1 The Cub Club, Inc. dba The Fort Myers Flying Club Rules and Regulations Revised April 17, 2013 I. Equipment and Costs. A. Type. FMFC aircraft are located at Page Field, Fort Myers, Florida, and consist of: N944CC 1979 Piper PA Archer II N9490X 1985 Cessna 182 Skylane N3521Q 2001 Cessna 172 Skyhawk RESTRICTIONS: A check-out by a Club approved CFI is required to fly all aircraft. The check-out is individual for each type. Each aircraft requires at least one hour or the hours necessary for CFI sign-off, plus instruction on avionics as applicable. In addition, the Cessna 182 requires 75 hours PIC and 5 hours in type and model, and a high performance endorsement. All CFI check-out forms must be on file with the FMFC prior to each members solo flight in Club aircraft. Flying costs are at the established rates per hour as determined by the reading from the aircraft Hobbs meter before and after flight and include all costs of fuel and oil. Rates are subject to change with one month notice to the membership. Fuel cost will be averaged for each month. B. Expense and Reimbursement: On all cross country flights, all fuel, oil and routine service bills, excluding airport tolls, hangar, and tie down fees paid by the member will be credited to his account after such receipts showing the FBO name, date and aircraft number are presented to the Treasurer. Fuel cost will be reimbursed based on fuel sale price. To obtain credit, 1

2 all receipts must be submitted as required by the Board within thirty (30) days and adjusted according to a resolution of the Board of Directors from time to time. Fuel cost reimbursement will be based on cost the Club pays for 100LL at Page Field. II. Membership. A. Costs: 1. Active Members: $ entrance fee (includes the first month s dues) and $40.00 monthly dues. 2. Family Members: No entrance fee and $20.00 monthly dues. 3. Inactive Members: Downgrade from Active status. $20 monthly dues. 4. Student Members: $ entrance fee (includes the first month s dues) and $40.00 monthly dues. 5. Instructors: $ entrance fee (includes the first month s dues) and $40.00 monthly dues. 6. Associate Members: $60 annual dues. 7. Honorary Members: No dues. B. Privileges. All new members, having been approved by a majority of the Board of Directors, are authorized the following privileges for sixty (60) days. To remove the sixty day limitation the member must attend one (1) Board of Directors meeting or a Club General Meeting within sixty days after acceptance into the Club. 1. Active Members: Full use of all Club equipment subject to limitations as described in Section IV. 2. Family Members: Same participation as Active Member as long as the: a. Family member is part of the household of parent or spouse of the Active Member. b. Family member s parent or spouse member remains as Active Member in good standing. Termination of either of the above criteria necessitates Family Member upgrade to Active Member status and payment henceforth of active member dues or 2

3 resignation. 3. Inactive Members: All privileges of Club except flying of aircraft and: a. Is available to all Active Members who wish to remain active with the Club but terminate their flying activity with the Club. b. May become an Active member at any time upon petition to the Board of Directors and payment henceforth of Active member dues. c. An Inactive Member, after change of Active Member status, must remain on Active status for six months before he/she can reapply for Inactive status. 4. Student Members: Same participation as Active Member except restriction to C172 and PA28 as primary training aircraft. 5. Associate Members: Are social members without voting or flying privileges. 6. Honorary Members: In recognition of service and contributions to the Club, the Board may classify a member as Honorary. Honorary Members have dues waived and do not vote or fly club aircraft. Honorary Members may return to Active Member status by: a. Notifying the treasurer of the desire to return to active status, and b. Resumption of monthly Active Member dues payments. 7. Resigned Members: Within a 2 year period after resignation any member who resigned is good status can reapply for reinstatement to active status. The entrance fee will be: a. One-third (1/3) of the entrance fee applicable at the time of reinstatement if the resignation has been in effect for one year or less. b. Two-third (2/3) of the entrance fee if the resignation has been in effect for one year but less than two years. c. Full entrance fee if the resignation has been in effect two years or longer. C. Credit Limitations: 1. New Members: $ maximum during the first year unless approval for extended credit is petitioned for by the member and approved by the Board of Directors. Cross-country or extended trips during the first year of membership may require a deposit from the member prior to permission for said trip(s), at the discretion of the Board of Directors, approximating the difference between the estimated cost of the flight(s) and the credit limit. 2. Established Members: Will receive unlimited credit beginning the second year if a history of on-time payment has been established. 3

4 III. Reservations A. Entering: 1. Up to 72 hours duration: Time of departure, time of return, destination, and member s name must be entered into MyFBO. MyFBO must be checked prior to each flight to be certain that it is properly reserved. All members are responsible for appropriate and correct use of the MyFBO reservation system, including making and cancelling reservations, as well as dispatching and checking in aircraft at the completion of the flight. 2. Extended trips is excess of seventy-two (72) hours require the member to complete the online Extended Trip Request Form and get approval of three Board Members. A MyFBO administrator must schedule the trip on MyFBO. The Board must be notified in advance by of all extended trips. B. Canceling: It is the member s responsibility to cancel and/or remove from MyFBO any reservation that will not be used as early as possible. Likewise, the remainder of any reservation completed early must be canceled and removed from MyFBO as soon as a member returns from his flight. If possible, cancellations should be done twelve (12) hours prior to the flight time. C. Ground Time: On all reservations of over seventy-two (72) hours, the aircraft must be flown an average of 2.5 hours per day. If the aircraft does not average 2.5hours per day, the difference between the actual flight time and the 2.5 hours per day must be paid for at a rate that is one-third (1/3) the hourly rate of that specific aircraft. D. Late Departure/Returns: 1. Departure: If an aircraft is not taken within thirty (30) minutes after the time reserved, it will be available to any other member desiring the use of that aircraft. The member will complete the 30 minute notification form and leave it in the treasurer s box. 2. Returns: Overtime flying involving time reserved by another member is prohibited unless an actual emergency or weathered-in condition exists as defined by Disciplinary Actions (Section VI). When a pilot finds he will not be able to return in his allotted time, it is MANDATORY he/she telephone the next pilot and inform him/her that the flight is delayed. It is also MANDATORY that this pilot contact the Club president or aircraft officer when the flight is delayed. This procedure will be followed for all overtime flying, whether emergency, weathered-in, or just plain late. A proper message left with the Club president or aircraft officer in case of emergency or weather will relieve the pilot of 4

5 all responsibility for the reservation forfeited by his delay unless there are questionable circumstances. In this event, the decision of an investigation committee will prevail. Ground time charges will be levied during the delay as for a normal flight unless waived by the investigating committee. Overtime flying involving infringement could cost the offending member the just difference between the member s cost and that of an equivalent aircraft. If the member whose reserved time was encroached upon rents a substitute aircraft, he/she may submit a bill to the offending member if the Board of Directors deems it just and fair. E. Limitations: 1. Weekends: A member may not reserve an aircraft for more than one individual full weekend during a calendar month except involving an approved extended trip reservation. A weekend is defined as overnight Saturday night. More than one weekend in a calendar month may be reserved with approval of the Board of Directors. 2. Duplicate: A member may not reserve more than one aircraft for the same period of time. 3. Reservations: With the exception of a same day reservation, a member may not have more than two (2) reservations booked at any given time. F. Infringements/Abuse of Reservations: Any member should report the infringement or abuse of MyFBO to the Board of Directors and/or the Disciplinary Officer. Offending members shall be dealt with as deemed fair and as outlined in Section VI, Disciplinary Actions, by the Board of Directors and/or Disciplinary Officer. IV. Operations of Aircraft. A. Documentation: 1. Before operating any Club aircraft, members must have on file with FMFC a copy of his/her current medical certificate, flight review, license, check-ride form and other documents required by the Board. Each member is required to submit a current copy of his/her license, medical certificate and biennial flight review or new rating. Failure to comply will result in automatic grounding. 2. The member renting the aircraft is personally responsible for any deductible in any insured accident. B. Applicable Operating Rules to be observed by all members: 1. Federal Air Regulations. (FAR s) 5

6 2. State and local airport regulations and rules. 3. FMFC Bylaws, Rules and Regulations. 4. Applicable Pilot Operating Handbook (POH) for aircraft. 5. The aircraft shall not be started unless a competent operator is at the controlls. No member shall execute slow rolls, snap rolls, spins, inverted flight or other unusual maneuvers that might cause structural damage to Club aircraft, other than maneuvers required during a flight test for any airman s certificate. 6. Club requirement: Pilot must have five (5) hours in a similar aircraft (i.e. tricycle gear) and one (1) hour in make and model in addition to a Club check-out. A high performance endorsement, five (5) hours in make and model, and 75 hours PIC time are required to fly the Cessna 182, N9490X. 7. Operate aircraft in a friendly and courteous manner. C. Use Limitations: 1. Airports. The aircraft belonging to FMFC shall be operated only from those landing areas which are officially recognized as a public or private airport, as designated on current sectional charts, unless deemed off limits by the Board of Directors. Flights which do not fall into this category must be approved on a case by case basis by the Board. 2. Non-members: The aircraft shall not be loaned or rented to non-members. The aircraft owned by the Club shall not be flown by persons other than members unless the Club member is in one of the front seats and serving as Pilot In Command (PIC). 3. Check-Ride Form: Prior to initial flight, new members must submit a Check- Ride Form endorsed by an approved Club member CFI for each Club aircraft type and model to be flown. 4. Commercial Use: Any form of commercial fees charged in or for the use of Club aircraft is strictly prohibited. Only an approved Club CFI may instruct Club members in Club aircraft. Members may have passengers share the costs of a flight. 5. Approved CFI: Only CFI s approved by the Club may give dual instruction to Club members in Club aircraft. All Club CFI s must be Active members. A current instructor list is published in the Club s newsletter. Use of a non-approved CFI is a violation of rules and subject to fines listed in Section F. Any CFI wishing to become an approved instructor will 6

7 accomplish the normally required aircraft check-outs from the right seat. Another Club approved CFI will perform the check-out. These check-outs will satisfy the Club s initial check-out requirements and enable the new member CFI to give dual instruction in Club aircraft. 6. Flights Outside the United States, including the Bahamas: Flights operating outside the continental US including the Bahamas must be approved by the Board of Directors. All pilots operating outside the United States must have at least 150 hours PIC or an IFR rating. Pilots with no previous experience flying to the Bahamas must have a preflight briefing conducted by a FMFC representative or other experienced party. Pilots must be familiar with any special rules for flights outside the United States, and are responsible for compliance with all regulations. All pilots requesting flights outside the US must complete the Bahamas/International Trip Request Form which will be reviewed and approved by 3 members of the Board. The Board must be notified by in advance of all trips to the Bahamas. A MyFBO administrator must schedule the trip on MyFBO. 7. Restricted Aircraft: The Club may from time to time operate higher performance/specially equipped aircraft that have limitations and/or prerequisites for flight as determined by the Board of Directors. The specific limitations will be described in Section I, Equipment. In all cases, in addition to such prerequisites, a member is responsible for obtaining and becoming familiar with a personal copy of the Pilot s Operating Handbook for the aircraft involved. 8. Night flights: Night flights are to be made in aircraft equipped for night flights and all pilots flying at night must be current under applicable FAR s. 9. Keys: Keys to all aircraft will be regulated by the Board of Directors. V. Responsibility A. Maintenance/Housekeeping: Each member using an aircraft will be responsible for the following items during each flight operation: 1. Pre-flight inspection according to Pilot Operating Handbook procedure. 2. Proper, legible logging in and out of the Hobbs hour meter and tach time. 7

8 3. Proper logging and notifying the Aircraft Officer of any malfunction(s), regardless of how minor the malfunction(s) may seem. 4. Ensure proper procedure for securing aircraft including the shut down procedure (avionics off), all switches off (including lights), control lock installed, properly tied down (including tail) when not in the hangar, doors locked and key returned to the Club office. 5. Park in the designated Club space or hangar at Page Field, or in a safe authorized location when away from Page Field. 6. Clean cabin interior, check for personal belongings, secure and stow belts and harnesses and install windshield sun screen or aircraft cover (when aircraft is not hangared). 7. A.R.O.W. documents (Airworthiness Certification, Aircraft Registration, Aircraft Operating Handbook, Weight and Balance, ) may not be removed from the aircraft. If any of the A.R.O.W. documents are removed from the aircraft other than at the request of a flight examiner for testing purposes, it will be considered a violation of the Fort Myers Flying Club Rules and Regulations and appropriate disciplinary action will be taken against offending party. 8. No smoking is allowed in or around any Club aircraft or in the Club office. B. Grounding of Aircraft: Whenever any private pilot or above acting as Pilot In Command of Club aircraft deems the aircraft not airworthy and takes the necessary steps to have the aircraft grounded, all members are prohibited from flying this particular aircraft until released for service by an A&P mechanic, Club President, or Club officer designated by the Club President to act in his behalf. Grounding of an aircraft should be entered into MyFBO. C. Equipment Damage: All equipment, whether it is aircraft or accessories, are the property of the Club exclusively and any attempt to tamper with, destroy, or in any way damage the property of the Club will be dealt with by the Disciplinary Committee and turned over to the civil authorities for prosecution. D. Maintenance Problems: If a Club aircraft encounters a maintenance problem, it will be the sole responsibility of the Club member for returning the aircraft to Page Field, Fort Myers, at his or her expense. 8

9 VI. Disciplinary Actions Violations and Fines A. Scope: Warnings, letters of reprimand or fines for violations of Club rules regarding reservations, logging, securing or operation of Club aircraft will be levied at the discretion of the Disciplinary Committee or Board of Directors. B. Parameters: Any third offense automatically requires an appearance before the Board plus the fine imposed. This means that the member shall be required to appear before the Board of Directors at the next scheduled Board meeting following his notification. Should said member fail to appear, he will be grounded until his appearance before a regular scheduled meeting of the Board. C. Offenses: All offenses are cumulative, meaning that a second offence of any type constitutes a second offense and will be treated as such. Offenses are listed by First, Second and Third. Violation of any Club Rule or Bylaw other than Specified. $50, Late Payment of Dues and Flying Time. $5, $10, $25 plus Board appearance In addition to fines, the cost of repair/replacement will be assessed. 1. Operational a. Improper tie down/not following the Securing AC checklist. $5, $15, Fine determined by Board appearance. b. Control/Throttle Lock Not Installed. $5, $15, Fine determined by Board appearance. c. Mag (Ignition) Left On while on ramp/hanger. $5, $15, Fine determined by Board appearance. d. Master Switch Left On while on ramp/hanger. $10, $25, Fine determined by Board appearance. e. Avionics Switch Left On while on ramp/hanger. 9

10 $10, $25, Fine determined by Board appearance. f. Smoking in Aircraft. g. Instructing Non-Member. h. Performing Aerobatics. i. Permitting Non-Member to Fly as PIC. j. Unlawful Use of Club Aircraft. k. Flying with Non Current License or expired Medical. 2. Reservations: a. Improperly Logged Reservation. $5, $15, $25 plus Board appearance b. Failure to Return Keys. $10, $25, $25 plus Board appearance c. Failure to use or Cancel Reservation. $10, $25, $25 plus Board appearance d. Flying an Aircraft Without a Reservation. e. Improper Change of Reservation. $15, $50, f. Unexplained failure to Return Aircraft on Time. $25, $50, NOTE: Acceptable excuses for late return of aircraft: 1. Weather below minimums for pilot or aircraft. 2. Aircraft malfunction rendering it not airworthy. 3. Pilot illness or bona fide family emergency. 10

11 In any case, it is mandatory to call the next pilot reserving the aircraft and explain the reason for the late return. The pilot will also notify the Club President or aircraft officer of the late return. Note that any infringement upon the reservation of another member may also cost the offending member the difference in cost between the aircraft involved and the cost of a comparable aircraft rented by the infringed-upon member as described in Section III. D. Accidents: 1. In the case of aircraft accident and/or damage, contact must be made with the Club Aircraft Officer or a Board member prior to operating the aircraft, obtaining repairs or taking any other action. 2. In the case of an aircraft accident and/or damage determined by the safety committee to be caused by pilot error, the involved member(s) shall be liable for any and all costs related to the accident/incident up to the amount not covered by insurance. 3. In the case of an accident and/or damage is determined by the safety committee to be caused by pilot error causing the aircraft to be grounded, ground time charges shall be levied against the offending member as described in Section III, Reservation/ Ground Time of the Rules and Regulations. E. Appeal: All fines and other forms of reprimand levied by the Disciplinary Officer may be appealed before the Board of Directors at the next regularly scheduled meeting. VII. Special Consideration for Officers and Appointed Positions. A. The following is a list of positions that, due to position requirements, can fly the club aircraft at a discounted rate. The discounted rate is determined by the credit units. A unit is defined as $100 credit towards aircraft rental only, and can be amended from time to time by the Board of Directors. Additionally, certain positions are exempt from monthly dues. 1. Treasurer 7 units, dues exempt. 2. Aircraft Maintenance Officer 2 units, dues exempt. 3. Newsletter Publisher 2 units. 4. President/Chair 2 units, dues exempt. 5. Secretary 1 unit. 6. Membership 1.5 units/new member, dues exempt. 11

12 7. Disciplinary Officer dues exempt. 8. Legal Officer dues exempt. B. All Board members shall pay monthly dues unless exempt in paragraph A above and can be offset by any accumulated credits. C. Cumulative Time: VIII. Amendments 1. Any member who has accumulated flying units may fly those off in the future. 2. Cumulative units are not negotiable, transferable, sellable, or convertible and have no cash value, except that credits accumulated are transferable to immediate family household members in good standing with the Club. Changes in, or amendments to, these rules may be affected only by the vote of a quorum of the Board of Directors and are subject to change. Such changes will be effective thirty (30) days after notification to the general membership is made. 12
