1 Republika e Kosovës Republika Kosovo Republic of Kosovo Autoriteti i Aviacionit Civil i Kosovës Autoritet Civilnog Vazduhoplovstva Kosova Civil Aviation Authority of Kosovo Director General of Civil Aviation Authority of the Republic of Kosovo, Pursuant to Article 3.4, 15.1 items (a), (c), (e), (f), (j), (k), and 21.2 of the Law No. 03/L-051 on Civil Aviation ( Official Gazette of the Republic of Kosovo Year III, No. 28, 4 June 2008), For the purpose of regulating aviation activities related with Remotely Piloted Aircraft Systems (RPAS) weighing less than 20 kilogrammes, operating in the airspace of the Republic of Kosovo and with the aim of developing and facilitating the RPAS activities while providing acceptable conditions for safe operation, After having completed public consultation process with all interested parties pursuant to the Administrative Instruction No. 01/2012 on Public Consultation of interested parties, Hereby issues the following: REGULATION No. 6/2014 ON REMOTELY PILOTED AIRCRAFT SYSTEMS WEIGHING LESS THAN 20 KILOGRAMMES Article 1 Applicability The present Regulation shall apply to all civil aviation activities within the territory of the Republic of Kosovo related with Remotely Piloted Aircraft Systems (RPAS) weighing less than 20 kg except for unmanned free balloons. Article 2 Definitions and Abbreviations For the purpose of the present Regulation, the definitions and abbreviations used herein shall have the following meaning: Aircraft - means any machine that can derive support in the atmosphere from the reactions of the air other than the reactions of the air against the earth s surface.

2 CAA - means Civil Aviation Authority of Kosovo established pursuant to the Law No. 03/L-051 on Civil Aviation. ATC Permission - means a formal written or oral consent from the Air Traffic Control Unit. KFOR J3Air - means an officer-in-charge for military and civilian air operations into Kosovo Airspace, whose scope of duties are set forth in the Regulations for aircraft operating as general air traffic (GAT) in the Balkan Joint Operation Area (JOA) as amended from time to time by the NATO Commander Combined Air Operations Center. MHz - means a unit of frequency equal to one million hertz. Model flying site - means a site of specified dimensions allocated for exclusive use to a specific user(s). Operator - means a person, organization or enterprise engaged in or offering to engage in an aircraft operation. Remotely piloted aircraft (RPA) - means an unmanned aircraft which is piloted from a remote pilot station weighing less than 20 kg. Remotely piloted aircraft system (RPAS) - means an RPA, its associated remote pilot station(s), the required command and control links and any other components as specified in the type design. Visual line-of-sight operation - means an operation in which the remote crew maintains direct visual contact with the aircraft to manage its flight and meet separation and collision avoidance responsibilities. Article 3 General provisions 3.1 The owner or operator of an RPAS shall be responsible for the flights with the aircraft being performed in accordance with the Law No. 03/L-051 and provisions of the present Regulation. 3.2 The owner or operator of an RPAS must not cause or permit any article or animal, whether equipped or not with the parachute, to be dropped from a remotely piloted aircraft so as to endanger persons or property. 3.3 The owner or operator of an RPAS may only operate the aircraft if reasonably satisfied that the flight can safely be performed. 3.4 The owner or operator of an RPAS must maintain direct, unaided visual lineof-sight with the aircraft sufficient to monitor its flight path in relation to other

3 aircraft, persons, vehicles, vessels and structures for the purpose of avoiding collisions. 3.5 The owner or operator of an RPAS must not operate the aircraft for the purposes of aerial work and equipped with photographing or remote sensing equipment without special permission granted by the CAA, in addition to the permission granted pursuant to Article 4 of this Regulation. Article 4 Operation permit 4.1 Upon submission of request to operate an RPAS, CAA shall review such request in accordance with the conditions set by the Article 5 and 6 of the present Regulation. 4.2 While reviewing the request from paragraph 1 of this Article, the CAA shall coordinate with KFOR J3-Air before permission to operate an RPAS is issued. 4.3 Once the conditions of paragraph 1 and 2 of this Article are met, the CAA shall issue a permit to operate the RPAS. 5.1 General conditions Article 5 Operational conditions For flights with RPAS the following shall apply: a) The flight must be performed in such way that no other persons or property are endangered and that the surroundings are inconvenienced as little as possible; b) The flight must be performed within 500 meters of the operator at all times; c) Clear of controlled airspace, unless with ATC permission; d) Clear of any aerodrome traffic zone, unless with ATC permission; e) Clear of any military airbase or restricted/prohibited areas; f) The distance to built-up areas and major public roads shall be at least 150 m; g) The flight level must not exceed 100 m above terrain; h) Densely built-up areas, including areas with weekend cottages and inhabited camping sites, and areas with large open-air assemblies of persons must not be overflown; i) The particularly environmentally sensitive nature areas must not be overflown. 5.2 Special rules (large models)

4 For flights with RPAS with a takeoff mass above 7 kg and below 20 kg, including fuel, and for RPAS using jet turbine engine(s) as power, the following shall apply in addition to the provisions referred to in paragraph 1 of this Article: a) RPAS must be equipped with radio control installation; b) Flights must be performed only from an approved model flying site, in accordance with paragraph 3 (b) of this Article, and within the limitations of the airspace belonging to a notified model flying site, in accordance with paragraph 3 (a) of this Article; c) Flights must not be performed unless a third party liability insurance has been issued in accordance with Article 93 of the Law No. 03/L-051 on Civil Aviation; d) Flights must be performed by owner or operator whose scope is to operate flights with large RPAS models on an amateur basis and in accordance with relevant regulations issued by the CAA. e) Any powered model aircraft fitted with a receiver capable of operating in failsafe mode should have the failsafe set, as a minimum, to reduce the engine(s) speed to idle on loss or corruption of signal. 5.3 Model flying site and airspace In order that a field may be used as a model flying site, the provisions of the paragraph 1 of this Article and the following conditions must be met: a) There must be an airspace around the field covering an area of at least 100 x 300 m; b) The model flying site must be approved by the CAA. An application for approval must contain a map of the area and a description of the model flying site and its airspace; c) To use the site as model flying site, permission by the owner or any other person individual or legal who has legal ownership rights or interest, must be obtained. The owner or such other person, of areas covered by the model flying site airspace must be notified before commencement of activities. Article 6 Radio control installation 6.1 Transceivers for radio-controlled model aircraft must meet regulatory requirements in accordance with the Law No. 04/L-109 on Electronic Communications, and secondary legal acts for the implementation of the assignment and use of radio frequencies. 6.2 Radio controlling of the RPAS, covered by paragraph 2 of Article 5, must be performed in accordance with the National Radio-Frequencies Plan, regulatory framework of the European Union and national legislation on electronic communications resources.

5 Article 7 Review of decisions Appeals against decisions taken by the CAA pursuant to the provisions of the present Regulation may be presented to the Board of Appeals, in accordance with applicable law. Article 8 Exceptions Notwithstanding fulfillment of conditions of Article 5 of the present Regulation, CAA may withdraw an approval granted or reject granting an approval to the owner or operator of an RPAS, or request immediate seizure of RPAS operations. Actions of CAA taken pursuant to the provisions of this Article shall be duly justified. Article 9 Punitive measures 9.1 Any person found in violation of the provisions of Article 5, paragraph 1 and 2 of the present Regulation, shall be issued a fine in accordance with Article 96 or 97 of the Law No. 03/L-051 on Civil Aviation. 9.2 Anyone operating a model flying site who violates the provisions of Article 5, paragraph 3 of the present Regulation shall be issued a fine in accordance with paragraph 1 of this Article.
