3 GEN ANNEX 2 - RULES OF THE AIR (10 th Edition, July 2005) CHAPTER 3, New Provision. Implementing Regulation (EU) No 923/2012, SERA.3210(b), specifies: (b) An aircraft that is aware that the manoeuvrability of another aircraft is impaired shall give way to that aircraft. CHAPTER 3, (b) Implementing Regulation (EU) No 923/2012, paragraph SERA.3215(b)(2), specifies (with the addition to ICAO Standard in Annex 2, (b) of the underlined text): (2) unless stationary and otherwise adequately illuminated, all aircraft on the movement area of an aerodrome shall display lights intended to indicate the extremities of their structure, as far as practicable; CHAPTER 3, (c) and (d) Implementing Regulation (EU) No 923/2012, paragraph SERA.3225 differs from ICAO Standard in Annex 2, 3.2.5(c) and 3.2.5(d) in that it specifies that subparagraphs (c) and (d) do not apply to balloons: (c) except for balloons, make all turns to the left, when approaching for a landing and after taking off, unless otherwise indicated, or instructed by ATC; (d) except for balloons, land and take off into the wind unless safety, the runway configuration, or air traffic considerations determine that a different direction is preferable. CHAPTER 3, ICAO Annex 2, is replaced with Implementing Regulation (EU) No 923/2012 SERA.4001(b). The differences between this ICAO Standard and this Union regulation are as follows: - With regards to VFR flights planned to operate across international borders, the Union regulation (SERA.4001(b)(5)) differs from the ICAO Standard in Annex 2, (e) with the addition of the underlined text, as follows: any flight across international borders, unless otherwise prescribed by the States concerned. - With regard to VFR and IFR flights planned to operate at night, an additional requirement is inserted to Union regulation SERA.4001(b)(6)as follows: (6) any flight planned to operate at night, if leaving the vicinity of an aerodrome CHAPTER 3, New Provision. Implementing Regulation (EU) No 923/2012, paragraph SERA.3210(c)(3)(i) differs from ICAO Standard in Annex 2, by specifying that: (i) Sailplanes overtaking. A sailplane overtaking another sailplane may alter its course to the right or to the left. CHAPTER 4, 4.3. New provision. ICAO Annex 2, 4.3, is replaced with Implementing Regulation (EU) No 923/2012 SERA.5005(c). The difference is that Implementing Regulation (EU) No 923/2012 adds requirements under which VFR flights at night may be permitted, as follows: (c) When so prescribed by the competent authority, VFR flights at night may be permitted under the following conditions: (1) if leaving the vicinity of an aerodrome, a flight plan shall be submitted; (2) flights shall establish and maintain two-way radio communication on the appropriate ATS communication channel, when available; (3) the VMC visibility and distance from cloud minima as specified in Table S5-1 shall apply except that: (i) (ii) the ceiling shall not be less than 450 m (1500 ft); except as specified in (c)(4), the reduced flight visibility provisions specified in Table S5-1(a) and (b) shall not apply; (iii) in airspace classes B, C, D, E, F and G, at and below 900 m (3000 ft) above MSL or 300 m (1000 ft) above terrain, whichever is the higher, the pilot shall maintain continuous sight of the surface; (iv) for helicopters in airspace classes F and G, flight visibility shall not be less than 3 km, provided that the pilot maintains continuous sight of the surface and if manoeuvred at a speed that will give adequate opportunity to observe other traffic or obstacles in time to avoid collision; and (v) for mountainous terrain, higher VMC visibility and distance from cloud minima may be prescribed. (4) ceiling, visibility and distance from cloud minima lower than those specified 4.3(c) above may be permitted for helicopters in special cases, such as medical flights, search and rescue operations and fire-fighting. (5) except when necessary for take-off or landing, or except when specifically authorised by the competent authority, a VFR flight at night shall be flown at a level which is not below the minimum flight altitude established by the State whose territory is overflown, or, where no such minimum flight altitude has been established: (i) (ii) over high terrain or in mountainous areas, at a level which is at least 600 m (2000 ft) above the highest obstacle located within 8 km of the estimated position of the aircraft; elsewhere than as specified in (i), at a level which is at least 300 m (1000 ft) above the highest obstacle located within 8 km of the estimated position of the aircraft. 4 GEN ANEXA 2 - REGULILE AERULUI (ediţia 10, iulie 2005) CAPITOLUL 3, Dispoziție nouă. Punctul SERA.3210 litera (b) din Regulamentul de punere în aplicare (UE) nr. 923/2012 prevede: (b) O aeronavă care cunoaște faptul că manevrabilitatea unei alte aeronave este afectată trebuie să acorde prioritate acelei aeronave. CAPITOLUL 3, (b) Punctul SERA.3215 litera (b) punctul 2 din Regulamentul de punere în aplicare (UE) nr. 923/2012 prevede [cu adăugarea textului subliniat la standardul OACI din Anexa 2 punctul (b)]: (2) cu excepția cazului în care sunt staționate și adecvat iluminate, toate aeronavele de pe suprafața de mișcare a unui aerodrom trebuie să aibă aprinse lumini destinate să indice extremitățile structurii lor, în măsura în care este posibil; CAPITOLUL 3, 3.2.5(c) și (d) Punctul SERA.3225 din Regulamentul de punere în aplicare (UE) nr. 923/2012 diferă față de standardul OACI din anexa 2, punctele 3.2.5(c) și 3.2.5(d) prin faptul că precizează că literele (c) și (d) nu se aplică în cazul baloanelor: (c) exceptând baloanele, să execute toate virajele spre stânga atunci când efectuează o apropiere pentru aterizare și după decolare, cu excepția cazului în care i s-a indicat altfel sau i s-au dat alte instrucțiuni de către ATC; (d) exceptând baloanele, să aterizeze și să decoleze cu vânt de față, cu excepția cazului în care siguranța zborului, configurația pistei sau considerentele de trafic aerian determină altă direcție preferabilă. CAPITOLUL 3, Punctul din Anexa 2 a OACI se înlocuiește cu punctul SERA.4001 litera (b) din Regulamentul de punere în aplicare (UE) nr. 923/2012. Diferențele dintre acest standard al OACI și prezentul regulament al Uniunii sunt următoarele: - Cu privire la zborurile VFR prevăzute să traverseze granițele internaționale, diferența dintre regulamentul Uniunii [punctul SERA.4001 litera (b) punctul 5] și standardul OACI din Anexa 2 punctul litera (e) constă în adăugarea textului subliniat, după cum urmează: oricărui zbor care traversează granițele internaționale, cu excepția cazului în care statele în cauză prevăd altfel. - Cu privire la zborurile VFR și IFR prevăzute să se desfășoare pe timp de noapte, s-a introdus o cerință suplimentară în Regulamentul Uniunii la punctul SERA.4001 litera (b) punctul 6, după cum urmează: 6. oricărui zbor prevăzut să se desfășoare pe timpul nopții, dacă se părăsește vecinătatea unui aerodrom. CAPITOLUL 3, Dispoziție nouă. Punctul SERA.3210 litera (c) punctul 3 subpunctul (i) din Regulamentul de punere în aplicare (UE) nr. 923/2012 este diferit de standardul OACI din anexa 2 punctul prin faptul că precizează: (i) Planoare care depășesc. Un planor care depășește un alt planor își poate devia cursul spre dreapta sau spre stânga. CAPITOLUL 4, 4.3 Dispoziție nouă. Punctul 4.3 din anexa 2 OACI se înlocuiește cu punctul SERA.5005 litera (c) din Regulamentul de punere în aplicare (UE) nr. 923/2012. Diferența constă în faptul că Regulamentul de punere în aplicare (UE) nr. 923/2012 adaugă cerințe conform cărora zborurile VFR pe timp de noapte pot fi permise, după cum urmează: (c) Atunci când autoritatea competentă prevede acest lucru, zborurile VFR pe timp de noapte pot fi autorizate în următoarele condiții: (1) în cazul părăsirii vecinătății unui aerodrom, trebuie depus un plan de zbor; (2) zborurile trebuie să stabilească și să mențină comunicația radio bilaterală pe canalul de comunicație al unității ATC competente, atunci când este disponibil; (3) se aplică minimele VMC de vizibilitate și distanță față de nori indicate în tabelul S5-1, însă: (i) (ii) plafonul nu poate fi mai mic de 450 m (1500 ft); cu excepția cazurilor prevăzute la litera (c) punctul 4, nu se aplică dispozițiile din tabelul S5-1 literele (a) și (b) referitoare la vizibilitățile în zbor reduse; (iii) într-un spațiu aerian de clasa B, C, D, E, F și G, la și sub cea mai mare altitudine dintre 900 m (3 000 ft) peste MSL sau 300 m (1000 ft) deasupra terenului, pilotul trebuie să mențină permanent suprafața la vedere; (iv) pentru elicoptere într-un spațiu aerian de clasa F și G, vizibilitatea în zbor nu poate fi mai mică de 3 km, cu condiția ca pilotul să mențină permanent suprafața la vedere și dacă sunt manevrate la o viteză care oferă posibilitatea de a observa alte aeronave sau orice obstacol la timp pentru a evita coliziunea; și (v) pentru terenurile muntoase, pot fi prevăzute de către autoritatea competentă minime VMC mai mari de vizibilitate și distanță față de nori; (4) pot fi autorizate minime mai mici de plafon, vizibilitate și distanță față de nori decât cele menționate la punctul 3 pentru elicoptere în cazuri speciale, cum ar fi zborurile medicale, operațiunile de căutare și salvare și operațiunile de stingere a incendiilor; (5) cu excepția cazului în care este necesar pentru decolare sau aterizare sau a cazurilor autorizate expres de autoritatea competentă, un zbor VFR pe timp de noapte se efectuează la un nivel care nu este situat sub altitudinea minimă de zbor stabilită de statul al cărui teritoriu este survolat sau în cazurile în care nu s-a stabilit o astfel de altitudine minimă de zbor: (i) (ii) deasupra terenurilor înalte sau în zonele muntoase, la un nivel care este la cel puțin 600 m (2000 ft) deasupra celui mai înalt obstacol situat pe o rază de 8 km de la poziția estimată a aeronavei; în alte locuri decât cele menționate la subpunctul (i), la un nivel care este la cel puțin 300 m (1000 ft) deasupra celui mai înalt obstacol situat pe o rază de 8 km de la poziția estimată a aeronavei. 5 GEN CHAPTER 4, 4.6. ICAO Annex 2, 4.6, is replaced with Implementing Regulation (EU) No 923/2012 SERA.5005, introducing the obstacle clearance criteria in (f), as follows: (f) Except when necessary for take-off or landing, or except by permission from the competent authority, a VFR flight shall not be flown: (1) over the congested areas of cities, towns or settlements or over an open-air assembly of persons at a height less than 300 m (1000 ft) above the highest obstacle within a radius of 600 m from the aircraft; (2) elsewhere than as specified in (1), at a height less than 150 m (500 ft) above the ground or water, or 150 m (500 ft) above the highest obstacle within a radius of 150 m (500 ft) from the aircraft. CHAPTER 3, 3.8 and Appendix 2 The words in distress of CHAPTER 3 Part 3.8, are not included in Union law, thus enlarging the scope of escort missions to any type of flight requesting such service. Furthermore the provisions contained in Appendix 2 Parts 1.1 to 1.3 inclusive as well as those found in Attachment A, are not contained in Union law. ANNEX 3 - METEOROLOGICAL SERVICE FOR INTERNATIONAL AIR NAVIGATION (17 th Edition, July 2010) CHAPTER 5 New provision. Implementing Regulation (EU) No 923/2012, paragraph SERA.12005, specifies: (b) Competent authorities shall prescribe as necessary other conditions which shall be reported by all aircraft when encountered or observed. ANNEX 4 - AERONAUTICAL CHARTS (11 th Edition, July 2009) - NIL ANNEX 5 - UNITS OF MEASUREMENT TO BE USED IN AIR AND GROUND OPERATIONS (5 th Edition, July 2010) - NIL ANNEX 6 - OPERATION OF AIRCRAFT Part I - International Commercial Air Transport Aeroplanes (9 th Edition, July 2010, Amendment 35) CHAPTER 1 Definitions Enhanced vision system (EVS) - This definition is not implemented in national legislation. Head-up display (HUD) - This definition is not implemented in national legislation. In accordance with EU-OPS Appendix 1 (Old) to OPS and Appendix 1 (New) to OPS 1.430: - for CAT IIIA RVR is not less than 200 m; - for CAT IIIB RVR is lower than 200 m but not less than 75 m. In accordance with Appendix 1 (New) to OPS for CAT IIIB the decision height is lower than 100 ft, or no decision height. CHAPTER 3 General 3.2 Safety management does not have requirements for SMS and SSP regarding OPS. However, some elements of the SMS are already in place according to EU-OPS requirements. CHAPTER 4 Flight operations Aeroplane operating procedures for rates of climb and descent - Recommendation This recommendation is not implemented in national legislation. CHAPTER 6 Airplane instruments, equipment and flight documents: Certified true copy Applicable provisions are OPS 1.125, OPS , OPS and CO: OPS-CC from a) Recommendation U-OPS/Part-OPS require a first aid kit for all flights, even if cabin crew is not required a) Recommendation EU-OPS/Part-OPS do not require a universal precaution kit a) Recommendation The emergency medical kit is required for aeroplanes with a max. approved seating config. of more than 30 seats if any point of the planned route is more than 60 minutes flying time from an aerodrome at which qualified medical assistance could be expected. 6 GEN CAPITOLUL 4, 4.6 Punctul 4.6 din Anexa 2 OACI se înlocuiește cu punctul SERA.5005 din Regulamentul de punere în aplicare (UE) nr. 923/2012, introducând criterii de trecere a obstacolelor la litera (f), după cum urmează: (f) Cu excepția cazului în care este necesar pentru decolare sau aterizare sau doar cu permisiunea autorității competente, nu se efectuează un zbor VFR: (1) deasupra zonelor dens populate ale orașelor sau ale altor așezări ori deasupra unor adunări de persoane în aer liber, la o înălțime mai mică de 300 m (1000 ft) deasupra celui mai înalt obstacol situat pe o rază de 600 m de la aeronavă; (2) în alte locuri decât cele menționate la punctul 1, la o înălțime mai mică de 150 m (500 ft) deasupra solului sau a apei sau de 150 m (500 ft) deasupra celui mai înalt obstacol pe o rază de 150 m (500 ft) de la aeronavă. CAPITOLUL 3, punctul 3.8 și apendicele 2 Cuvintele în pericol din CAPITOLUL 3 partea 3.8 nu sunt incluse în legislația Uniunii, extinzând prin urmare domeniul de aplicare al misiunilor de escortă la orice tip de zbor care solicită astfel de servicii. În plus, dispozițiile cuprinse în apendicele 2 părțile inclusiv, precum și cele care se regăsesc în apendicele A nu sunt cuprinse în legislația Uniunii. ANEXA 3 - ASISTENŢA METEOROLOGICĂ PENTRU NAVIGAŢIA AERIANĂ INTERNAŢIONALĂ (ediţia 17, iulie 2010) CAPITOLUL 5 Dispoziție nouă. Punctul SERA din Regulamentul de punere în aplicare (UE) nr. 923/2012 prevede: (b) Autoritățile competente dispun, în funcție de necesități, alte condiții care, atunci când sunt întâlnite sau observate, trebuie raportate de către toate aeronavele. ANEXA 4 - HĂRŢI AERONAUTICE (ediţia 11, iulie 2009) NIL. ANEXA 5 - UNITĂŢILE DE MĂSURĂ UTILIZATE ÎN OPERAŢIUNILE AERIENE ŞI LA SOL (ediţia 5, iulie 2010) - NIL ANEXA 6 - OPERAREA AERONAVEI Partea I - Transport Aerian Comercial Avioane (ediţia 9, iulie 2010, amendamentul 35) CAPITOLUL 1 Definiţii Sistem de intensificare vizuală (EVS) - Această definiţie nu este implementată în legislaţia naţională. Sistem de afişare de la nivelul ochilor (HUD) - Această definiţie nu este implementată în legislaţia naţională. În conformitate cu EU-OPS Apendicele 1 (varianta veche) la OPS şi Apendicele 1 (varianta nouă) la OPS 1.430: - RVR minim pentru CAT IIIA este 200 m; - RVR pentru CAT IIIB este mai mică de 200 m, dar nu mai mică de 75 m. În conformitate cu EU-OPS Apendicele 1 (varianta nouă) la OPS 1.430, pentru operațiuni din CAT IIIB, DH este sub 100 ft sau fără DH. CAPITOLUL 3 Generalităţi 3.2 Managementul siguranţei zborului ROMÂNIA nu are cerinţe pentru SMS şi SSP cu referire directă la OPS. Cu toate acestea unele elemente ale SMS sunt deja în aplicare conform cerinţelor EU-OPS. CAPITOLUL 4 Operaţiuni de zbor Proceduri de operare pentru ratele de urcare şi coborâre - Recomandare Această recomandare nu este implementată în legislaţia naţională. CAPITOLUL 6. Head-up display (HUD) - This definition is not implemented in national legislation. In accordance with Appendix 1 to JAR-OPS 3.430, for CAT I, RVR minimum is 500m. In accordance with RACR-OPS LAAG, Appendix 1 to RACR-OPS 0.430, for CAT IIIB RVR is lower than 200 m but not less than 75 m. SECTION 2 - INTERNATIONAL COMERCIAL AIR TRANSPORT CHAPTER 1 General 1.3 Safety management does not have requirements for SMS and SSP regarding OPS. However, some elements of the SMS are already in place according to JAR-OPS 3 requirements. Small helicopters (6000 lb or less) and large helicopters (heavier than 6000 lb) are classified as either Category A or B on the basis of engine and isolation features as well as performance capabilities. PART II (a) Romania transmits mandatory continuing airworthiness information to those States that request it and provide an address to which the information to be sent. PART III CHAPTER Romania also uses service experience and equivalent safety findings as a basis for finding compliance with the appropriate airworthiness requirements. CHAPTER 2, Paragraph Implementing Regulation (EU) No 923/2012 SERA.3401(d)(1) differs from ICAO Annex 11, standard by stating that Time checks shall be given at least to the nearest half minute CHAPTER 2, Paragraph Exemption possibility. Implementing Regulation (EU) No 923/2012 paragraph SERA.6001 allows aircraft to exceed the 250 knot speed limit where approved by the competent authority for aircraft types, which for technical or safety reasons, cannot maintain this speed CHAPTER 3 New provision. Implementing Regulation (EU) No 923/2012, paragraph SERA.8005(b), specifies: (b) Clearances issued by air traffic control units shall provide separation: (1) between all flights in airspace Classes A and B; (2) between IFR flights in airspace Classes C, D and E; (3) between IFR flights and VFR flights in airspace Class C; (4) between IFR flights and special VFR flights; (5) between special VFR flights unless otherwise prescribed by the competent authority; except that, when requested by the pilot of an aircraft and agreed by the pilot of the other aircraft and if so prescribed by the competent authority for the cases listed under (b) above in airspace Classes D and E, a flight may be cleared subject to maintaining own separation in respect of a specific portion of the flight below 3050 m (10000 ft) during climb or descent, during day in visual meteorological conditions. CHAPTER 3 Implementing Regulation (EU) No 923/2012, paragraph SERA.8015, specifies (with the addition to ICAO Standard in Annex 11, of the underlined text): (e) Read-back of clearances and safety-related information (1) The flight crew shall read back to the air traffic controller safety-related parts of ATC clearances and instructions which are transmitted by voice. The following items shall always be read back: (i) (ii) ATC route clearances; clearances and instructions to enter, land on, take off from, hold short of, cross, taxi and backtrack on any runway; and (iii) runway-in-use, altimeter settings, SSR codes, newly assigned communication channels, level instructions, heading and speed instructions; and (iv) transition levels, whether issued by the controller or contained in ATIS broadcasts. 10 GEN ANEXA 8 - AERONAVIGABILITATEA AERONAVEI (ediţia 11, iulie 2010, amendamentul 102) PARTEA I Definiţii Elicoptere clasa de performanţă 1, 2 si 3. Elicopterele mici (6000 lb sau mai puţin), precum şi elicopterele grele (mai mult de 6000 lb) sunt clasificate într-una sau alta dintre Categoriile A sau B, pe baza caracteristicilor de izolare ale motoarelor şi sistemelor, precum şi a capabilităţilor de performanţe. PARTEA II (a) România transmite informaţii obligatorii pentru continuitatea navigabilităţii către statele care le solicită şi care furnizează o adresă la care să fie transmise informaţiile. PARTEA III CAPITOLUL România foloseşte de asemenea experienţa în serviciu şi constatările de siguranţă echivalente ca o bază pentru constatarea conformării cu cerinţele de navigabilitate corespunzătoare. PARTEA IV CAPITOLUL Aşa cum s-a declarat în diferenţele claselor de elicoptere din Partea I, clasificările din România se bazează pe caracteristici constructive, cât şi de performanţă. CAPITOLUL 2, Punctul Diferența dintre punctul SERA.3401 litera (d) punctul 1 din Regulamentul de punere în aplicare (UE) nr. 923/2012 și standardul din anexa 11 constă în faptul că se afirmă: Verificările orei se furnizează cel puțin la cea mai apropiată jumătate de cel mai apropiat minut întreg. CAPITOLUL 2, Punctul Posibilitate de scutire. Punctul SERA.6001 din Regulamentul de punere în aplicare (UE) nr. 923/2012 permite aeronavelor să depășească limita de viteză de 250 de noduri în cazurile aprobate de autoritatea competentă pentru tipurile de aeronave care, din motive tehnice sau de siguranță, nu pot menține această viteză. CAPITOLUL 3 Dispoziție nouă. Punctul SERA.8005 litera (b) din Regulamentul de punere în aplicare (UE) nr. 923/2012 prevede: (b) Autorizările emise de unitățile de control al traficului aerian trebuie să asigure eșalonarea: (1) între toate zborurile desfășurate în spațiile aeriene de clasa A și B; (2) între zborurile IFR desfășurate în spațiile aeriene de clasa C, D și E; (3) între zborurile IFR și zborurile VFR desfășurate în spațiile aeriene de clasa C; (4) între zborurile IFR și zborurile VFR speciale; (5) între zborurile VFR speciale, cu excepția cazului în care autoritatea competentă dispune altceva; însă, la cererea pilotului unei aeronave și cu acordul pilotului celeilalte aeronave și dacă autoritatea competentă dispune astfel pentru situațiile indicate la litera (b) de mai sus în spațiile aeriene de clasa D și E, zborul poate obține o autorizare sub rezerva asigurării eșalonării proprii pe o anumită porțiune a zborului sub 3050 m (10000 ft) în timpul urcării sau coborârii, pe timp de zi, în condiții meteorologice de zbor la vedere. CAPITOLUL 3 Punctul SERA.8015 din Regulamentul de punere în aplicare (UE) nr. 923/2012 prevede (cu adăugarea textului subliniat la standardul OACI din anexa 11 punctul ): (e) Confirmarea prin repetare a autorizărilor și a informațiilor legate de siguranță (1) Echipajul de zbor trebuie să repete controlorului de trafic aerian elementele autorizărilor și instrucțiunilor ATC care sunt legate de siguranță și care sunt transmise prin voce. Următoarele elemente se confirmă întotdeauna prin repetare: (i) (ii) AMDT 342 autorizările ATC de rută; autorizările și instrucțiunile pentru intrarea, aterizarea, decolarea, așteptarea înainte, traversarea, rularea și întoarcerea pe orice pistă; și (iii) pista în serviciu, calajele altimetrice, codurile SSR, canalele de comunicație nou repartizate, instrucțiunile de nivel, instrucțiunile de cap și viteză; și (iv) nivelurile de tranziție, indiferent dacă sunt primite de la controlor sau sunt cuprinse în transmisiunile ATIS. 11 GEN CHAPTER 3 Implementing Regulation (EU) No 923/2012, paragraph SERA.8015(e)(2), specifies (with the addition to ICAO Standard in Annex 11, of the underlined text): (2) Other clearances or instructions, including conditional clearances and taxi instructions, shall be read back or acknowledged in a manner to clearly indicate that they have been understood and will be complied with. CHAPTER 3 New provision. Implementing Regulation (EU) No 923/2012, paragraph SERA.5010, specifies: SERA.5010 Special VFR in control zones Special VFR flights may be authorised to operate within a control zone, subject to an ATC clearance. Except when permitted by the competent authority for helicopters in special cases such as medical flights, search and rescue operations and firefighting, the following additional conditions shall be applied: (a) by the pilot: (1) clear of cloud and with the surface in sight; (2) the flight visibility is not less than 1500 m or, for helicopters, not less than 800 m; (3) at speed of 140 kts IAS or less to give adequate opportunity to observe other traffic and any obstacles in time to avoid a collision; and (b) by ATC: (1) during day only, unless otherwise permitted by the competent authority; (2) the ground visibility is not less than 1500 m or, for helicopters, not less than 800 m; (3) the ceiling is not less than 180 m (600 ft). CAPITOLUL 3 Dispoziție nouă. Punctul SERA.5010 din Regulamentul de punere în aplicare (UE) nr. 923/2012 prevede: SERA.5010 Zborurile VFR speciale în zone de control Zborurile VFR speciale pot fi autorizate să se desfășoare într-o zonă de control, sub rezerva obținerii unei autorizări ATC. Cu excepția situațiilor în care sunt autorizate de autoritatea competentă pentru elicoptere în cazuri speciale, cum ar fi zborurile medicale, operațiunile de căutare și salvare și operațiunile de stingere a incendiilor, se aplică următoarele condiții suplimentare: (a) de către pilot: (1) în afara norilor și cu vederea solului; (2) vizibilitatea în zbor nu este mai mică de m sau, pentru elicoptere, mai mică de 800 m; (3) la viteza de 140 de noduri IAS sau mai puțin pentru a oferi posibilitatea de a observa alte aeronave sau orice obstacol la timp pentru a evita coliziunea; și (b) de către ATC: (1) numai pe timpul zilei, cu excepția unei autorizări contrare din partea autorității competente; (2) vizibilitatea la sol nu este mai mică de m sau, pentru elicoptere, mai mică de 800 m; (3) plafonul nu este mai mic de 180 m (600 ft). Other charges 6.1 Airport development charges UNIT RATE: 5.00 EURO / passenger The charge doesn t apply for passengers being in transit, transfer or to children under the age of 2. General 0.1 The charges set forth hereunder in items 1 and 2 are applied to all aircraft using the air navigation facilities and services, as follows: Route air navigation services charge (RANC), for use of the en route air navigation services in the controlled airspace of the charging zone of Romania; Terminal air navigation services charge (TANC), for use of approach and aerodrome control. The charges constitute remuneration for the costs incurred in respect of air navigation facilities and services provided by the N AIR TRAFFIC SERVICES ADMINISTRATION (ROMATSA). The use of these services implies the acceptance by the user of all the conditions mentioned in GEN 4.2 section. 0.2 In the case of take-offs and landings which do not proceed during the operational hours of the airports, as these are set forth in (AD section), the charges from item 2 will be increased with 100%. Exemptions are granted to scheduled domestic flights All charges listed in the items 1 and 2 are subject to VAT value added tax. Services provided for the direct needs of aircraft used by airlines mainly for international transport of persons and/or cargo effected for reward are exempted from VAT. Airspace users that consider they should be exempted should provide to ROMATSA a copy of the Air Operator Certificate plus all annexes, a copy of the company s Certificate of Registration as a tax payer for VAT and any other relevant documents. 1. Route air navigation services charge (RANC) 1.1 General Pursuant to the provisions of Law 44/1996, Romania acceded to the International Convention for the Safety of Air Navigation and to the Multilateral Agreement Relating to Route Charges Establishing and collection of charges for route air navigation services is entrusted to EUROCONTROL and is governed by the rules instituted in the document Conditions of Application of the Route Charges System and Conditions of Payment published in Art In order to avoid errors in the calculation of charges and penalties, users will strictly comply with the instructions for completion of the flight plan form of the International Civil Aviation Organisation (ICAO), as described in Annex 2 of ICAO document 4444-RAC/501 and with the provisions of the GEN 4.2 section. 1.2 Unit rate and interest The global unit rate for the route air navigation services in the charging zone of Romania is euro The unit rate is subject to monthly recalculation with the exchange rate between the euro and the national currency (see GEN 4.2-3, Article 7, point 2) The rate of interest on late payment of Route Charges is 10.30% per annum. 1.3 Conditions of application of the route charges system and conditions of payment ARTICLE 1 1. A charge shall be levied for each flight performed under Instrument Flight Rules by an aircraft in accordance with the procedures laid down in application of the Standards and Recommended Practices of the International Civil Aviation Organisation in the airspace of the Flight Information Regions listed in ANNEX 1 (see pag. GEN 4.2-4), falling within the competence under the responsability of the Contracting States. Furthermore, in the Flight Information Regions which fall within its competence, a Contracting State may decide that a charge be levied on any flight conducted in accordance with the visual flight rules (VFR flight). Flights conducted partly in accordance with the visual flight rules and partly in accordance with the instrument flight rules (mixed VFR/IFR flights) in the Flight Information Regions falling within the competence of a given Contracting State are subject, for the entire distance flown within the said Flight Information Regions, to charges levied in that State for IFR flights. For route charge purposes, this airspace shall be divided into en route charging zones, as defined by the Contracting States and listed in Annex The charge shall constitute remuneration for the costs incurred by Contracting States in respect of en route air navigation facilities and services and the operation of the Route Charges System, and for the costs incurred by EUROCONTROL in operating the System.
