabilitate the land. The Jacinth Ambrosia Mineral Sands Mining Proposal was made available for public comment over the period 22 November 2007 until the 04 January A two week extension was also granted to two stakeholders upon request to PIRSA. Advertisements in the Adelaide Advertiser, The West Coast Sentinal (local Ceduna paper) The Australian and the South Australian Government Gazette directed interested parties to copies of the Mining Proposal document on display at the office of the Department of Primary Industries and Resources South Australia (PIRSA) and the local Council in Ceduna. In addition, copies of the Mining Proposal (MP) could also be accessed from both the PIRSA and Iluka websites. 5 Environment Protection Authority (EPA) Department of Environment and Heritage (DEH) Department of Water Land and Biodiversity Conservation (DWLBC) Department of Premier and Cabinet Aboriginal Affairs Division (Aboriginal Lands Trust) Department of Transport Energy and Infrastructure (DTEI). In total, PIRSA received thirty three submissions from government agencies and the public in response to the Mining Proposal. These submissions were provided to Iluka following the public comment period. Iluka addressed the key issues from the submissions and provided a response document Jacinth-Ambrosia Mineral Sands Mining Proposal, Response to Submissions to PIRSA on 6 th March Consultation on the MARPs In addition to the consultation undertaken as detailed in Section 4.4 below, the following key project stakeholders were consulted during preparation of the MARP(EW), MARP(Const), and this MARP(Ops) has also been facilitated as follows: Far West Coast Native Title Claimant Group (FWCNTCG) Aboriginal Lands Trust (ALT) The Wilderness Society AWNRM Board DWLBC DEH EPA PIRSA. 4.4 Ongoing consultation Approach Iluka s approach to developing relationships with stakeholders and the community has been consultative with the key stakeholders and interested community groups. Engagement commenced early in the project s development. The consultation approach has included an awareness campaign, interactive forums and ongoing consultation to ensure that stakeholders and the community are well-informed prior to project milestones, and that the community understands the scope of the project. Iluka has also completed a Stakeholder Engagement Plan specifically designed for the operations phase of the project. A copy of the plan is provided in Appendix B. A summary of the plan details is provided below. During operations, the pro-active approach to consultation established for the project will continue to be adopted with the community and stakeholders through continued dialogue. The consultation will continue until the life of the mine is exhausted and during the site rehabilitation, closure and completion process. 6 During the operations phase, the consultation program will involve: ongoing liaison with government and non-government organisations, and community representative groups meetings with councillors and staff of local authorities providing information on the project to the Iluka workforce dissemination of information through community newspapers in the region; and the publication of a regular community newsletter, distributed to local landholders and the regional community. Details of the specific approach to stakeholder engagement regarding mine closure are detailed in the Mine Closure Plan developed as part of this MARP(Ops). The Mine Closure Plan is included in Section Landowner requirements During operations Iluka will continue to engage and liaise with landowners to ensure they are aware of the operational status and associated activities. In addition to this general requirement, conditions within the Second Schedules of ML6315 (Condition 15), EML6316 (Condition 14), MPL110 (Condition 15) and MPL111 (Condition 14) require Iluka to develop an operating protocol with the Director of National Parks and Wildlife to articulate operating procedures between mining operations and park management. Iluka will continue to work with representatives of DEH in order to finalise this protocol Native Title Agreement Consultation with the Indigenous community has been directly through the Far West Coast (FWC) Native Title Land Group as part of the negotiations of the Part 9B Agreement. A Part 9B Native Title Agreement was signed on the 18 th December 2007 between Iluka Resources and the Far West Coast Native Title group. This agreement formalises protocols and systems for the parties to work together to achieve mutual benefits. Consultation with the FWC will continue during operations.
