APPROVAL: CA BACKGROUND/RELATED STRATEGIC GOAL: The (ANAC) was originally formed in August 2003 by the Martin County Board of County Commissioners (BOCC) to include eleven members representing residents of aircraft noise impacted neighborhoods, citizens, businesses and municipal entities interested in the activities at Martin County Airport. On May 6, 2008 the BOCC added two new members to the committee, one representing residents in noise impacted areas near the airport and one representing the Witham Aero Club. The ANAC is tasked to recommend implementation of noise abatement and land use compatibility planning and mitigation measures adopted in the 2002 FAR Part 150 Noise and Land Use Compatibility Study. Appendix A of the attached report provides a summary of the noise study process and measures included in the Noise Compatibility Program (NCP). The Federal Aviation Administration s (FAA) record of approval of the 2002 study can be found on the Witham Airport home page at Table 2 on page 9 provides the implementation status of noise abatement and land use compatibility planning measures adopted in the study. ISSUES: This is the sixth annual report of the committee. It details the committee s activities and achievements over the 2009 calendar year. The report also includes information on the committee s goals and priorities for the 2010 calendar year (see page 12 of the report). Six meetings were held in Each meeting included regular updates regarding the Voluntary Home Acquisition Program and Sound Insulation Program (page 10 of the report), and from the Airport Director regarding the Voluntary Curfew Operations Log (page 13 of the report). Table 1 on page 6 of the report provides a summary of the committee s activities in The Committee s priorities for 2010 are located in Section 2.3 on pages 10 and 11 of the report. It is anticipated that 2010 will be the final year for the Martin County. Upon the completion of the above tasks, the committee will have accomplished all tasks it was developed to implement and sun setting the ANAC should occur following their final meeting in October The participation of all committee members has been greatly appreciated by airport staff. 6 Executive Summary The (ANAC) was originally formed in August 2003 by the Martin County Board of County Commissioners (BOCC) to include eleven members representing residents of aircraft noise impacted neighborhoods, citizens, businesses and municipal entities interested in the activities at Martin County Airport. On May 6, 2008 the BOCC added two new members to the committee, one representing residents in noise impacted areas near the airport and one representing the Witham Aero Club. Table 1 on page 6 provides a summary of the committee s activities in In 2009 the ANAC focused on continuing the Voluntary Home Acquisition Program in the Phase 2 project area, implementing the Sound Insulation Program, and monitoring the installation of the Noise Operations Monitoring System (NOMS). The committee worked with airport staff and the consultant to develop a Hybrid Project for the Phase 2 project area to allow homeowners the option to sell their property and relocate or remain in the home and receive sound insulation. The committee worked closely with staff and the vendor to develop a NOMS that would provide the most benefit to airport staff and the community. ANAC participated in the selection of the permanent noise monitoring sites and configuration of the portable monitoring trailer. The committee continued coordination with the FAA for publication of takeoff flight paths from all runways to minimize impacts on neighboring residential areas. ANAC representatives met with key FAA air traffic representatives to ensure that Martin County s interests were properly represented. Home Acquisition Program a program initiated by Martin County offering homeowners in noise impacted areas identified in the approved 2002 FAR Part 150 Noise Study with purchase and relocation assistance. Noise Abatement Departure Profile a series of actions taken by the pilot in command of an aircraft to control noise emissions of the aircraft on takeoff. National Business Aviation Association Noise Exposure Map documents the existing and future impacts of aircraft operations utilizing a standardized methodology and system of noise metrics. National Environmental Policy Act of an Act to establish a national policy for the environment, to provide for the establishment of a Council on Environmental Quality, and for other purposes. Noise Compatibility Program a list of actions the airport proprietor proposes to undertake to minimize existing and future noise and land use incompatibilities. INTRODUCTION This report provides an overview of the committee s activities during calendar year 2009 as well as the status of implementation of airport noise abatement and land use compatibility planning measures. The committee s priorities for the 2010 calendar year are also identified. 1.1 ANAC History On August 26, 2003, the BOCC created the (ANAC). The Commission acted upon recommendations of the committee overseeing the Airport s first comprehensive FAR Part 150 Noise and Land Use Compatibility Study 4 (Noise Study). Under the provisions of the BOCC resolution 5, the ANAC is tasked to recommend implementation of noise abatement and land use compatibility planning and mitigation measures adopted in the Noise Study. On May 6, 2008 the BOCC added two new members to the committee, one representing residents in noise impacted areas near the airport and one representing the Witham Aero Club. This change brought the committee membership to thirteen. The ANAC has been active since its first meeting in December Meetings and Topics Discussed The ANAC s enabling resolution specifies that meetings should be held as needed to develop and implement the recommendations of the FAA Part 150 Noise Study. All meetings are advertised in the County s announcements of public meetings to encourage community participation. Information is also posted on the County s website. The ANAC scheduled eight and conducted six meetings in Each meeting included a detailed agenda and presentations if appropriate. Correspondence received from outside sources was distributed and discussed if appropriate. Table 1 provides a list of ANAC meetings, agenda topics, and a synopsis of implementation activities CFR Part 150. 10 2. ANAC PRIORITIES AND PROJECT IMPLEMENTATION STATUS Throughout 2009 ANAC focused on actions related to FAR Part 150 noise program implementation. Table 2 summarizes the implementation status of each measure. The paragraphs below provide additional detail on specific priority projects. 2.1 Ongoing Noise Abatement Operational Projects Noise Abatement Departure Flight Tracks This measure contemplates the development of a standard departure procedure (DP) for use by pilots operating under Instrument Flight Rules. Departure flight tracks have been designed and FAA implemented for all runways at the Martin County Airport. These tracks minimize pilot deviation from flight paths and reduce noise associated with those deviations. Preliminary analysis was completed in 2006 and the information was provided to the FAA. The DPs were published in August 2009 and became effective and available for pilot use December 17, Compliance is encouraged through onairport signage, FBO posters, and publication in pilot information materials, pilot websites, and information in manuals. Runway 12/30 remains the preferential runway. Takeoff and Landing Procedures This measure recommends the use of National Business Aviation Association (NBAA) noise abatement takeoff and landing procedures. On June 26, 2008 the airport consultant team, with a grant provided by the Florida Department of Transportation (FDOT), collected field data of aircraft takeoff noise testing several noise abatement departure profiles. Stuart Jet Center, Galaxy Aviation, and Fair Air Wind Charter donated aircraft, fuel and pilots for the demonstration. This project won the Florida Airport s Council Noise Abatement Project of the Year Award in January 2009 and the Florida Dept. of Transportation (FDOT) Airport Project of the Year Award in August FDOT Aviation Department Manager, Aaron Smith presents the 2009 Airport Project of the Year Award to Martin County Airport Director, Mike Moon, A.A.E. 11 Install Flight Tracking System (Noise and Operations Monitoring System NOMS) This measure calls for the installation of equipment to monitor the effectiveness of NCP noise abatement measures. A FDOT grant covering 80% of the costs for the design and procurement of the NOMS was received in Lochard was the vendor selected to provide the Noise Monitoring System. Staff and the County s noise consultant began coordination with Lochard to design the NOMS. In 2009, Lochard began installing hardware and software for the noise monitoring system. This included the construction of two permanent solar powered noise monitoring sites. On October 22, 2009, a representative from Lochard demonstrated the features of the Martin County Airport system to the members of the ANAC. 13 2.2 Land Use Compatibility Planning Measures Under Ongoing Implementation Voluntary Home Acquisition Program (HAP) and Voluntary Sound Insulation Program - The HAP provides for the purchase and relocation of residences in noise impacted areas with the initial effort focused upon those within the DNL contours in the 2002 Noise Exposure Map. Participation in these programs is voluntary on the part of eligible homeowners. Phase 1 indicated in Figure 1 by the shaded parcels has been completed. The property is currently a green space. The Sound Insulation Program provides residential sound insulation treatment to homes located within the DNL dba and dba noise contours that are not included in the home acquisition program. Figure 1 also depicts Phases 3 and 4, which are recommended for sound insulation. Figure 1 Voluntary Home Acquisition Program Area Phase 1 (Completed) Voluntary Sound Insulation Program Areas Phase 3 and Phase 4 Figure 2 illustrates the Phase 2 voluntary home acquisition program and voluntary sound insulation program project area and the Phase 5 voluntary sound insulation program project area. The ANAC originally recommended that Phase 2 be a voluntary home acquisition area. When the consultant team began meeting with eligible Phase 2 homeowners to complete the needs assessment surveys, a number of homeowners indicated a desire to remain in their homes and receive sound insulation instead of acquisition. Those homeowners choosing to receive sound insulation, and neighboring homeowners not eligible for participation in any program, expressed Hanson Professional Services, Inc. Page 9 PDF Page 13 of 30

14 concerns about what would happen to the lots of the homes purchased by the County. In response to those concerns, ANAC, staff and the consultants developed a hybrid project. This hybrid project allows the County to sound insulate homes of those who do not want to sell in exchange for an Avigation Easement. For those who want to sell and relocate, the County will purchase that home, sound insulate it, and re-sell the property. Properties purchased and re-sold by the County will be sold with an Avigation Easement attached to property. Proceeds form the sale of each home will be returned to the project budget to fund further implementation. Martin County accepted a grant from the FAA for $4,522,000 to fund the Phase 2 hybrid project area in August A grant from the FDOT was also accepted in the amount of $119,000. The consultant team has begun coordination with homeowners in the Phase 2 project area to implement the program. 15 2.3 ANAC Priorities for 2010 The committee has prioritized the following measures for the 2010 calendar year. Noise Exposure Map (NEM) Update The FAA is requiring the airport to complete an NEM update in order to continue receiving federal funding for the Land Use Mitigation Program. The updated NEM will document existing and future (5 year forecast) impacts of aircraft operations using a standardized methodology and system of metrics. The NEM documents the airport layout, runway locations, and flight tracks; illustrates aircraft related noise exposure in the form of noise contours; and identifies the compatible and non-compatible uses of land in areas surrounding the airport. Contours will be developed using the FAA approved Integrated Noise Model (INM) software. Noise Exposure Maps must illustrate the cumulative 6 impacts of aircraft operations within 3 specific contour levels: 75 dba 7, 70 dba and 65 dba. Re-Prioritization of Phases 3 through 5 of the Land Use Mitigation Program The committee will participate in the review of the updated Noise Exposure Maps. This review will include evaluating all non-compatible land uses located within the 65 DNL or greater noise contour. Phases 3 through 5 of the current Land Use Compatibility Plan will be re-evaluated to determine if those areas remain eligible for sound insulation. It is possible that some of the phases that were originally recommended for sound insulation will no longer be eligible for noise mitigation. Updating Pilot Informational Materials The ANAC will work with airport staff and the consultant to revise pilot educational materials. This includes handouts, brochures, posters, signage, and business cards. Revisions will reflect the publication of the new departure procedures. Sun setting the ANAC 2010 will be the final year for the Martin County Airport Noise Advisory Committee. Upon the completion of the above tasks, the committee will have accomplished all tasks it was developed to implement. The participation of all committee members has been greatly appreciated by airport staff. 3. Committee Monitoring Activities The ANAC continued focusing on implementation of programs that were legally, technically, and financially feasible. These included improving pilot/user awareness through enhanced education and informational materials, improving the availability of these materials, improving communications with airport service providers and aircraft owners that base their airplanes at SUA, providing positive reinforcement and recognition for those operators identified as working to comply with the County s noise abatement goals, and implementing direct communications 6 Part 150 requires that airports describe cumulative noise exposure during the average annual day: the repetitive day-night average sound level expressed in DNL 7 dba, or the A-weighted decibel represents the sound level which corresponds best to the range of the human ear. 16 from the ANAC Chair with operators of jet aircraft that frequently use the airport during voluntary curfew hours. To facilitate these programs, Airport staff has continued to provide the ANAC with monthly reports of total aircraft operations, total operations during voluntary curfew hours, and jet operations during these same hours. In 2009, Airport staff developed a graphic identifying the location of all noise complaints and now includes it with the monthly curfew report and reviewed by the ANAC. The ANAC reviews the reports at each meeting and provides recommendations to staff regarding the need for communication with violators and/or other actions. Figure 3 provides a graphic illustration of total airport operations for January through December for 2007 through Figure 4 illustrates the total operations during the curfew period only and Figure 5 depicts the number of jet operations during the voluntary curfew period. Figures 6 and 7 illustrate the number of total curfew operations and curfew operations by jet aircraft based on the time of day. Airport staff consults a number of sources to compile this information, including FAA airport traffic reports, airport security flight tracking logs, Amstat and Landings.com. It should be noted that nighttime operations do not include those conducted by the Sheriff s Department, U.S. Coast Guard, Lifestar or mosquito control and exclude operations such as medical delivery and air ambulance. Such operations are exempt from the provisions of the voluntary curfew. 8 An aircraft arrival (landing) or departure (takeoff) represents one operation. A low approach or touch and go operation is counted as both a landing and a takeoff (2 operations). 22 APPENDIX A SUMMARY OF FAR PART 150 NOISE STUDY PROCESS AND RECOMMENDATIONS FAR PART 150 NOISE STUDY PROCESS In August 2001, the Board of County Commissioners submitted documentation to the FAA to satisfy the requirements of FAR Part 150, Airport Noise and Compatibility Planning. 9 FAR Part 150 defines the procedures, standards, and methodology governing the development, submission, and review of airport noise exposure maps and noise compatibility programs. The Federal Aviation Administration (FAA) is responsible for administering Part 150 and participation by airports is voluntary. The process offers airport sponsors, users, and citizens the opportunity to examine the potential impacts of aircraft operations on surrounding environs and to develop programs that minimize noise related land use incompatibilities. A formal submission under FAR Part 150 includes two (2) volumes: (1) the Noise Exposure Map (NEM) and (2) the Noise Compatibility Program (NCP). The Noise Exposure Map (NEM) The overall purpose of the NEM is to document existing and future impacts of aircraft operations using a standardized methodology and system of metrics. The NEM documents the airport layout, runway locations, and flight tracks; illustrates aircraft related noise exposure in the form of noise contours; and identifies the compatible and non-compatible uses of land in areas surrounding the airport. The NEM must address two specific timeframes: (1) the year of submission, and (2) the fifth year following submission. The year of submission of the SUA Study was 2002; 2007 represents the 5-year forecast. FAR Part 150 requires the development of noise contours using an FAA approved computer prediction model called the Integrated Noise Model (INM). Contours must illustrate the cumulative 10 impacts of aircraft operations within 3 specific contour levels: 75 dba 11, 70 dba and 65 dba. The SUA study went beyond this minimum requirement and included the evaluation of impacts within the 60 dba and 55 dba contour levels. The Noise Compatibility Program (NCP) The NCP is a list of actions the airport proprietor proposes to undertake to minimize the existing and the future noise/land use incompatibilities. Acceptance by the FAA of the submission is a prerequisite to application for funding of implementation actions. In addition, it does not eliminate the need to formally address other environmental impacts of proposed actions pursuant to the requirements of the National Environmental Protection Policy Act (NEPA). FAR Part 150, Appendix B Noise Compatibility Programs, Sec. B150. (b) states that the purposes of the NCP are to: 9 14 CFR Part Part 150 requires that airports describe cumulative noise exposure during the average annual day: the repetitive day-night average sound level expressed in DNL 11 dba, or the A-weighted decibel represents the sound level which corresponds best to the range of the human ear. 23 (1) To promote a planning process through which the airport operator can examine and analyze the noise impact created by the operation of an airport, as well as the costs and benefits associated with the various alternative noise reduction techniques, and the responsible impacted land use control jurisdictions can examine existing and future areas of non-compatibility and consider actions to reduce non-compatible uses; (2) To bring together through public participation, agency coordination, and overall cooperation, all interested parties with their respective authorities and obligations, thereby facilitating the creation of agreed upon noise abatement plan especially suited to the individual airport location while at the same time not unduly affecting the national air transportation system; and (3) To develop comprehensive and implementable noise reduction techniques and land use controls which, to the maximum extent feasible, will confine severe aircraft noise impacts (DNL 75 dba and greater) to areas within the airport boundary and will establish and maintain compatible land uses in the areas affected by noise between the DNL 65 and 70 dba contours. As allowed under FAA regulations 12 Martin County elected to evaluate the compatibility of land uses beyond the minimum requirements of FAR Part 150 and within the 60 and 55 DNL dba noise levels. Figure C.1 illustrates the 2002 and 2007 noise exposure contours with implementation of the recommended NCP measures. The FAA has ultimate authority in the review and approval of noise compatibility measures recommended in the NCP 13. Under Part 150 regulations, the FAA must evaluate each measure based upon strict criteria including whether a proposed measure: Creates an undue burden on interstate or foreign commerce; Is consistent with the goal of reducing existing non-compatible land uses and preventing new non-compatible land uses; Includes noise control measures that can be implemented within the period covered by the program, and Does not compromise safety or the efficient use and management of navigable airspace and air traffic control systems. 12 FAR Part 150, Part B Noise Exposure Map Development, Sec. The ROA includes actions that Martin County recommends be taken by the FAA and actions that are to be implemented by Martin County for the purposes of reducing the impacts of aircraft operations and reducing land uses that are not compatible with normal airport operations. 25 FAR PART 150 NOISE ABATEMENT PROGRAM OPERATIONAL MEASURES Noise abatement and operational measures fall within three general categories: (1) measures to limit the impacts of aircraft ground noise; (2) measures to limit the impacts of aircraft takeoff and landing noise; and (3) measures that can enhance implementation and monitoring of the noise abatement program in general. Martin County adopted twelve (12) noise abatement and operations measures following analysis as part of the FAR Part 150 planning process. Unless specifically noted, the measures adopted by Martin County and approved for implementation by the FAA are as follows: Measures to limit aircraft ground noise impacts (noise study measure-ops) Engine Run-Up Procedures and Facilities (OPS11) Noise Barriers (OPS12) Measures to limit the impacts of aircraft takeoff and landing noise Preferential Runway Use (OPS1) [This measure was disapproved by FAA.] Ban of Stage 1 Aircraft (OPS2) [This measure was disapproved by FAA.] Voluntary Stage 2 Aircraft Nighttime Curfew (OPS3) Voluntary Touch-and-Go Limits (OPS4) Runway 12 Voluntary Noise Abatement Departure Flight Track (OPS5) Runway 30 Voluntary Noise Abatement Departure Flight Track (OPS6) Voluntary Takeoff and Landing Procedures (OPS7) [This measure was disapproved by FAA pending submission of additional data to make an informed analysis.] Measures to enhance implementation and monitoring Install Flight Tracking System (OPS8) Pilot Information Program (OPS9) Monitor Air Traffic Control Frequencies (OPS10) FAR PART 150 LAND USE COMPATIBILITY MEASURES Land use compatibility measures are designed to provide additional relief to residents surrounding the airport who remain impacted after the operational measures have been implemented.
