2 INTRODUCTION AND NUMBERING This Volume dedicated to the Licensing Procedures, is developed by the San Marino CAA for the use of both the Civil Aviation Inspectors and the Civil Aviation users in San Marino and contains all the relevant Forms. 7 GENERAL 1. Purpose 1.1 This order is referred to Licensing Procedures and details the forms associated to the Personnel Licensing Handbook, that an applicant has to fill regarding the issuing, renewing, reissuing of ground licence with the associated rating, flight licence with associated ratings and particular licence and certificate in conformity with the San Marino Civil Aviation Regulations (SM CAR PL). 1.2 All persons having to send any official document by any way must follow the procedures according the conformity to the San Marino Civil Aviation Regulations. The objective is to insure the tracks and the proper followed of any requirement. 1.3 This procedure, implemented by the Licensing Department of San Marino Civil Aviation Authority, will be used for any transmission by postal way, electronic device (telefax, and direct manual deposit. 2. Field of application 2.1 All documents contended in the relevant SM CAR PL must be reported following to the Personnel Licensing procedures, 2.2 All people wishing to receive a safe, efficient and rapid answer may follow also the Personnel Licensing procedures. 3. References SM.CAA regulations CAR PL series. ICAO Recommendations in relative Annexes 4. Applicable rules 4.1 The relevant SM CAA Regulations are basically the documents to follow. The procedures detailed in Personnel Licensing Handbook are only the explanation of the relevant Personnel Licensing SM CAP (CAP PL series). 4.2 Each personal and official of SM CAA must be aware that precise delay is committing the responsibility of SM CAA and must be respected every time. Any non-complying due to unforeseen reason must be reported without delay and notified to the applicant. Issue 1 7/52

Application of the procedures SM CAP PL 01 (G) Gliders Operations 5.1 All documents must be enclosed with an applicant form (if defined and existing) or a shipping letter annotated with all inside details, 5.2 The shipment must be addressed to the Director of SM CAA without specifying particular name, 5.3 Whatever means of shipment issued (mail, hand, fax, , etc. ) for a document, it must be taken in charge by the person responsible for the mail register, 5.4 In case of direct delivery to any official SM CAA person, this person must transmit without delay all documents concerning entering mail to registering person. If he has no possibility to do it without delay he must refuse to take in charge any document, 5.5 A register is dedicated to the entering mail. It is an official register, where the date, the applicant s name and subject are written thanks to a registered list of number. The corresponding number is transcribed on the applicant form or shipping letter, 5.6 After this registration, all parts of the total document are transmitted internally to the appropriate personal for application, 5.7 In this case, the date taken into account in the process of delivery of final document is the entering registration date, 5.8 If required, an acknowledgement may be delivered to the applicant, by the person responsible for the mail register, justifying the date and registering number. 6. Forms This SM CAP contains all the necessary forms related to SM CAR PL 01 concerning Pilot Licensing The following forms are applicable to the procedures described in the volume of the Personnel Licensing Inspector Handbook. 9 SUBPART 1 GENERAL SM CAP PL 01 (G) Applicability and definitions (1) This SM CAP PL 01 (G) prescribes: (c) The requirements for issuing a glider pilot licence and a glider instructor rating; the conditions under which those licences and ratings are necessary; and the privileges and limitations of those licences and ratings. The requirements for issuing a glider pilot licence and glider instructor rating for persons who have taken courses approved by the Director of the San Marino CAA under other SM-CARs and associated CAPs. Operational procedures not included in this SM CAP PL 01 (G) are published by the San Marino Aero-Club after approval by the SMR CAA. (2) Definitions: Aeronautical experience : glider pilot flight time obtained in a glider for meeting the appropriate training and flight time requirements for a glider pilot licence or recency of flight experience requirements of this SM CAP PL 01 (G). Authorised instructor : Cross-country time : (i) A person who holds a current glider instructor rating issued under this SM- CAP when conducting ground training or flight training in accordance with the privileges and limitations of his or her glider instructor rating; or (ii) A person authorised by the Director of the San Marino CAA to provide glider flight training under this SM-CAP. In general and except as provided in sub-regulations (3) (i), (ii), (iii), of this section, time acquired during a flight: (i) conducted by a person who holds a glider pilot licence; (ii) conducted in a glider; (iii) that includes a landing at a point other than the point of departure; and (iv) that involves the use of dead reckoning, pilotage, and navigation systems to navigate to the landing point. For the purpose of meeting the aeronautical experience requirements for a pilot licence, time acquired during a flight: (i) conducted in an appropriate glider; (ii) that includes a point of landing that was at least a straight-line distance of more than 50 kilometres from the original point of departure; and (iii) that involves the use of dead reckoning, pilotage, and navigation systems to navigate to the landing point. Examiner : any person who is authorised by the Director of the San Marino CAA to conduct a glider pilot proficiency test or a practical test for a pilot licence issued under this SM Issue 1 9/52

10 CAP PL 01 (G), or a person who is authorised to conduct a knowledge test under this SM CAP PL 01 (G). Flight training : that training, other than ground training, received from an authorised instructor in flight in a glider. Ground training : that training, other than flight training, received from an authorised instructor. Instrument training : that time in which instrument training is received from an authorised instructor under actual instrument conditions. Knowledge test : a test on the aeronautical knowledge areas required for a glider pilot licence or rating that can be administered in written form or by a computer. Glider s Pilot time : that time in which a person: (c) Serves as a glider s pilot; Receives training from an authorised instructor in a glider; or Gives training as an authorised instructor in a glider. Practical test : a test on the areas of operations for a glider pilot licence, rating, or authorisation that is conducted by having the applicant respond to questions and demonstrate manoeuvres in flight. Training time : training received: In flight from an authorised instructor; On the ground from an authorised instructor. SM CAP PL 01 (G) Certification of foreign pilots and flight instructors (1) Except as provided for in paragraph (2) of this section, a glider pilot licence issued under this SM CAP PL 01 (G) (other than under section SM CAP PL 01 (G)-02.03) may not be issued to a person who is not a citizen of the Republic of San Marino or a resident alien of the Republic of San Marino unless that person passes the appropriate practical test within the Republic of San Marino. (2) A person who is not a citizen of the Republic of San Marino or a resident alien of the Republic of San Marino may be issued a glider pilot licence, and the practical test for that licence may be administered outside the Republic of San Marino when: (c) the Director of the San Marino CAA determines the person needs a glider pilot licence to operate as a required pilot of a civil aircraft of the Republic of San Marino registry; the Director of the San Marino CAA determines the person needs a glider flight instructor rating to train persons who are citizens of the Republic of San Marino; the certificate is for an addition of a category, class, instrument, or type rating onto an existing the Republic of San Marino glider pilot licence, provided the licence is not one that was issued on the basis of a foreign pilot licence; Issue 1 10/52

11 (d) the licence is for an addition, renewal, or reinstatement of a category, class, or instrument rating onto an existing Republic of San Marino glider flight instructor rating. (3) Certified training centres and their satellite training centres may outside the Republic of San Marino: prepare and recommend the Republic of San Marino citizen applicants for glider pilot licences, and issue licences to the Republic of San Marino citizens within the authority granted to that training centre by the Director of the San Marino CAA. SM CAP PL 01 (G) Requirement for licences, ratings, and authorizations (1) Glider Pilot licence. A person may not act as a glider pilot of a civil glider of the Republic of San Marino registry, unless that person has a valid glider pilot licence or special purpose pilot authorisation issued under this SM CAP PL 01 (G) in that person's physical possession or readily accessible, when exercising the privileges of that glider pilot licence or authorisation. (2) Required glider pilot licence for operating a foreign-registered glider. A person may not act as pilot of a civil glider of foreign registry within the Republic of San Marino, unless that person's pilot licence: is valid and in that person's physical possession, or readily accessible when exercising the privileges of that glider pilot licence; and has been issued under this SM CAP PL 01 (G), or has been issued or validated by the country in which the glider is registered. (3) Medical certificate. The student or glider pilot licence owner shall hold a Class 1 or a Class 2 medical certificate. Validity : (i) Student or qualified glider pilot less than 40 years of age : 60 months (ii) Student or qualified glider pilot 40 years old and less than 50 years of age : 24 months (iii) Student or qualified glider pilot is 50 years of age or more : 12 months (4) Glider flight instructor rating: a person who holds a glider flight instructor rating issued under this SM CAP PL 01 (G) must have that certificate, or other documentation acceptable to the Director of the San Marino CAA, in that person's physical possession or readily accessible when exercising the privileges of that glider flight instructor rating. no person other than the holder of a glider flight instructor rating issued under this SM CAP PL 01 (G) may: Issue 1 11/52

12 (i) give training required to qualify a person for solo flight and solo cross-country flight; (ii) endorse an applicant for a: Glider Pilot licence or rating issued under this SM CAP PL 01 (G); Glider Flight instructor rating issued under this SM CAP PL 01 (G); (iii) endorse a glider pilot logbook to show training given; or (iv) endorse a student pilot licence and logbook for solo operating privileges. (5) Inspection of licence: Each person who holds a glider pilot licence or flight instructor rating, authorisation, or license required by this SM CAP PL 01 (G) must present it for inspection upon a request from: (c) the Director of the San Marino CAA; an authorised representative of the Aircraft Accident Investigation Office; or any National law enforcement officer. SM CAP PL 01 (G) Licences and ratings issued under this SM CAP PL01(G) (1) The following licences and certificates are issued under this SM CAP PL 01 (G) to an applicant who satisfactorily accomplishes the training and certification requirements for the licence or certificate sought: Pilot licences: (i) Student pilot; (ii) Glider Pilot. (2) The following rating is placed on a glider pilot licence (other than student pilot) when an applicant satisfactorily accomplishes the training and certification requirements: class ratings special ratings (Glider pilot): (i) Aerobatics (ii) Aero-towing (iii) Winch launching (iv) Motorglider (c) Glider Flight instructor rating. 13 SM CAP PL 01 (G) Exercise of privileges of glider pilot licence. (1) No person who holds an glider pilot licence or rating should exercise the privileges of that pilot licence or rating if the conditions defined in SM CAP 01(G) are not satisfied and associated medical certificates is no longer valid. SM CAP PL 01 (G) Issuance of glider pilot licences, ratings, and authorizations (1) An applicant for a Glider Pilot licence, rating, or authorisation under this SM CAP PL 01 (G) must make that application on a form and in a manner acceptable to the Director of the San Marino CAA. (2) An applicant who is neither a citizen of the Republic of San Marino nor a resident alien of the Republic of San Marino: Must show evidence that the appropriate fee prescribed by San Marino CAA regulations has been paid when that person applies for a: (i) Student glider pilot licence that is issued outside the Republic of San Marino; or (ii) Knowledge test or practical test for a Glider Pilot licence or rating issued under this SM CAP PL 01 (G), if the test is administered outside the Republic of San Marino. May be refused issuance of any the Republic of San Marino Glider Pilot licence, rating, or authorisation by the Director of the San Marino CAA. (3) Except as provided in paragraph (2) of this section, an applicant who satisfactorily accomplishes the training and certification requirements for the licence, rating, or authorisation sought is entitled to receive that Glider Pilot licence, rating, or authorisation. SM CAP PL 01 (G) Offences involving alcohol or drugs Each aeronautical person must comply with the national laws and specially the regulations defined in the relevant SM CAR. SM CAP PL 01 (G) Refusal to submit to an alcohol test or to furnish test results Each aeronautical person must comply with the national laws and specially the regulations defined in the relevant SM CAR. SM CAP PL 01 (G) Duration of glider pilot licence and glider flight instructor rating (1) The holder of a licence or certificate with an expiration date may not, after that date, exercise the privileges of that licence or certificate. (2) Student Glider Pilot licence. A student pilot licence expires 24 calendar months from the month in which it is issued. Issue 1 13/52

14 (3) Glider Pilot licences. A pilot licence (other than a student pilot licence) issued under this SM CAP PL 01 (G) have an unlimited validity, however, the holder should comply with the content of SM CAP PL 01(G) and SM CAP PL 01 (G) (4) The holder of a validation of a foreign Glider Pilot license may exercise the privileges of that licence only for as long as that person's foreign pilot license is effective. (5) Glider Flight instructor rating. A flight instructor rating is effective only while the holder has a current Glider Pilot licence; (6) Surrender, suspension, or revocation. Any licence issued under this SM CAP PL 01 (G) ceases to be effective if it is surrendered, suspended, or revoked. (7) Return of licences. The holder of any licence issued under this SM CAP PL 01 (G) that has been suspended or revoked must return that licence to the San Marino CAA when requested to do so by the Director of the San Marino CAA. SM CAP PL 01 (G) Replacement of a lost or destroyed glider pilot licence or glider flight instructor rating or knowledge test report (1) A request for the replacement of a lost or destroyed Glider Pilot licence or Glider Flight instructor rating issued under this SM CAP PL 01 (G) must be made by letter to the San Marino CAA, and must be accompanied by a check or money order for the appropriate fees as prescribed in San Marino regulations. (2) A request for the replacement of a lost or destroyed knowledge test report must be made by letter to the San Marino CAA, and must be accompanied by a check or money order for the appropriate fees as prescribed in San Marino regulations. (3) The letter requesting replacement of a lost or destroyed Glider Pilot or Glider Flight Instructor ratings, or knowledge test report must state: the name of the person; the permanent mailing address (including Postal Code), or if the permanent mailing address includes a post office box number, then the person's current residential address; (c) (d) (e) any Personal Identification Document number; the date and place of birth of the licence or certificate holder; and any available information regarding the: (i) number, and date of issuance of the licence, and (ii) date the knowledge test was taken, if applicable. (4) A person who has lost a Glider Pilot licence or Glider Flight Instructor rating, or knowledge test report may obtain a facsimile from the San Marino CAA, confirming that it was issued and the: Issue 1 14/52

15 facsimile may be carried as a Glider Pilot licence or Glider Flight instructor rating, or knowledge test report, as appropriate, for up to 60 days pending the person's receipt of a duplicate under paragraph (1), or (2), of this section, unless the person has been notified that the licence / certificate has been suspended or revoked. (5) Request for such a facsimile must include the date on which a duplicate licence / certificate or knowledge test report was previously requested. SM CAP PL 01 (G) special type ratings requirements Additional training required for operating a glider. (1) No person may act as pilot in command of a glider: using auto-tow launching procedures, unless that person has satisfactorily accomplished ground and flight training on ground-tow procedures and operations, and has received an endorsement from an authorised instructor who certifies in that glider pilot's logbook that the pilot has been found proficient in ground-tow procedures and operations; or (c) using areo-towing procedures, unless that person has satisfactorily accomplished ground and flight training on aero-towing procedures and operations, and has received an endorsement from an authorised instructor who certifies in that pilot's logbook that the pilot has been found proficient in aero-towing procedures and operations; or using winch launching or self-launching procedures, unless that person has satisfactorily accomplished ground and flight training on self-launch procedures and operations, and has received an endorsement from an authorised instructor who certifies in that pilot's logbook that the pilot has been found proficient in winch launching or self-launching procedures and operations. (2) The holder of a glider pilot or glider flight instructor rating, is considered to be in compliance with the training and logbook endorsement requirements of this paragraph for the specific operating privilege for which the holder is already qualified. SM CAP PL 01 (G) Tests : general procedure (1) Tests prescribed by or under this SM CAP PL 01 (G) are given at times and places, and by persons designated by the Director of the San Marino CAA. SM CAP PL 01 (G) Knowledge test : prerequisites and passing grades (1) An applicant for a knowledge test must have: received an endorsement, as required by this SM CAP PL 01 (G), from an authorised instructor certifying that the applicant accomplished the appropriate ground-training or a home-study course required by this SM CAP PL 01 (G) for the licence or rating sought and is prepared for the knowledge test; and proper identification at the time of application that contains the applicant's: Issue 1 15/52

16 (i) photograph; (ii) signature; (iii) date of birth, which shows the applicant meets or will meet the age requirements of this SM CAP PL 01 (G) for the licence sought before the expiration date of the glider pilot or glider flight instructor knowledge test report; and (iv) actual residential address, if different from the applicant's mailing address. (2) The Director of the San Marino CAA shall specify the minimum passing grade for the knowledge test. SM CAP PL 01 (G) Prerequisites for practical tests (1) Except as provided in paragraphs (2) and (3) of this section, to be eligible for a practical test for a licence or rating issued under this SM CAP PL 01 (G), an applicant must: (c) pass the required knowledge test within the 24-calendar-month period preceding the month the applicant completes the practical test, if a knowledge test is required; present the knowledge test report at the time of application for the practical test, if a knowledge test is required; have satisfactorily accomplished the required training and obtained the aeronautical experience prescribed by this SM CAP PL 01 (G) for the licence or rating sought; (2) An applicant for glider practical test is required to have a medical certificate issued under SM-CAR PL 03; (3) Meet the prescribed age requirement of this SM CAP PL 01 (G) for the issuance of the licence or rating sought; (4) Have an endorsement, as required by this SM CAP PL 01 (G), in the applicant's logbook or training record that has been signed by an authorised instructor who certifies that the applicant: (c) has received and logged training time within 60 days preceding the date of application in preparation for the practical test; is prepared for the required practical test; and has demonstrated satisfactory knowledge of the subject areas in which the applicant was deficient on the airman knowledge test. (5) Have a completed and signed application form. (6) A person is not required to comply with the provisions of paragraph (4) of this section if that person: holds a foreign-glider pilot license issued by a Contracting State to the Convention on International Civil Aviation that authorises at least the glider pilot privileges of the licence sought; Issue 1 16/52

17 (7) If all increments of the practical test for a licence or rating are not completed on one date, all remaining increments of the test must be satisfactorily completed not more than 60 calendar days after the date on which the applicant began the test. (8) If all increments of the practical test for a licence or a rating are not satisfactorily completed within 60 calendar days after the date on which the applicant began the test, the applicant must retake the entire practical test, including those increments satisfactorily completed. SM CAP PL 01 (G) Practical tests : general procedures (1) The ability of an applicant for a licence or rating issued under this SM CAP PL 01 (G) to perform the required tasks on the practical test is based on that applicant's ability to safely: (c) perform the tasks specified in the areas of operation for the licence or rating sought within the approved standards; demonstrate mastery of the aircraft with the successful outcome of each task performed never seriously in doubt; demonstrate satisfactory proficiency and competency within the approved standards; and (d) demonstrate sound judgement.. (2) If an applicant fails any area of operation, that applicant fails the practical test. (3) An applicant is not eligible for a licence or rating sought until all the areas of operation are passed. (4) The examiner or the applicant may discontinue a practical test at any time: when the applicant fails one or more of the areas of operation. (5) If a practical test is discontinued, the applicant is entitled credit for those areas of operation that were passed, but only if the applicant: passes the remainder of the practical test within the 60-day period after the date the practical test was discontinued; presents to the examiner for the retest the original notice of disapproval form or the letter of discontinuance form, as appropriate; (c) satisfactorily accomplishes any additional training needed and obtains the appropriate instructor endorsements, if additional training is required; and (d) presents to the examiner for the retest a properly completed and signed application. 18 SM CAP PL 01 (G) Practical tests : required glider and equipment (1) An applicant for a licence or rating issued under this SM CAP PL 01 (G) must furnish: A glider of the Republic of San Marino registry for each required test; that: (i) has a current utility airworthiness certificate, or (ii) an aerobatics category airworthiness certificate, or (iii) both, utility and aerobatics category airworthiness certificate, or (iv) depending on the launching methods for which certification is requested, the glider must be fitted with one or more launching hooks; (v) a glider of any of the categories mentioned in subparagraphs (i), (ii), (iii) and (iv), of foreign registry that is properly certified by the country of registry. (2) Required equipment (other than controls): Except as provided in paragraph of this section, a glider used for a practical test must have: (i) Aero-towing hook and release handle; or (ii) Winch towing self-release hook; or (iii) Auto towing self-release hook; (iv) ATC airborne equipment, if required; (v) Oxygen equipment and supply, if required; (c) (d) Except as provided in paragraph (d) of this section, two pilot stations for each person to operate the glider safely; and Required controls. A glider used for a practical test must have flight and towing controls that are easily reached and operable in a conventional manner by both pilots, unless the examiner determines that the practical test can be conducted safely in a glider without the controls being duplicated. Glider with single controls. A practical test may be conducted in a glider having a single set of controls, provided the: (i) Examiner agrees to conduct the test; and (ii) Proficiency of the applicant can be observed by the examiner who is in a position to observe the performance of the applicant. SM CAP PL 01 (G) Status of an examiner who is authorized by the Director of the San Marino CAA to conduct practical tests (1) An examiner represents the Director of the San Marino CAA for the purpose of conducting practical tests for licences and ratings issued under this SM CAP PL 01 (G) and to observe an applicant's ability to perform the areas of operation on the practical test. 19 SM CAP PL 01 (G) Retesting after failure (1) An applicant for a knowledge or practical test who fails that test may reapply for the test only after the applicant has received: the necessary training from an authorised glider instructor who has determined that the applicant is proficient to pass the test; and an endorsement from an authorised glider instructor who gave the applicant the additional training. (2) An applicant for a glider flight instructor rating with an aeroplane category rating or, for a flight instructor rating with a glider category rating, who has failed the practical test due to deficiencies in instructional proficiency on stall awareness, spin entry, spins, or spin recovery, must: (c) comply with the requirements of paragraph (1) of this section before being retested; bring a glider to the retest that is of the appropriate glider category for the rating sought and is certified for spins; and demonstrate satisfactory instructional proficiency on stall awareness, spin entry, spins, and spin recovery to an examiner during the retest. SM CAP PL 01 (G) Prohibition on operations during medical deficiency (1) No person shall act as a glider pilot or glider flight instructor, while that person knows or has reason to know of any medical condition that would make the person unable to operate the glider in a safe manner. (2) No person shall act as a pilot-in-command of an aeroplane towing a glider, while that person knows or has reason to know of any medical condition that would make the person unable to tow the glider in a safe manner. SM CAP PL 01 (G) Recent flight experience: glider pilot in command (1) No person shall exercise the privileges of his glider pilot licence unless he/she : Has, within the last 12 months, flown solo 5 hours or 10 launches; (2) If (1) above is not satisfied : Has received the recommendation of a qualified instructor who will decide the conduct or not of a check flight. This recommendation should be notified on the logbook of the glider pilot licence holder by the qualified instructor. Issue 1 19/52

20 SM CAP PL 01 (G) Falsification, reproduction, or alteration of applications, licences, logbooks, reports, or records (1) No person may make or cause to be made: (c) Any fraudulent or intentionally false statement on any application for a licence, rating, authorisation, or duplicate thereof, issued under this SM CAP PL 01 (G); Any fraudulent or intentionally false entry in any logbook, record, or report that is required to be kept, made, or used to show compliance with any requirement for the issuance or exercise of the privileges of any licence, rating, or authorisation under this SM CAP PL 01 (G); Any reproduction for fraudulent purpose of any licence, rating, or authorisation, under this SM CAP PL 01 (G); or (d) Any alteration of any licence, rating, or authorisation under this SM CAP PL 01 (G). (2) The commission of an act prohibited under paragraph of this section is a basis for suspending or revoking any airman licence, rating, or authorisation held by that person. Issue 1 20/52

21 SUBPART 2 GLIDERS RATINGS AND PILOT AUTHORIZATIONS SM CAP PL 01 (G) Applicability (1) This subpart prescribes the requirements for the issuance of additional ratings after a pilot licence is issued, and the requirements for and limitations of pilot authorisations issued by the Director of the San Marino CAA. SM CAP PL 01 (G) Glider towing: experience and training requirements (1) No person may act as pilot in command for towing a glider unless that person: (c) Holds at least a private pilot licence (PPL); Has logged at least 100 hours of pilot-in-command time in the aircraft category, class, and type, if required, that the pilot is using to tow a glider; Has a logbook endorsement from an authorised instructor who certifies that the person has received ground and flight training in gliders and is proficient in: (i) The techniques and procedures essential to the safe towing of gliders, including airspeed limitations; (ii) Emergency procedures; (iii) Signals used; and (iv) Maximum angles of bank. (d) (e) (f) Except as provided in paragraph of this section, has logged at least three flights as the sole procedures while accompanied by a pilot who meets the requirements of paragraphs (c) and (d) of this section; manipulator of the controls of an aircraft towing a glider or simulating glider-towing flight Except as provided in paragraph of this section, has received a logbook endorsement from the pilot, described in paragraph (4) of this section, certifying that the person has accomplished at least 3 flights in an aircraft while towing a glider, or while simulating glider-towing flight procedures; and Within the preceding 12 months has: (i) Made at least three actual or simulated glider tows while accompanied by a qualified pilot who meets the requirements of this section; or (ii) Made at least three flights as pilot in command of a glider towed by an aircraft. (2) Any person who, before the initial publication date of the SM CAR PL 01, has made and logged 10 or more flights as pilot in command of an aircraft towing a glider in accordance with a certificate of waiver need not comply with paragraphs (4) and (5) of this section. (3) The pilot, described in paragraph (4) of this section, who endorses the logbook of a person seeking glider-towing privileges must have: Issue 1 21/52

22 Met the requirements of this section prior to endorsing the logbook of the person seeking glider-towing privileges; and Logged at least 10 flights as pilot in command of an aircraft while towing a glider. (4) If the pilot described in paragraph (4) of this section holds only a private pilot licence, then that pilot must have: Logged at least 100 hours of pilot-in-command time In aeroplanes, or 200 hours of pilot-in-command time in a combination of powered and other-than-powered aircraft; and Performed and logged at least three flights within the 12 calendar months preceding the month that pilot accompanies or endorses the logbook of a person seeking glider-towing privileges : (i) In an aircraft while towing a glider accompanied by another pilot who meets the requirements of this section; or (ii) As pilot in command of a glider being towed by an aircraft. SM CAP PL 01 (G) Glider pilot licence issued on the basis of a foreign pilot license (1) General. A person who holds a current foreign glider pilot license issued by a contracting State to the Convention on International Civil Aviation may apply for and be issued validation of that glider glider pilot licence when the application is based on the foreign pilot license that meets the requirements of this section. (2) Validation of license. A glider pilot licence validated under this section shall specify the person's foreign license number and country of issuance. A person who holds a current foreign glider pilot license issued by a Contracting State to the Convention on International Civil Aviation may be issued a validation of that glider pilot licence based on the foreign pilot license without any further showing of proficiency, provided the applicant: Meets the requirements of this section; Holds a foreign pilot license that: (i) Is not under an order of revocation or suspension by the foreign country that issued the foreign pilot license; and (ii) Does not contain an endorsement stating that the applicant has not met all of the standards of ICAO for that licence; (iii) Does not currently hold a the Republic of San Marino pilot licence; (iv) Holds a current medical certificate issued by the country that issued the person's foreign pilot license; and (v) Is able to read, speak, write, and understand the Italian or English language. If the applicant is unable to meet one of these requirements due to medical reasons, then the Director of the San Marino CAA may place such operating limitations on that applicant's pilot licence as are necessary for the safe operation of the aircraft. 23 SUBPART 3 STUDENT GLIDER PILOTS SM CAP PL 01 (G) Applicability (1) This subpart prescribes the requirements for the issuance of student glider pilot licences, the conditions under which those licences are necessary, and the general operating rules and limitations for the holders of those licences. SM CAP PL 01 (G) Eligibility requirements for student glider pilots To be eligible for a student glider pilot licence, an applicant must: (1) Be at least 14 years of age; (2) Be able to read, speak, write, and understand the Italian or English language. Note : If the applicant is unable to meet one of these requirements, then the Director of the San Marino CAA may place such operating limitations on that applicant's glider pilot licence as are necessary for the safe operation of the glider. SM CAP PL 01 (G) Application An application for a student glider pilot licence is made on a form and in a manner provided by the Director of the San Marino CAA and is submitted to: (1) An Aero-Club examiner; or (2) The Civil Aviation Authority Office. SM CAP PL 01 (G) Solo requirements for student glider pilots (1) General. A student glider pilot may not operate a glider in solo flight unless that student has met the requirements of this section. The term "solo flight" as used in this subpart means that flight time during which a student glider pilot is the sole occupant of the glider. (2) Aeronautical knowledge. A student pilot must demonstrate satisfactory aeronautical knowledge on a knowledge test that meets the requirements of this paragraph: the test must address the student pilot's knowledge of: (i) applicable sections of SM-CAR's PL 01 and OPS 0; (ii) Airspace rules and procedures for the airport where the solo flight will be performed; and (iii) flight characteristics and operational limitations for the make and model of glider to be flown. (3) The student's authorised instructor must: Issue 1 23/52

24 administer the test; and at the conclusion of the test, review all incorrect answers with the student before authorising that student to conduct a solo flight. (4) Pre-solo flight training. Prior to conducting a solo flight, a student pilot must have: received and logged flight training for the manoeuvres and procedures of this section that are appropriate to the make and model of glider to be flown; and demonstrated satisfactory proficiency and safety, as judged by an authorised instructor, on the manoeuvres and procedures required by this section in the make and model of glider. (5) Manoeuvres and procedures for pre-solo flight training in a glider. A student pilot who is receiving training for a glider rating must receive and log flight training for the following manoeuvres and procedures: proper flight preparation procedures, including pre-flight planning, preparation, aircraft systems, and, if appropriate, power-plant operations; taxiing or surface operations, including run-ups, if applicable; (c) launches, including normal and crosswind; (d) straight and level flight, and turns in both directions, if applicable; (e) airport traffic patterns, including entry procedures; (f) collision avoidance, windshear avoidance, and wake turbulence avoidance; (g) descents with and without turns using high and low drag configurations; (h) flight at various airspeeds; (i) (j) emergency procedures and equipment malfunctions; ground reference manoeuvres, if applicable; (k) inspection of towline rigging and review of signals and release procedures, if applicable; (l) aero-towing, ground tow, or self-launch procedures; (m) procedures for disassembly and assembly of the glider; (n) stall entry, stall, and stall recovery; (o) straight glides, turns, and spirals; (p) landings, including normal and crosswind; (q) slips to a landing; (r) procedures and techniques for thermalling; and Issue 1 24/52

25 (s) emergency operations, including towline break procedures. (6) Limitations on student pilots operating a glider in solo flight. A student pilot may not operate a glider in solo flight unless that student pilot has received: an endorsement from an authorised instructor on his or her student pilot licence for the specific make and model glider to be flown; and an endorsement in the student's logbook for the specific make and model glider to be flown by an authorised instructor, who gave the training within the 90 days preceding the date of the flight. (7) Limitations on flight instructors authorising solo flight: no instructor may authorise a student pilot to perform a solo flight unless that instructor has: (i) given that student pilot training in the make and model of glider or a similar make and model of glider in which the solo flight is to be flown; (ii) determined the student pilot is proficient in the manoeuvres and procedures prescribed in this section; (iii) determined the student pilot is proficient in the make and model of glider to be flown; (iv) ensured that the student pilot's licence has been endorsed by an instructor authorised to provide flight training for the specific make and model glider to be flown; and (v) endorsed the student pilot's logbook for the specific make and model glider to be flown, and that endorsement remains current for solo flight privileges, provided an authorised instructor updates the student's logbook every 90 days thereafter. (8) The flight training required by this section must be given by an instructor authorised to provide glider flight training who is appropriately rated and current. SM CAP PL 01 (G) General limitations (1) A student pilot may not act as pilot in command of a glider: (c) to carry a passenger; when the flight cannot be made with visual reference to the surface; or in a manner contrary to any limitations placed in the pilot's logbook by an authorised instructor. SM CAP PL 01 (G) Solo cross-country flight requirements (1) No student pilot may operated a glider in solo-cross-country flight, nor may that student, except in an emergency, make a solo flight landing at any airport other than the airport of take-off, unless the student has met the requirements of this section. The term cross-country flight as used in this section means a flight beyond a radius of 25 nautical miles from the point of departure. Issue 1 25/52

26 (2) A student pilot, in addition to the pre-solo flight training manoeuvres and procedures required by section SM CAP PL 01 (G)-03.04, must have received and logged instruction from an authorised flight instructor in the appropriate pilot manoeuvres and procedures of this section. Additionally, a student pilot must have demonstrated an acceptable standard of performance, as judged by the authorised flight instructor certified under this part, who endorses the student's pilot licence in the appropriate pilot manoeuvres and procedures of this section: the use of aeronautical charts for VFR navigation using pilotage and dead reckoning with the aid of a magnetic compass; (c) (d) (e) (f) (g) (h) (i) (j) aircraft cross-country performance, and procurement and analysis of aeronautical weather reports and forecasts, including recognition of critical weather situations and estimating visibility while in flight; cross-country emergency conditions including lost procedures, adverse weather conditions, and simulated precautionary off airport approaches and landing procedures; traffic pattern procedures, including normal area arrival and departure, collision avoidance, right of way, windshear avoidance, and wake turbulence precautions; recognition of operational problems associated with the different terrain features in the geographical area in which the cross-country flight is to be flown; proper operation of the instruments and equipment installed in the aircraft to be flown; landings accomplished without the use of the altimeter from at least 2,000 feet above the surface; recognition of weather conditions and conditions favourable for cross-country soaring; and the use of radios for two-way radio communications; and emergency procedures. (3) No student pilot may operate an aircraft in solo cross-country flight, unless: the authorised glider flight instructor has the student's licence endorsed attesting that the student has received the instruction and demonstrated an acceptable level of competency and proficiency in the manoeuvres and procedures of this section for the category of glider to be flown; and the instructor has endorsed the student's logbook: (i) for each solo cross-country flight, after reviewing the student's pre-flight planning and preparation, attesting that the student is prepared to make the flight safely under the known circumstances and subject to any conditions listed in the logbook by the instructor; and (ii) for repeated specific solo cross-country flights that are not greater than 25 nautical miles from the point of departure, after giving that student flight instruction in both directions over the route, including takeoffs and landings at Issue 1 26/52
