2 Introduc on The FAA considers landfills a hazardous wildlife a ractant Repor ng, studies, documenta on and sta s cs clearly show aircra collisions with birds and other wildlife are a serious economic and public safety concern Wildlife- aircra strikes Loss of hundreds of lives worldwide Billions of dollars in aircra damage The FAA provides procedures and condi ons to ensure compa bility of landfills with safe airport opera ons (FAA Advisory Circular 150/ B) 3 Wildlife Strikes 4 2

3 FAA Guidelines Under most circumstances Public Law prohibits new MSWLF construc on within 6 miles of certain airports Law does not apply to expansion, either ver cal or horizontal of exis ng landfills FAA provides separa on criteria for landfill si ng based on: 78 percent of strikes occur under 1,000 feet above ground level 90 percent of strikes occur under 3,000 feet above ground level 5 FAA General Separa on Criteria FAA Advisory Circular 150/ B provides recommenda ons for Landfill/Airport Separa on distances Airports serving piston- powered aircra FAA recommends minimum separa on distance of 5,000 feet Airports serving turbine- powered aircra FAA recommends minimum separa on distance of 10,000 feet Protec on of approach, departure and circling airspace FAA recommends minimum separa on distance of 5 miles between farthest edge of airport s airspace opera on area and landfill property boundary 6 3

4 New Mexico Solid Waste Rules The applica on shall provide proof the applicant has no fied the federal avia on administra on and the affected airport if the facility is to be located within six miles of an airport used by the public and that the federal avia on administra on does not object to the site being operated as a solid waste facility. No landfill shall be located within the distance to airports set by the federal avia on administra on unless the landfill owner or operator demonstrates that the federal avia on administra on does not object to construc on and opera on of the landfill at the proposed site 8 of 25 permi ed landfills in New Mexico are within 6 miles of an airport 7 FAA No fica on Construc on/modifica on of landfills requires FAA no fica on Owners must complete FAA Form , No ce of Proposed Construc on or Altera on Loca on La tude Longitude Height File electronically on FAA s Obstruc on Evalua on /Airport Airspace Analysis (OE/AAA) website FAA to provide confirma on that landfill loca on has no poten al to a ract hazardous wildlife on or near public- use airport 8 4

6 Old Vs New Regula ons Previous Solid Waste Rules only required FAA and airport no fica on for landfills within 5 miles of an airport Permit renewal had to comply with current Solid Waste Rules for landfills within 6 miles of an airport 11 Process to Determine Compliance with FAA Proposed landfill modifica ons were mailed to FAA in October 2010 no response Proposed modifica ons were resubmi ed through the FAA s online Obstruc on Evalua on/airport Airspace Analysis (OE/ AAA) Determina on of No Hazard to Air Naviga on received in May 2011 Addi onal determina on needed by FAA for compa bility with safe airport opera ons as a hazardous wildlife a ract Completed April
