Table 10: Category Drainage Drainage Floodplain Management Authorities Relevant Authority Floodplain Management Corangamite Catchment Management Authority 5 PRECINCT INFRASTRUCTURE PLAN 5.1 INTRODUCTION This Precinct Infrastructure Plan (refer Table 11: Infrastructure Required in Armstrong Creek East Precinct) summarises the infrastructure required to ensure the appropriate development of ACEP generally in accordance with the ACEPSP. The infrastructure is to be provided through a number of mechanisms including: l development works / or full funding by developers (individually or jointly in some cases); development contributions (community infrastructure levy development infrastructure levy); utility service provider works / or funding; capital works / or funding by the Australian Government, State Government, the other, agencies non-government organisations; grants funding available from a variety of sources. 125

5 5.1.1 L Development Works by s As part of l development works, new development by a developer must provide fully fund the cost of delivering the following infrastructure on or where abutting or related to the l: l construction of roads including related culverts, intersection works traffic management measures as listed in Table 8; lscaping of all category B to D roads streets as listed in Table 8; local walking / cycling paths along category B to D roads streets in accordance with Table 8 the relevant road cross-sections; unencumbered l equal to 10 per cent of the net developable area for public open space, to be located as specified on Plan 7 or cash-in-lieu to the equivalent value, all subject to equalisation; local infrastructure as required by utility service providers including water, sewerage, electricity, gas telecommunications; all drainage system flood mitigation works (excluding Armstrong Creek works, which are a development contribution plan project) Development Contributions Plan A development contribution plan is being prepared for ACEP in conjunction with this ACEPSP. The ACEPDCP will be an incorporated document in the Scheme. Development that occurs before the approval of the ACEPDCP requires as a condition on any planning permit before the issue of a building permit, the completion of an agreement under section 173 of the Planning Environment Act 1987 (the Act) requiring: the payment of development contributions to the satisfaction of the responsible authority in accordance the approved ACEPDCP; if the ACEPDCP is not approved at the time of required payment, the payment of development contributions to the satisfaction of the responsible authority in accordance with the exhibited ACEPDCP; if the ACEPDCP is not yet exhibited at the time of required payment, the payment of development contributions to the satisfaction of the responsible authority in accordance with the exhibited ACEPDCP as soon as it is exhibited. 129
6 The agreement must specify that any development contribution payment made by a party that is greater than the payment that otherwise would have been payable under the approved ACEPDCP: must be refunded to that party by ; or subject to agreement between that party, may become a credit against the payment by that party of other development contributions under the ACEPDCP. Conversely, the agreement must specify that the extent of any development contribution payment made by a party that is less than the payment that otherwise becomes payable under the approved ACEPDCP, will be paid by that party to at the time of approval of the ACEPDCP. 5.2 INFRASTRUCTURE AND SERVICES REQUIRED OUTSIDE ACEP TO SUPPORT DEVELOPMENT OF ACEP There are no infrastructure or services outside ACEP required to be provided by developers or through the ACEPDCP to support its development. 5.3 PROJECT CO-ORDINATION A number of projects can be grouped as, if delivered together or in a co-ordinated way, they have potential to deliver significant benefits to the community beyond the benefits of each project if delivered separately. Examples of the projects that could be grouped for co-ordinated delivery include: the State secondary, primary special needs schools west of the neighbourhood activity centre; combinations of sub-projects that make up the regional active open space east of Barwon Heads Road; community associated works in the neighbourhood activity centre (immediately west of Barwon Heads Road); community associated works in the local activity centre (immediately west of Horseshoe Bend Road south of Stewarts Road); 130
