3 Annex Pursuant to Federal Law No.197 -FZ The Labor Code of the Russian Federation of 30 December 2001 (Collected Legislation of the Russian Federation, 2002, No.1 (Part 1), Article 3) I hereby order as follows: To approve the attached Regulations on Specific Features of Crew Work-Rest Regime at Russian Civil Aircrafts. Depending on the scope of post-flight works (performance of the procedures Shutdown / Secure / Post flight exterior inspection, aircraft transfer to another crew) this time is 15 min. is the duration of procedures related to passing preflight medical, customs, border control and execution of flight documentation before takeoff estimated from the moment of a crew member attendance for the flight to the flight time start. is the time estimated from termination of post-flight works after completion of relay flight and to the beginning of the next relay preflight preparation at the airport where the crew change and rest are scheduled. is the time during which a crew member performs his employment functions both on ground and in flight. 6 RFAR 139.I General Provisions 1. Regulations on Specific Features of Crew Work-Rest Regime at Russian Civil Aircrafts (hereinafter - the Regulations) developed pursuant to Article 329 of Federal Law No.197-FZ of 30 December 2001 The Labor Code of the Russian Federation (hereinafter - the RF Labor Code) in order to ensure flight security, fatigue reduction and health maintenance for aircraft crew members. 2. These Regulations shall establish specific features of working and rest hours for aircraft crew members who have valid certificates (licenses) entitling them to perform works on board aircraft as part of a crew including flight schools students and apprentices (hereinafter crew members). 3. The provisions of these Regulations shall be binding for elaboration of Operator s Flight Operation Manual (hereinafter - the FOM), working out crew activities plans and operators flight schedules. a) An aircraft s operator works out regulations to govern regimes of crew work and rest according to the clauses of these Regulations and contains the FOM subject to the views of the labor union elected organ which is a part of all-russian labor union organization and that promotes interests of flight and cabin crew members (hereinafter - employee representatives). 4. Any flight crew member may refuse to further perform his employment duties in case he feels poorly stressed out that may unfavorably affect flight safety as established in the FOM procedures. Page 6

7 RFAR 139.II Working hours 5. Aircraft crew working hours consist of flight duty period, ground working hours between flight duties and a period of transferring as a passenger, as assigned by (on instruction of) the employer. 6. Normal working hours of flight crew member and loadmaster shall not exceed 36:00 a week. a) Normal flight attendant working hours shall not exceed 40:00 a week. b) Maximum crew daily working hours shall not exceed 8:00. The exception is when summarized recording of working hours is applied as stated by clause 7 of these Regulations. 7. In cases where, under the terms of work, no weekly or daily standard working hours can be adhered to, as stated by the clause 6 of these Regulations, crew members shall benefit from summarized recording of hours worked within the reference period of not more than one month. It is allowed to extend the reference period up to a quarter subject to employee representatives view. a) Working hours over the reference period shall not exceed the normal working hours. b) Summarized recording of working hours shall be adopted by the employer subject to employees representatives view. c) Any crew member shall be relieved of his employment functions once he has worked the established working time rate in the reference period. The exception are cases stipulated by clause 8 of these Regulations. 8. Overtime work can be assigned on direction of the employer with the crew member s written consent in cases stipulated by clauses 1-5 Article 99 of the Labor Code of Russia. a) In other cases overtime work may be assigned with the crew member s written consent and in consideration of employee representatives opinion in order to operate flights associated with carrying passengers, baggage, cargo and mail (hereinafter - delivery flights) and aerial flights. b) Overtime work for each crew member shall not exceed 4:00 over the fixed flight duty time within 2 consecutive days (except for the cases stated by clause 39 of these Regulations), 20:00 per month and 120:00 per year. c) At that, any flight duty period given overtime work may not exceed maximum flight duty period as set by clauses 16, 17 and 41 of these Regulations. The exception are cases stipulated by clause 39 of these Regulations. Page 7

8 RFAR 139.III Flight duty 9. Working time period from the start of pre-flight preparation to the end of post-flight works (hereinafter the flight duty) includes: a) time of procedures related to pre-flight medical examination, customs clearance, border control and execution of flight documentation before flight calculated upon a crew member s attendance for the flight in accordance with the FOM until the start of flight duty time (hereinafter - time of pre-flight preparation); b) time from the engine (engines) start on the aircraft before takeoff until the engine (engines) cut-off after flight - for aircrafts, and from the start of rotary wing blades rotation till their full stop - for helicopters (hereinafter - flight time); c) time of regulated routine break; d) time of short-time breaks; e) time of post-flight works from the end of flight time until the flight duty completion (post-flight works completion) as per FOM; f) time of parking at any off-base airport upon intermediary landings with no crew to be replaced and no facilities for relaxation at a hotel or specialized facilities to be provided which would enable proper undisturbed rest and complying with the applicable sanitary-hygienic requirements (hereinafter conditions for rest); g) time of flight delay without provision of any rest facilities. 10. Duration of pre-flight preparation and post-flight works shall be established in the FOM subject to the operation schedule of preparation of a certain-type aircraft for flight and upon landing. RFAR 139.IV Flight time 11. When operating flights at all types of aircrafts the flight time shall not exceed 80:00 per one calendar month, 240:00 per quarter, 800:00 per calendar year. 12. Duration of the flight time set by clause 11 of these Regulations may be extended up to 9 0:00 per one calendar month, up to 270:00 per quarter and up to 900:00 per calendar year with the crew member s written consent and considering the view of the elected employee representatives. 9 RFAR 139.V Ground working time between flight duties 13. Any crew member may be required to perform some ground work after the flight duty is completed but not earlier than daily rest is over as stated by clauses 55, 56, 57, 59 of these Regulations, and not later than 12-hour rest period prior to the beginning of a regular flight duty. 14. Crew ground working hours between flight duties include: a) time of preliminary preparations for flights, flights debriefing, professional training, practicing on simulators, knowledge assessments, execution of flight and other service documentation, study of documents regulating organization, flight support and operation; b) time of being on duty and on reserve; c) time of staying at an off-base airport as assigned by (on instruction of) the employer in order to further operate a flight assignment (hereinafter - time of waiting for the flight at off-base airports between flight duties) in the amount specified by clause 27 of these Regulations; d) time of aircraft loading and unloading; e) time of performing other employment functions not related to flight assignment. (i) Time of start and end of ground operations specified in sub-clauses а) and f) shall be fixed by a Union Contract or Internal Work Regulations. RFAR 139.VI Flight Duty Period: Minimum Crew: Delivery Operations Flight duty period with minimum crew agreed upon in Aircraft Flight Manual when operating delivery flights 15. Flight duty time with minimum crew agreed upon in Aircraft Flight Manual for the aircraft in question shall be established by the employer subject to base time of attendance for the flight and number of landings scheduled in the flight assignment. a) In doing so, the base time shall imply the local time of a crew member regular work airport (hereinafter - base airport) or the time of off-base airport if the crew member has stayed at an off-base airport for 48:00 or more. 16. Maximum flight duty period of a flight crew member per one day (any consecutive 2 4:00) shall not exceed the values stated in Annexes No. 1-4 of these Regulations. Exception is the cases stipulated by clause 39 of these Regulations. 17. Maximum flight duty period of a cabin crew member per one day (any consecutive 2 4:00) shall not exceed the values stated in Annex No.1 of these Regulations. 10 RFAR 139.VII Flight Duty Period: Augmented Crew: Delivery Operations Flight duty period with increased crew when operating delivery flight 18. In the event a scheduled flight duty period exceeds the maximum permitted one as stated in clauses 16, 17 of these Regulations, the additional flight crew members (hereinafter - increased crew) shall be involved in order to perform crew member functions during a standard routine break. 19. Flight duty period with the increased crew shall be established by the employer subject to the number of additional crew members and landings scheduled by the flight assignment. 20. Maximum flight duty period with the increased crew within 24:00 shall not exceed the values stated in Annex No.5 of these Regulations. Exception is the cases stipulated by clause 39 of these Regulations 21. Number of additional cabin crew members shall be fixed in the FOM and be subject to the following: a) flight duty period and the number of landings; b) type of aircraft; c) types of passenger handling by classes available while in flight (first class, business class, economy class). 22. Flying with the increased crew may only be operated on condition that the additional crew members are provided with the special cabin spaces fitted with armchairs having quick access t o oxygen dispensing equipment. In this case, given the design specifics of a certain aircraft the armchairs in the passenger aircraft cabin shall be isolated from passengers. 23. Time of scheduled routine breaks shall be included in the flight duty time in full. RFAR 139.VIII Working hours when on duty and on reserve 24. The time of being on duty and on reserve includes the time during which a crew member on instruction of the employer stays at the designated place with proper facilities for rest and shall be prepared to perform a flight assignment. 25. Any crew member may be assigned on reserve not more than four times per reference period. Time on duty and on reserve shall not exceed 12:00 within 24:00 consecutive. 26. Time of being on duty and on reserve at the appropriate facilities shall count as working hours in full if the same duties are performed at the place of residence this time counts as at least 25%. a) When called from reserve to perform the flight assignment, the crew member s hours on duty and on reserve shall be registered as working time in the reference period but they shall not be added to the flight duty period. RFAR 139.IX Ground Time between Flights and Delayed Departures Ground working time when waiting for the takeoff from an off-base airport between flight duties and in case of delay. 27. Time of waiting for departure at an off-base airport between flight duty periods shall be included in the hours worked in the amount of 1:00 for every 4:00 of waiting. Time of waiting for the flight at an off-base airport between flight duties shall not include the time of weekly rest stipulated by the flight assignment. 28. Time of flight delay shall be calculated from the time of departure set by the flight assignment to the actual off time. Page 10

11 RFAR 139.X Split Duty: Delivery Operations Working hours and rest time when operating a delivery flight duty split into parts 29. When operating a flight with a minimum crew any crew member s flight duty may be split into 2 parts with his written consent. a) The time of interval between 2 parts of the flight duty shall not be included in the working hours. Dividing a flight duty period into parts shall be made by the employer based on local regulatory document adopted in view of the organization s elected labor union organization. 30. When dividing a flight duty into parts it is permitted to split not more than 2 flight duties within the working time reference period and not more than 2 consecutive flight duties. 31. Overall duration of flight duty period divided into parts shall not exceed the flight duty period duration fixed by clauses 16, 17 of these Regulations. 32. In case of flight duty operated with an increased crew the splitting of the flight duty is not allowed. 33. After 2 consecutive flight duties split into parts have been performed, crew members shall be granted a rest period of at least 48:00 at the base airport. RFAR 139.XI Crew member working hours when transferring as a passenger 34. Time of a crew member transferring (flight or journey) as a passenger, as assigned by (on instruction of) the employer, shall be included in the working hours upon his attendance to the place of departure but not less than 0:40 before the takeoff and until the arrival at the designated location (to rest accommodations). 35. When transferred at the aircraft as a passenger, any crew member may perform, subject to no daily rest, a flight duty of duration not more than that fixed by clauses 16, 17 of these Regulations given the time of attendance for the flight reduced by 50% of travel (flight) time. In doing so, if the specified flight duty period is insufficient for performance of the flight assignment such assignment may be executed by a crew member only after daily rest as stated in clauses 55, 56, 57, 59 of these Regulations. RFAR 139.XII Working hours when performing training and/or practice flights. 36. When performing training and (or) practice flights the following restrictions shall apply with regard to flight duty duration, flight time and number of landing approaches: a) flight duty period shall not exceed 10:00; b) flight time per flight duty shall not exceed 6:00; c) number of landing approaches shall not exceed 25; d) number of landing approaches for aircrafts of fourth class and all types of helicopters shall not exceed 40. 12 RFAR 139.XIII Working hours and rest hours in case of ferrying a malfunctioned aircraft 37. When ferrying a malfunctioned aircraft with no passengers or cargo on-board allowed, a crew member s flight duty period shall not exceed 12: A crew member rest time between flight duties when ferrying a malfunctioned aircraft shall be not less than 10:00, while after ferry the rest time at the base airport shall be not less than 42:00. RFAR 139.XIV Crew members working hours and rest time in case of contingencies 39. In the event of contingencies associated with meteorological conditions, inability to carry out a landing at the airport of destination, failure of aviation equipment in flight and other reasons not scheduled by a flight assignment, the Aircraft Commander has the sole right to extend the set duration of the flight duty to the following extent: a) by 2:00 when the flight duty is carried out with minimum crew; b) by 3:00 when the flight duty is carried out with an increased crew. (i) Decision of the crew flight duty extension shall be registered by the Aircraft Commander by making appropriate entry in the flight assignment. 40. In the event the Aircraft Commander has not used the right to extend flight duty or the exercise of this right does not allow continuing the flight, he is entitled to take a decision to complete the flight duty and provide daily rest for the crew at appropriate facilities. In this case daily rest time set by clause 59 of these Regulations may be reduced but it should be not less than 10:00 with the respective increase of daily rest at the base airport directly after the end of flight duty. 13 RFAR 139.XV Work Limitations and Rest Requirements: Aviation Works Operations Specific features of working hours and rest hours regime of flight crew members when performing aviation works 41. Maximum flight duty duration of a flight crew member shall not exceed: a) 12:00 when performing aviation works; b) 10:00 when performing aerial distribution of chemicals (in case of mineral fertilizers - 12:00). 42. When ferrying an aircraft for repair, from repair to field, from field to the base the duration of such flight duty shall not exceed 12: Any flight crew member when performing aerial works including crop dusting shall be subject to the flight time standards stated by clauses 11, 12 of these Regulations. In doing so, when executing some certain types of aerial works the maximum flight time shall not exceed: a) 4:00 - when flying to distribute highly toxic and poisonous substances (extremely and highly hazardous) a) 4:00 - when reeling out conductive wires; b) 5:00 - when carrying timber on suspending device; c) 5:00 - when performing construction and assembling works; d) 5:00 - when carrying out gravimetrical survey with landings on ice; e) 6:00 - when carrying cargo on store; f) 6:00 - during aerial shooting of wild animals; g) 7:00 - when performing aerovisual, surveying, exploration or rescue fighting works as well as aerial radiation reconnaissance of the terrain and when flying to marine (floating) drilling rigs. (i) To complete the flight duty with a load on store it is permitted to extend flight time by 1 hour. 44. A crew member may perform during one flight duty 2 different types of works specified in subparagraphs a), b), c), d) of clause 43 of these Regulations. a) In such case the maximum aggregate flight duty duration shall be determined in proportion to types of works within rates established by clause 41 of these Regulations. 45. A flight crew member when performing aerial distribution of chemicals shall be subject to the following limits for landings during one flight duty: a) in an aircraft - 45 landings; b) in a helicopter - 55 landings. 46. Duration of the flight crew member continuous stay on field when performing aerial works shall not exceed 15 consecutive calendar days, and when performing aerial distribution of chemicals - 30 consecutive calendar days. 47. In case the term of a crew member continuous stay on field exceeds the standards established b y clause 46 of these Regulations the repeated sending of this crew member to field shall occur no t earlier than in 7 calendar days of his being at the place of regular work. 48. When performing aerial distribution of chemicals the flight duty for a crew member with his consent may be divided into parts with an interval of at least 2:00 between 2 parts. The time of interval between 2 parts of the flight duty shall not be included in the working hours. Dividing a flight duty period into parts shall be made by the employer based on local regulatory document adopted in view of the employee representatives. Overall duration of the flight duty period divided into parts shall not exceed the flight duty period fixed by clauses 41 of these Regulations. 49. The flight crew member shall be subject to short-time breaks of the following duration: a) at least 0:15 every 1:30 of flight time or after 10 landings; b) at least 1:30 every 4:00 of flight time or after 25 landings; in this case such short-time rest may be combined with the relaxation or meal breaks. 50. Any flight crew member shall be subject to weekly uninterrupted rest after 6 consecutive calendar days worked at the base airport or at the place of performing actual activities of 42-hour duration. 14 RFAR 139.XVI Time for obligatory medical clearance 51. The employer ensures provision of the following time periods for crew obligatory medical clearance and examinations (as prescribed by the doctor): a) quarterly medical examination - 2 calendar days; b) semi-annual and annual medical examination - four calendar days. RFAR 139.XVII Rest hours 52. Crew member rest shall imply an uninterrupted ground period of time during which the crew member is relieved of performing any employment functions and he may choose to use this time on his own. 53. Crew members shall benefit from the following varieties of rest: a) daily rest (relaxation between flight duty periods); b) weekly uninterrupted rest (days off) c) annual rest (principal и additional leaves). RFAR 139.XVIII Daily rest 54. Daily rest (relaxation between flight duties) implies an uninterrupted period of time provided to a crew member for efficiency restoration after the regular flight duty. 55. The normal time of rest between flight duties shall be not less than the double time of a completed flight duty and be established subject to the following: a) time of completed flight duty; b) differences in time between base and off-base airports as per Universally Coordinated Time (UTC); c) traffic time at an off-base airport. 56. With the time difference of 4:00 and more as per Universally Coordinated Time (UTC) between base and off-base airports, rest time between flight duties shall be extended by 0:30 per 1:00 of difference in time with the base airport. 57. After staying in time zones where difference in time as per Universally Coordinated Time (UTC) with the base airport is 4:00 and more for 48:00 and longer, rest time after returning to the base airport shall be at least 48: When the traffic time at an off-base airport exceeds 60 minutes the rest period between flight duties shall be extended by the traffic time period corresponding to the period from the moment of a crew member departure after the end of his flight duty till the moment of his accommodation for rest as well as by the time from the crewman departure from the place of rest till the start of pre-flight preparation. 59. As agreed upon with employee representatives the duration of daily rest at the base and off -base airports, subject to the completed flight duty period, may be reduced to minimal daily rest values stated in Annex No.6 with respect for the standards specified by clauses 56, 58 of these Regulations. 60. In case of scheduled early departures and late landings (from 20:00 to 06:00) the employer provides to the crew members at its base airport all facilities and conditions for relaxation and arranges delivery of crew members to/from the airport to their places of residence. 15 RFAR 139.XIX Weekly uninterrupted rest (days off) 61. Weekly uninterrupted rest period shall not be less than 42:00. a) Weekly uninterrupted rest shall be granted as a rule at the place of permanent residence and include 2 home-based nights local time of base airport. 62. Daily uninterrupted rest (days off) may be granted to a crew member at the place of his actual staying when waiting longer periods for a flight (3 days and more) at off-base airports (at field). In such case a crew member s days off shall be registered as an entry to the flight assignment. 63. Weekly uninterrupted rest shall be granted at least in six consecutive working days or 2 consecutive night flight duties. In this case the night flight duty periods are the duties where 50% and more of their time fall on periods from 10 p.m. to 6 a.m. local time of the base airport. RFAR 139.XX Requirements for planning and logging of work and rest hours 64. When working in shifts and on a basis of summarized recording of working time, any crew member shall fulfil his work within the established working hours according to operating schedules. a) Operating schedules shall be drawn up by the employer for at least 1 month in view of employee representatives opinion and be communicated to the crew members 1 month prior to their coming into effect at the latest. If required operationally, it is allowed to amend the operation schedule taking into consideration employee representatives view. At that the specified changes shall be communicated to the crew members not later than 5 days before they are put into effect. 65. The employer shall ensure the accurate recording of overtime works. 66. The employer shall keep records of each crew member working hours and rest hours as follows: a) flight time shall be registered both in the crew flight assignment and flight logbooks; b) flight duty period shall be registered in the flight assignment; c) work, rest and overtime hours shall be registered in the Daily Time Record.
