1 181 Ellicott Street Buffalo, New York Fax: TDD: Re: Notice of Air Carrier Consultation Meeting for PFC Application Niagara Falls International Airport (NFIA/IAG) To Whom It May Concern: This letter constitutes written notice to the carriers at Niagara Falls International Airport (NFIA) that the Niagara Frontier Transportation Authority (NFTA) intends to submit its first PFC application to the Federal Aviation Administration (FAA) to obtain approval to use Passenger Facility Charges (PFC) for projects at NFIA. Pursuant to Section (b) of 14 CFR Part 158, NFTA is notifying air carriers that have a significant business interest at NFIA. The distribution list for this notice is included as Attachment A. This notice includes the following: 1. Project descriptions pursuant to Section (a)(1) 2. PFC level pursuant to Section (a)(2) 3. Air carriers not required to collect the PFC pursuant to Section (a)(3) 4. Date and location of air carrier consultation meeting pursuant to Section (a)(4) PROJECT DESCRIPTIONS NFTA is seeking approval to impose and use PFC revenues on a pay as you go basis for nine projects. NFTA requests reimbursement of a portion of the local matching share of previously awarded AIP grants for six of the projects and is seeking full funding from PFCs for the remaining three projects (Snow Removal Equipment, Runway 28R Visual Aid PAPI Improvement, and PFC Planning and Program Administration). The following discussion summarizes all nine projects. 2 2 Master Plan Update Ongoing 13,776 Runway 28R Visual Aid PAPI Improvement Complete 84,665 PFC Planning and Program Administration Ongoing 30,000 $ 1,237,244 Snow Removal Equipment This project includes the purchase of the following: snow blower; snow plow; spreader; and a snow melter. The equipment will be used on airport to clear snow from the airport operations area, which is necessary for the ongoing operation of NFIA. The snow blower and snow plow equipment will replace NFIA s existing snow blower and snow plow which have exceeded their useful lives and parts are no longer available. The spreader and snow melter will be supplemental to the existing snow removal equipment inventory. NFIA s full inventory of existing snow removal equipment can be found in NFIA s approved Snow and Ice Control Plan. Conduct Environmental Study NFTA is seeking reimbursement for a portion of the costs associated with a Short Environmental Assessment for removal of obstructions to existing Runway 6 24 and 10L 28R at NFIA. This project also included the following supporting tasks: physical tree identification, wetland delineation, conceptual design (up to 30 percent), agency coordination, and state environmental quality review. This project is complete and NFTA is seeking to reimburse a portion of the local matching share of a previously awarded AIP grant. Land Acquisition within RPZ This project acquired approximately 70 acres of vacant property located within the approach to Runway 10L, with a portion of the property located within the Runway 10L Runway Protection Zone at NFIA. The property is located adjacent to NFIA on the east side of Young Street, north of Porter Road and a contiguous parcel on the south side of Packard Road in the Town of Niagara. Costs include the purchase price, cost of the title, and administrative and consulting fees. This project is complete and NFTA is seeking to reimburse a portion of the local matching share of a previously awarded AIP grant. Runway Distance Markers FYE 08 This project included design, construction, inspection, and administrative services associated with the relocation of runway distance remaining signs on Runway 10L 28R at NFIA. This project provided for the removal of the zero feet distance remaining sign and relocation of the nine other runway distance remaining signs, foundations, and associated wiring. The runway distance remaining signs were relocated to accurately present runway surface distances available to aircraft using the runway and accommodate a 400 foot aircraft turn around/runway extension on the 10L (West) end of the main runway. The signs

3 3 promote safety of aircraft by providing essential reference information to pilots during taxiing, take off, and landing operations. This project is complete, and NFTA is seeking to reimburse a portion of the local matching share of a previously awarded AIP grant. Part 77 Obstruction Removal Phase II This project included identification, mitigation, and inspection of airfield obstructions penetrating the Part 77 airspace in specific air operations areas at NFIA. Certain trees and brush located on property areas owned or controlled by the NFTA, the Niagara County Industrial Development Agency (NCIDA), and the U.S. government were considered obstructions to both aircraft safety and the Air Traffic Control Towers line of sight to active aircraft operation areas. Mitigation of these obstructions was accomplished through removal of shrubbery and reduction of the height of trees and other obstructions at NFIA. This project is complete and NFTA is seeking to reimburse a portion of the local matching share of previously awarded AIP grants. Work associated with this project falls under AIP grants and and does not overlap with Phase I of the Part 77 Obstruction Removal. Phase I involved acquiring easements and is associated with AIP grant Gate 3 Walkway & Passenger Boarding Bridge This project furnished, installed, and commissioned a second Passenger Board Bridge (PBB) at NFIA. The new PBB is a refurbished, ADA compliant PBB with a connecting fixed link (walkway) to the passenger terminal. The project included a preconditioned air unit, a ground power unit, and potable water service. The installation included delivery of the refurbished equipment, construction of all foundations, infrastructure, utilities, and related work required for installation and commissioning of the PBB and walkway. The increase in airline activity at the NFIA resulted in simultaneous arrivals and departures of aircraft that warranted installation of a second PBB. The second PBB provides safety, security, and comfort for passengers using the terminal, and improves passenger service at NFIA. The refurbished PBB is anticipated to provide years of service. This project is complete and NFTA is seeking to reimburse a portion of the local matching share of a previously awarded AIP grant. Master Plan Update NFTA is seeking reimbursement for a portion of the costs related to the preparation of a Master Plan Update for NFIA. This project, which is currently in process, will result in a blueprint for the airport s long term development. Runway 28R Visual Aid PAPI Improvement This project consisted of the design and installation of a Precision Approach Path Indicator (PAPI) System on Runway 28R at NFIA. A PAPI system consists of four light units located left of the runway edge and perpendicular to the runway centerline. The series of light units, when properly orientated, furnish pilots with visual approach slope information to provide aircraft descent guidance to the optimum touchdown point on the runway. The project also included the installation of the electrical feed, conduit and cable trenching, connection to permanent power supply, and installation of concrete bases. Spirit and Allegiant airlines had requested that airport operations provide this landing visual aid which improves aircraft safety at NFIA.

4 4 PFC Planning and Program Administration The NFTA is seeking the reimbursement of fees for consulting services related to the preparation of the current PFC application and the administration, management, and tracking of the NFIA PFC program by NFTA staff. Tasks associated with this project include: Collection and organization of PFC project documentation Drafting of the PFC meeting notice letter Preparation of airline and public consultation documents Participation in preliminary meetings and air carrier consultation Preparation of draft and final PFC applications Coordination with FAA staff Management oversight over PFC project implementation PFC program reporting and compliance PFC LEVEL, PROPOSED CHARGE EFFECTIVE DATE, ESTIMATED CHARGE EXPIRATION DATE, AND TOTAL PFC REVENUE PFC Level: Effective Date: July 1, 2017 Expiration Date: February 1, 2020 NFTA proposes to impose the PFC at the $4.50 level. Total PFC Revenue: This application requests imposition and use of $1,237,244 in PFC funds. AIR CARRIERS NOT REQUIRED TO COLLECT THE PFC NFTA intends to exclude from the requirements to collect PFCs the class of carriers titled Air Taxi/Commercial Operators (ATCO) who file Form The ATCO carriers listed below served NFIA in calendar year 2015: Aero Jet Services LLC Reliant Air Charter, Inc. The number of passengers enplaned by this class of carriers in calendar year 2015 was 8 representing less than one percent of total annual enplanements at NFIA. NFTA also intends to exclude from PFC collection requirements those airlines which had no scheduled enplanements at NFIA in calendar year 2015 and which had unscheduled enplanements that represented less than one percent of total enplanements at NFIA in calendar year The only airline in this category in calendar year 2015 was Blue Jet Sp from the Foreign Air Carriers (FAC) class with 3 enplanements.
