Each petition for an exemption shall be submitted to the Rules Docket Clerk in accordance with Part 11 Procedures for Making Ordinary Rules and Granting Exemptions. Director's action on external petitions for exemptions 3/EXE/3 Mount Cook Airline Ltd Civil Aviation Rule (f)(1) Use of aerodromes The Director granted an exemption to Mount Cook Airline Limited from requirement in Civil Aviation Rule (f)(1) that each aerodrome that is to be used by an aeroplane that has a certificated seating capacity of more than 30 passengers and is engaged on a regular air transport passenger service, shall be an aerodrome that is associated with a Part 139 certificate, only with respect to charter flights conducted to and from Gisborne aerodrome using ATR 72 aeroplanes for the carriage of NPC rugby teams. This exemption shall remain in effect from 9 August 2002 until 31 October 2002 unless withdrawn earlier in writing by the Director. Dated 7 August /EXE/47 Air Nelson Ltd Civil Aviation Rule (f)(1) Use of aerodromes The Director granted an exemption to Air Nelson Limited from requirement in Civil Aviation Rule (f)(1) that each aerodrome that is to be used by an aeroplane that has a certificated seating capacity of more than 30 passengers and is engaged on a regular air transport passenger service, shall be an aerodrome that is associated with a Part 139 certificate, only with respect to charter flights conducted to and from Gisborne aerodrome using Saab 340 aeroplanes for the carriage of NPC rugby teams. This exemption shall remain in effect from 9 August 2002 until 31 October 2002 unless withdrawn earlier in writing by the Director. Dated 7 August 2002 Notice of intention to withdraw General exemption 01/EXE/25 - requirement for automatic ELTs General exemption 01/EXE/25 was granted on 28 November 2000 to allow pilots of gliders and Pitts Special aeroplanes to operate their aircraft without the fitment of an automatic ELT as required under rule (a). 3 Amendment 7 to Part 91 came into effect on 1 July 2002, and amongst other things, provided greater flexibility in rule regarding the requirement for aircraft to be equipped with an ELT. In the case of gliders and single seat aircraft there is the option for the pilot to carry a portable ELT and if not venturing more than 10 nm from the departure aerodrome then no ELT is required for these aircraft. This amendment to Part 91 now supersedes the need for the exemption and it can be withdrawn. The Director therefore proposes to withdraw exemption 01/EXE/25 with effect from 1 October 2002, as Civil Aviation Rule Part 91 Amendment 7 makes adequate provision for carriage of ELTs by gliders and single seat aircraft. Any comments you may wish to make should be addressed to the Docket Clerk and submitted no later than 20 September Notification of Exemption petition received 3/EXE/6 Rotor Work Ltd Civil Aviation Rule 61.70(a)(1) This petition for exemption is filed for relief from the requirement in Civil Aviation Rule (a)(1) that a pilot must have completed at least 200 hours flight time as a pilot, including at least 100 hours pilot-incommand in the appropriate category of aircraft, before commencing training for an agricultural rating. To qualify for a CPL(A) a pilot must have 200 hours flight time experience with 100 hours pilot-incommand, for a CPL(H) a pilot must have 150 hours flight time and 35 hours pilot-in-command. Therefore the holder of a CPL(A) may commence training for an agricultural rating immediately, while the holder of a CPL(H) must gain an additional 65 hours pilot-in-command flight time before commencing training for an agricultural rating. AC Appendix I suggests that training for an agricultural rating can commence on completion of the flight time experience (normal length course not an approved shortened training course) for the issue of a CPL(A) or CPL(H). However a commercial helicopter pilot is prevented from doing so by CAR (a)(1) requirements. Relief is being sought to enable a pilot who holds a CPL(H) with 160 hours flight time experience, all in helicopters, of which 40 hours in pilot-in-command, to commence training for an agricultural rating. The relief is sought on the basis that there is an inconsistency in the rule between commercial aeroplane and commercial helicopter pilot licence requirements for those pilots wishing to commence training for an agricultural rating. Comments in respect of this exemption petition are invited and are to be made in writing to the Docket Clerk: docket@caa.govt.nz. Quote reference 3/EXE/6. Closing date for comment is 30 September Emergency Rule making activity Under section 31 of the Civil Aviation Act the Director may make emergency Civil Aviation Rules as may be necessary to alleviate or minimise any risk of the death of or serious injury to any person, or of damage to any property. Nil. Rule making activity The statutory power to make Civil Aviation Rules rests with the Minister of Transport under Part 3 of the Civil Aviation Act The CAA is contracted to the Ministry of Transport to develop Rules for the Minister. Under the contract the Minister of Transport approves a programme of new Rules, and changes to existing Rules for the financial year. The programme is based on the CAA proposals and proposals from other interested parties. File Ref. 180 C03 (HMK) 3

Petitions for Rule making 2/PET/6 NZ Parachute Federation The New Zealand Parachute Federation Inc submitted a petition dated 16 May 2002 to propose the following amendment to Part 105- Proposal- amending the current wording of (3) to read all mandatory modifications or instructions issued by the manufacturer or as stated by a parachute organisation. Reason- Information contained in the NZPF submission indicates there exists a safety risk where harness manufacturers issue instructions mandating only their products (such as reserve parachutes or main parachutes) be used with their harnesses. NZPF states the Taupo Tandem fatality was contributed to by one of the manufacturer s instructions being followed. Had the instructions not been followed as now is recommended by the New Zealand Parachute Federation, this fatality may well have been avoided. The NZPF has concerns over the lack of manufacturer response to identified safety concerns when they occur in New Zealand, adopting a do what you want policy to those users outside the US. There is also the perception manufacturers will not acknowledge design deficiencies due to the possibility of legal action arising from such acknowledgements in the US. The NZPF believes that a Parachute Organisation should have the authority to determine whether a manufacturer s instruction is in fact improving safety. CAA comment-the CAA is interested in hearing from parachute users, importers and manufacturers as to the extent of this problem. Possible non-rule remedies could include a tighter control of those parachutes that are approved for use by the NZPF to the extent that manufacturers who fail to deliver meaningful ongoing technical support of their products may have their approval for use withdrawn by the NZPF. The integrity of technical information from equipment manufacturers is a vital link in the safe operation of that equipment. Such action, would be responding in a similar manner to that action that would occur if any other aviation equipment supplier fail to meet minimum standards that have a direct impact on safety. The CAA also believes that where such a rule amendment is made as proposed in this petition, there would be a need for a suitably qualified person within the organisation charged with making the required technical assessments. Such a person would need to be a senior person as described in Part 149 with responsibilities for those technical assessments. A full copy of the petition is available on request to the Docket Clerk. Comment period closed on 3 October Other Rule Activity Notice of proposed rule making (NPRM) CAR Part 125 Air operations Medium aeroplanes Docket 2/CAR/3 NPRM Airborne Collision Avoidance System (ACAS) Docket 2/CAR/8 NPRM Terrain Awareness Warning Systems (TAWS) These two proposals would require medium size (10 to 30 passenger seats, or payload capacity 3410 kg or less and MCTOW greater than 5700kg, or performing a SEIFR operation) turbine powered aeroplanes used on air transport or commercial transport operations to be equipped with ACAS and TAWS systems by various dates up to 1 January File Ref. 180 C03 (HMK) 4

5 The proposals affect all such aeroplanes added to the New Zealand register after the effective date of the rules (expected to be March 2003) and some aeroplanes currently on the New Zealand register. The TAWS proposals, which are only applicable for operations under IFR, also affect piston powered aeroplanes over 5700kg or with 10 or more passenger seats. The specifications of the ACAS and TAWS systems proposed are consistent with ICAO standards. The CAA consider the fitting of this equipment to Part 125 aeroplanes will significantly reduce the risk of mid-air collision or controlled flight into terrain accidents involving these aeroplanes. Both NPRM have been subject to industry consultation through CIRAG Technical Study Group (TSG) meetings since January NPRM and are available on the CAA Web site and on request from the Docket Clerk. Comments on these NPRM are invited and should be sent to the Docket Clerk by 14 October 2002 CAR Part 137 Agricultural Aircraft Operations Docket 1/CAR/ NPRM Agricultural Aircraft Operations re-issue The purpose of this notice of proposed rule making is to provide an opportunity for comment on the proposed changes to the Civil Aviation Rules with respect to agricultural aircraft operations in the New Zealand aviation system. The Civil Aviation Authority (CAA) received two petitions for rule change from the New Zealand Agricultural Aircraft Association (NZAAA). Petition 98/PET/74 sought changes to the jettison requirements contained in Part 137 as the wording implied that each agricultural material s dump time must be tested and recorded. Petition 0/PET/18 sought clarification of the word hazard in rule with respect to agricultural operations over non-populous areas. A technical study group (TSG) comprised of representatives of the CAA and NZAAA was formed in March 2000 to discuss the changes proposed by the two petitions and went on to consider other issues that arose from the meetings. The TSG considered various options to clarify hazard in rule including seeking external legal opinion and Ministry advice. This has resulted in the wording of rule (2) remaining substantially unchanged as it was considered that the rule was drafted appropriately and should pose no interpretation problems. The following is a summary of the changes to Part 137 proposed by NPRM 03-04: (a) Clarification of the criteria for a senior person acting as Chief Pilot for an agricultural aircraft operation. (b) Removal of the inference that jettison capability and associated dump times need to be tested and recorded for each agricultural material dispensed during agricultural aircraft operations. (c) Minor editorial changes to ensure wording is consistent with the current legislative drafting style and to simplify and clarify the rule intent where appropriate. This NPRM also proposes a consequential amendment to Part 1 Definitions and Abbreviations, to amend the definition of an agricultural aircraft operation to exclude activities which are commercial in nature and do not require an agricultural rating. 6 Docket 98/CAR/ Part 71 Designation of airspace: Realignment of the Nadi/Auckland Oceanic FIR Boundary The following Rule amendments came into force on 8 August 2002: Part 71 Amendment 1 and Part 172 Amendment 3. These amended Rules update Part 71 with the amended boundary of the Auckland Oceanic FIR and clarify New Zealand's obligations when an ICAO Contracting State other than New Zealand may be providing an air traffic service in this airspace. These Rule amendments result from the November 2001 ICAO Council approved amendment to the ICAO Air Navigation Plan-Asia and Pacific Region. You can choose to be sent only the information that is relevant to you. CIRAG CIRAG is the acronym for the joint Civil Aviation Authority (CAA) and Industry Rules Advisory Group. It is part of the Rule making process to involve industry representation in the development of new or amended Rules. CIRAG s prime objective is to assess and recommend potential regulatory changes through cooperative Rule making activities. Details about CIRAG s structure and mechanism are available on the CAA web site under the Rules & more heading, or from the Docket Clerk. The CIRAG Executive consists of three AIA/industry members Greg Barrow, Geoff Eban and John Funnell; and three CAA members, Steve Douglas, Peter Blackler and the relevant General Managers of Airlines, General Aviation or Personal Licensing and Aviation Services Groups. The CIRAG Executive last met on 25 July 2002 to review the progress of the various Technical Study Group (TSG) projects. The Minutes of the 14 th Meeting of the CIRAG Executive held 25 July 2002 are available on the CAA Web site. The CIRAG Executive next meets 24 October The CAA CIRAG Web site is continually updated with information on the TSG s projects. Part 21 Certification of aircraft Engine and noise emissions Project No: 99/CAR/1342 Additional Rules to implement the ICAO environmental standards for the certification of aircraft regarding engine emissions (formerly Part 34) and noise emissions (formerly Part 36). The ICAO standards will be incorporated by reference into the Rule. Bill Wilson With the elapse in time since publication of the NPRM, the Draft Final rule has been circulated to aviation organisations with explanatory comments, and seeking views especially from members of those organisations who are new to the industry.
