The associated documents are available under the JAA website at: NPAs NPA Content NPA-FCL 31 proposes the following main changes to JAR-FCL 1: Transposition of the ICAO Annex 1 Standards and Recommended Practices introducing the new Multi crew Pilot License (MPL(A)) into JAR-FCL 1. General The NPA is the standard JAA procedure for consultation with the aviation community. In addition to this JAA process, the National Aviation Authorities may also perform their own consultation. The objective of the NPA consultation is to inform interested parties of the current position and to receive comments on the draft. This means that the draft text is not necessarily the final text. NPA-FCL 31 Transposition of ICAO Annex 1 amendments, including the Multi-crew Pilot Licence, to JAR-FCL 1 JAR-FCL 1 (Aeroplane) EXPLANATORY NOTE Introduction 1. NPA-FCL 31 proposes amendments to the JAR-FCL to ensure JAA Member States will be compliant with the ICAO Standards and Recommended Practices incorporated into the amendments to ICAO Annex 1 as a result of the Flight Crew Licensing and Training Panel recommendations and based on ICAO State Letter AN 12/1.1-05/62, including ICAO Secretariat accepted changes after consultation. 2. The items are: a. the means to approve training courses and licensing requirement for the Multi-crew Pilot Licence (MPL); b. the adoption of elements of the new ICAO PANS-TRG document into the JAR-FCL system; and c. the achievement of appropriate supervision and development of expertise in competence based training. d. The adoption of the ICAO Annex 1 amendment of PIC hours for the CPL(A) and ATPL(A). 3. The introduction of the Multi-crew Pilot Licence MPL(A) provides the aviation community with an opportunity to train pilots directly for co-pilot duties using to a greater extent modern training devices such as flight simulators. The ICAO Standards for the MPL(A) specify the minimum number of actual and simulated flight at 240 hours. However, they do not specify the breakdown between actual and simulated flight hours and thus allow part of the training course that was traditionally conducted on aeroplane to be done on flight simulation training devices. While the airline industry has acquired a considerable experience in the use of flight simulation training devices, the use of such devices in the early phase of airline pilot training has been limited. 4. It is considered that current JAR-FCL requirements for Approved Training Organisations and Quality Systems are fully ICAO Annex 1 compliant. 5. The transposition of the ICAO standards related to the aircraft categories of Powered Lift and Airship do not form part of this NPA, but may be developed under future JAA rulemaking activity. This NPA, which is now presented, results from a discussion paper for a working group of experts from the Authorities of the JAA Member States and Interested Parties, the Ad Hoc Working Group ICAO FCLTP Transposition, for the purpose of advising the Licensing Sectorial Team (LST) on how JAA can best achieve compliance with the new ICAO Standards in Annex 1 adopting the recommendations of the ICAO Flight Crew Licensing and Training Panel (FCLTP). 7. The Ad-hoc Working Group ICAO FCLTP Transposition at its meeting on 29 September 2005 agreed upon the basic concept as laid down in WP JAA LST # 100 with the incorporation of several amendments to the proposed text. 8. The amended proposal, as WP JAA LST # 100a, was presented to the LST during LST meeting # 15 held on November The LST meeting # 16 held on 7-10 February 2006 discussed the proposal from the Ad-hoc Working Group ICAO FCLTP Transposition as JAA Licensing Sectorial Team, JAA LST WP # 100a, and with the incorporation of several text improvements the LST adopted the proposal for NPA. 10. During LST meeting # 17 held on 4 6 April 2006 the draft NPA text was further improved and during the 1 st RST review meeting on 18 April 2006 it was agreed that new AMC FCL 1.310(d) will be developed and appear as a separate NPA on JAR-FCL After the 1 st RST Review and before the start of the consultation period of this NPA the Instructors Competency Working Group finalised the work on AMC FCL 1.310(d). The LST were consulted by written procedure on the AMC and fully supported its late inclusion into the NPA-FCL 31 text. This slightly abbreviated procedure was also agreed by the Chairman of the RST as achieving the best quality draft for consultation. Proposed Amendments to JAR-FCL 1 (Aeroplane) 12. General Requirements JAR-FCL 1 Subpart A - the following modifications are proposed: JAR-FCL 1.001» several new definitons to be added to JAR-FCL for the harmonisation of JAR-FCL and ICAO Annex 1 definitions; JAR-FCL (c)(2)» amendment of JAR-FCL (c)(2), to add a reference to the MPL(A), to align the requirement for the designation of examiners with the ATPL(A); Explanatory Note Consultation Version 4 of 15 (Incorporating Instruction Working Group and Human Factors Steering Group proposals and RIA )

JAR-FCL (a)(2)(ii) and (iii)» amendment to those paragraph to reflect the changes in Appendix 1 to JAR-FCL & 1.165(a)(1) paragraph 13(e) and Appendix 1 to JAR-FCL & 1.165(a)(2) paragraph 12(e) JAR-FCL (d)» new paragraph (d) to JAR-FCL in order to adjust JAR-FCL to address the ICAO proposal on MPL training courses and to allow JAA monitoring; and Appendix 1c to JAR-FCL 1.055» new paragraph (7) to Appendix 1c to JAR-FCL to guarantee that TRE(A) for the MPL(A) skill test are designated and authorised by the approving Authority. 13. Commercial Pilot Licence JAR-FCL 1 Subpart D - the following modifications are proposed: JAR-FCL 1.155» new paragraph (d), the additional requisites, as mentioned in ICAO Annex 1 paragraph , for MPL(A) holder to operate on a singlepilot aeroplane are included in this paragraph. Appendix 1 to JAR-FCL & (a)(1) ATP(A) integrated course» paragraph 13(b) was amended to incorporate ICAO Annex 1 paragraph The reducing to 70 hours pilot-in-command flight experience to obtain a ATPL(A). As a consequence of this amendment paragraphs 13(e) (i) and (ii) were also adjusted. Appendix 1 to JAR-FCL & (a)(2) CPL(A)/IR integrated course» paragraph 12(b) was amended to incorporate ICAO Annex 1 paragraph The reducing to 70 hours pilot-in-command flight experience to obtain a ATPL(A). As a consequence of this amendment paragraphs 12(e) (i) and (ii) were also adjusted. 14. Instrument Rating JAR-FCL 1 Subpart E - the following modifications are proposed: JAR-FCL (b)» this paragraph was amended in order to include a reference to the MPL(A). Appendix 1 to JAR-FCL 1.200» paragraphs 1 (a) and (b) were amended to include a reference to the MPL, this to align with the ATPL(A). 15. Appendix 1 to JAR-FCL & 1.295» Title to be amended, since this Appendix will apply also to cover the skill test for the issue of a MPL(A). Appendix 2 to JAR-FCL & 1.295» Title to be amended, since this Appendix will apply also to cover the skill test for the issue of a MPL(A). 16. Airline Transport Pilot Licence JAR-FCL 1 Subpart G - the following modifications are proposed: JAR-FCL (c)» New paragraph (c) to this requirement to set out the privileges of a holder of an ATPL(A) based on a MPL(A). JAR-FCL (a)» This paragraph was amended to incorporate: o In paragraph (a)(1) references to the now existing EASA CS ; o ICAO A nnex 1 paragraph , the reducing to 70 hours pilot-incommand flight experience to obtain a ATPL(A), in paragraph (a)(2) ; and o Editorial amendment of paragraph (a)(3). JAR-FCL 1.290» This paragraph was amended in order to include a reference to the MPL(A). 17. Instructors Several changes to JAR-FCL 1 Subpart H are proposed to enlarge the privileges of the FI(A), TRI(A), SFI(A) and STI(A) to instruct during the MPL(A). A MPL(A) Instructors Training Course has been developed by the Instructors Competency Working Group taking into account Chapter 4 paragraph 4.1. of the ICAO PANS- TRG document. The objective of this course is to familiarise instructors with the competency based training methodology and the completion of such as course is mandatory for instructors wishing to instruct at a training course with a competency based approach. The structure of the course is set out in new AMC FCL 1.310(d). Since the AMC was agreed by the LST under written procedure, specific comments are requested on this AMC and associated paragraphs. JAR-FCL 1 Subpart H - To introduce the above mentioned changes, the following modifications are proposed: JAR-FCL (d)» new paragraph (d) to stipulate the basic requirements for instructors wishing to instruct at training courses with a competency based training approach and to maintain the MPL(A) instructors qualification. JAR-FCL (a)» The TRI(A) privileges were extended to allow the TRI(A) to instruct during the basic, intermediate and advanced training phases of MPL(A) integrated training course. JAR-FCL 1.405» The SFI(A) privileges were extended to allow the SFI(A) to instruct during the basic, intermediate and advanced training phases of MPL(A) integrated training course. JAR-FCL 1.416» The MCCI(A) privileges were extended to allow the MCCI(A) to instruct during the basic phase of MPL(A) integrated training course. JAR-FCL (a)» The STI(A) privileges were extended to allow the STI(A) to instruct during the core flying skills training phase of MPL(A) integrated training course. Appendix 1 to JAR-FCL 1.310(d)» New Appendix containing the requisites of the MPL(A) Instructors Training Course. This Appendix contains text as proposed by the Instructors Competencies Working Group. AMC FCL 1.310(d)» New AMC containing the structure of the MPL(A) Instructors Training Course. IEM FCL 1.310(d)» New IEM as proposed by the Instructors Competencies Working Group contains a summary of the instructors qualifications required for each phase of the MPL(A) integrated training course. 18. Examiners The TRE(A) privileges have been enlarged to the extent that those examiners are authorised to conduct skill tests for the issue of a MPL(A). JAR-FCL 1 Subpart I - To intro duce the above mentioned change, the following modification is proposed: JAR-FCL (d)» New paragraph to extend the privilieges of a TRE(A) to conduct s kill tests for MPL(A) issue. 19. Theoretical Knowledge Requirements JAR-FCL 1 Subpart J - the following modifications are proposed: JAR-FCL (a)» This paragraph was amended in order to include a reference to the MPL(A). Multi-Crew Pilot Licence For the introduction of the Multi-Crew Pilot Licence into JAR-FCL it is proposed to establish a new Subpart K specially dedicated to this new licence. In addition, several modification are proposed to other Subparts to adjust JAR-FCL to the Competency Based Training concept. This new JAR-FCL 1 Subpart K comprises the following requirements: JAR-FCL 1.500» the minimum age requirement which is aligned with the CPL(A) age requisites in JAR-FCL and ICAO Annex 1 paragraph JAR-FCL 1.505» the MPL(A) being a professional licence a Class 1 medical certificate is required. JAR-FCL 1.510» comprises 2 sub-paragraphs. Sub-paragraph (a) contains the privileges of a MPL(A), and the characteristics are basically to act as co - pilot in an aeroplane required to be operated with a co -pilot and defines also the requirements in case an applicant wants to exercise the IR(A) and CPL(A) privileges in a single-pilot aeroplane. Sub-paragraph (b) defines the conditions under which a MPL(A) may be issued. JAR-FCL 1.515» is composed of 4 sub-paragraphs defining the minimum total flight experience to be gained during the MPL(A) integrated training course and specifiies the conditions. JAR-FCL 1.520» is related to the theoretical knowledge, specifiying that the course shall be approved and be provided at an approved FTO. It also requires that an applicant for a MPL(A) demonstrates the level of theoretical knowledge at ATPL(A) level. Since, the privileges of the MPL(A) is to act as co-pilot in a multi-pilot aeroplane this is in conformity with JAR-FCL paragraph (a)(4) requiring the ATPL(A) theoretical knowledge level as a prerequisite to commence training for a multi-pilot type rating. JAR-FCL 1.525» specifies the required flight instruction, referring to the competency units as mentioned in Appendix 1 to JAR-FCL & paragraph 17 transposed from the ICAO PANS-TRG document. JAR-FCL 1.530» stipulates that for the demonstration of the skills required to comply with all the competency units specified in Appendix 1 to JAR-FCL & and for the issue of a MPL(A), an applicant shall pass the multi-pilot type rating skill test as defined in the Appendices 1 and 2 to JAR- FCL & Appendix 1 to JAR-FCL & 1.525» sets out the MPL(A) integrated training course, designed in the conventional JAR-FCL training course outline, but incorporating new features introducing competence based training in accordance with the ICAO PANS -TRG document. It adds the requirement for there to be a link between the provision of training and an airline operator. Specific comments are requested on the need for additional requirements or guidance material on the content of the arrangement between the FTO and a JAR OPS 1 operator required by Appendix 1 to JAR-FCL 1.310(d), paragraph 3. 12 NPA-FCL 31 - Transposition of ICAO Annex 1 amendments to JAR-FCL 1, including the MPL. It also specifies that information shall be exchanged between NAAs, training organisations, airlines. For this purpose the MPL Advisory Board of the JAA Licensing Sectorial Team shall be established to provide guidance to Authorities and Interested Parties on the implementation and improvement o f the MPL(A) training courses. The establishment of this Board shall be coordinated by Central JAA. The constitution and terms of reference are planned to be developed during The appendix also incorporates an editorial change proposal by the Human Factors Steering Group to adjusting the text of the TEM competency unit and making reference to the IEM FCL No. 2 to Appendix 1 to JAR-FCL & The MPL is based on an integrated process from the first training in the FTO to line flying under supervision with the operator. It is also based on a regular evolution base on the feed back from the operator. Specific comments are requested on the need to complement JAR FCL material by JAR OPS requirement on the operator s responsibilities, notably on the need to report to the FTO and the licensing authority and on the need for specific conversion course for pilots issed from an MPL(A) course. AMC FCL & 1.525» this new AMC contains a copy of the MPL(A) Training Scheme transposed from Attachment A to Chapter 3 of the ICAO PANS-TRG document. IEM FCL No.1 to Appendix 1 to JAR-FCL & 1.525» this new IEM contains a description of the MPL(A) Competency Units as Competency Elements and Performance Criteria transposed from Appendix B to Chapter 3 of the ICAO PANS-TRG document. The IEM also includes some text proposed by the Human Factors Steering Group to ensure consistency with existing JAA human factor principles. Because this text was inserted late in the process, commenters are especially requested to comment on this aspect. IEM FCL No. 2 to Appendix 1 to JAR-FCL & 1.525» this new IEM contains a description of Threat and Error Management (TEM) Concept transposed from Attachment D to Chapter 3 of the ICAO PANS -TRG document. TEM is a new concept in JAA documents. The JAA Human Factors Steering Group raised concerns about how it could be introduced whilst retaining the excellent progress already achieved regarding the treatment of non-technical skills generally and CRM in particular. a full discussion on this issue took place during the Human Factors Steering Group meeting on 9/10 May An agreement was reached with the Licensing Director on the means by which their comments will be addressed during the consultation period and prepared for review by the LST.. The IEM also includes some text proposed by the Human Factors Steering Group to ensure consistency with existing JAA human factor principles. Because this text was inserted late in the process, commenters are especially requested to comment on this aspect. General This NPA contains an alternative route for training pilots as co-pilots in aeroplanes required to be operated with a co-pilot. The conventional way of training using the modular or the ATP(A) integrated training course route will continue to exist, and therefore it will be a matter of choice for the applicant or the airline operator which training route is appropriate to their situation. 22. Issue and Objectives For many years airline operators have indicated their dissatisfaction with the product of existing training schemes whether coming from ab initio integrated or modular training courses. The main criticism has been that classical training courses are not able to make full and best use of improved technology, particularly flight simulation training devices, nor do they equip the pilot trainee for multi-crew operations in a multi-pilot aeroplane. The solution, derived through the work of ICAO s Flight Crew Licensing and Training Panel, was the creation of a new training route to the right hand seat of a modern multi-pilot aeroplane which has been called the Multi-crew Pilot Licence (Aeroplane) or MPL(A). It is important to note that the principal driver for this proposal was to achieve a better quality pilot able to perform more effectively in the multi-crew environment at an equivalent stage of training compared to one who had been trained under existing training courses. It is also important to understand that the MPL(A) training route is complementary to existing routes to a licence and does not replace them. This feature makes it difficult to make a thorough assessment of the impacts of the proposal on the various sectors. In effect, the choice to utilise the MPL(A) route to a licence is a voluntary one at the discretion of the airline operator in conjunction with the training organisation. Time and the analysis of the products of MPL(A) training courses will tell whether the expectation of improved pilot performance is delivered. If a clear performance improvement would be detected then it is likely that, in time, the MPL(A) will become the preferred training route. The sectors of the civil aviation community affected by this proposal are: Flying Training Organisations (FTO), JAR-OPS 1 Operators and their training facilities, Flight Simulation Training Devices (FSTD) manufacturers and operators, National Aviation Authorities and pilot trainees. Of these, the most significant impact initially will be on those FTO which choose to become involved in MPL(A) training. For them, there will be a need for a significant investment in appropriate FSTD and the courseware and qualified instructors needed to support their use. 23. Options Following the anticipated amendment to ICAO Annex 1 introducing the MPL(A), JAA has two options. This would require every JAA Member State to issue a difference from ICAO Annex with regard to the MPL(A). Option 2 is to transpose the MPL(A) as established in ICAO Annex 1 into JAR-FCL as proposed in this NPA. Based on the review of impacts below and on the already high level of interest expressed by sectors of the civil aviation community Option 2 is considered to be the preferred option. 24. Impacts a. Safety While the airline industry has acquired a considerable experience in the use of flight simulation training devices, the use of such devices in the early phase of airline pilot training was limited. The increased use of flight simulation training devices and the introduction of the multi-crew concept at an early stage in abinitio training is intended to improve the performance of pilot students to act as co-pilots in aeroplanes required to be operated with a co -pilot. The introduction of competency based training contributes to an improvement of the assessment process of students by enabling a continuous assessment and documentation of the knowledge and skills acquired. The introduction of the MPL(A) requires a close co-operation between the training organisations and the airline operator. This link will promote the entrance of new flight crew into the airline industry with an enhanced experience in multi-pilot operations and lead to improved quality of training. b. Economic The introduction of this new training concept will demand, in most cases, investments for training organisations, but it is compensated by an anticipated increased quality of the output, better use of the available technology and a reduction of the impact on the environment. c. Harmonisation With the transposition of ICAO Annex 1 amendments and the ICAO PANS -TRG document JAR-FCL 1 will be harmonised with ICAO Annex 1, and enable the JAA Member States to have a common and harmonised approach towards the implementation of those amendments. d. Compliance with ICAO Adoption of these requirements will enable JAA Member States to be fully compliant with the new ICAO Annex 1 SARPS. No difference to ICAO will need to be filled by the JAA Member States on implementation of the requirements. Environmental This proposal enables the increased use of modern training devices such as flight simulators. This reduction of flight hours in aeroplanes for training will help to limit noise and other emissions which have a negative impact on the environment. f. Social No social impact has been identified. 21 JAR FCL Definitions and Abbreviations (See IEM FCL 1.001) New definitions Aircraft required to be operated with a co-pilot. A type of aircraft that is required to be operated with a co-pilot as specified in the flight manual or by the air operator certificate or equivalent document. Airmanship. The consistent use of good judgement and well-developed knowledge, skills and attitudes to accomplish flight objectives. Competency. A combination of skills, knowledge and attitudes required to perform a task to the prescribed standard. Competency element. An action that constitutes a task that has a triggering event and a terminating event that clearly defines its limits, and an observable outcome. Competency unit. A discrete function consisting of a number of competency elements. Credit. Recognition of alternative means or prior qualifications. Cross-Country. A flight between a point of departure and a point of arrival following a pre -planned route using standard navigation procedures. Error. An action or inaction by the flight crew that leads to deviations from organisational or flight crew intentions or expectations. Error management. Consultation Version 3 of 70

Performance criteria. A simple, evaluative statement on the required outcome of the competency element and a description of the criteria used to judge if the required level of performance has been achieved. Co-pilot performing, under the supervision of the pilot-incommand, the duties and functions of a pilot-in-command, provided that the method of supervision employed is acceptable to the Authority. Threat. Events or errors that occur beyond the influence of the flight crew, increase operational complexity and which shall be managed to maintain the margin of safety. Threat management. 23 JAR FCL Arrangements for testing Amendment to paragraph (c)(2) (c) Notification of examiners. (1) The Authority will maintain a list of all examiners it has authorised stating for which roles they are authorised. The list will be made available to TRTOs, FTOs and registered facilities within the JAA Member State. The Authority will determine by which means the examiners will be allocated to the skill test. (2) Pilot-in-command or under instruction (i) An applicant for a licence or rating is credited in full with all solo, dual instruction or pilot-in-command flight time towards the total flight time required for the licence or rating. (ii) A graduate of an airline transport pilot integrated flying training course is entitled to be credited with up to hours of student pilot-in-command instrument time towards the pilot-incommand time required for the issue of the airline transport pilot licence, commercial pilot licence and a multi-engine type or class rating. (iii) A graduate of a CPL/IR integrated flying training course is entitled to be credited with up to hours of the student pilot-in-command instrument time towards the pilot-incommand time required for the issue of the commercial pilot licence and a multi-engine type or class rating. THEORETICAL KNOWLEDGE Training for theoretical knowledge may be given at a FTO conducting approved training outside the JAA Member States. Within the total of 195 hours, applicants shall complete at least: (a) 95 hours of dual instruction of which up to 55 hours may be instrument ground time; (b) hours as pilot-in-command including 50 hours VFR flight and 50 hours instrument flight time as student pilot-in-command (SPIC). (SPIC time shall be credited as pilot-in-command time, unless the flight instructor had to influence or control any part of the flight. A ground de-briefing by the flight instructor does not affect the crediting as pilot-in-command time); (c) 50 hours of cross-country flight as pilot-in-command including a VFR cross-country flight totalling at least 540 km (300 NM) in the course of which full stop landings at two aerodromes different from the aerodrome of departure shall be made; (d) 5 hours flight time in aeroplanes shall be completed at night comprising 3 hours of dual instruction including at least 1 hour of cross-country navigation and 5 solo take-offs and 5 solo full stop landings; and (e) 115 hours of instrument time comprising: (i) at least 50 hours of instrument flight instruction of which up to 25 hours may be instrument ground time in a FNPT I, or 40 hours if the instrument ground training is conducted in an FNPT II or flight simulator. With the agreement of the approving Authority not more than 10 hours of FNPT II or flight sim ulator instrument ground time may be conducted in a FNPT I. (ii) hours as SPIC; and (iii) 15 hours multi-crew co-operation, for which a flight simulator or FNPT II may be used. See AMC -FCL & 1.165(a)(1) for the flight instruction syllabus. (b) ground: all information relevant to the accomplishment of a flight, e.g. * be able to read and demonstrate an understanding of technical manuals written in English, e.g. an Operations Manual, an Aeroplane Flight Manual, etc. * pre-flight planning, weather information collection, NOTAMs, ATC Flight Plan, etc. * use of all aeronautical en-route, departure and approach charts and associated documents written in English. This item in considered to be fulfilled, if the applicant has graduated from an IR, MPL or ATP course given in English or if he has passed the theoretical IR or ATPL examination in English. (c) communication: be able to communicate with other crew members in English during all phases of flight, including flight preparation This item is considered to be fulfilled, if the applicant for or the holder of an IR(A) has graduated from an MCC course given in English and is holding a certificate of satisfactory completion of that course in accordance with JAR -FCL 1.250(a)(3) or if he has passed a multi-pilot skill test/proficiency check in accordance with Appendix 1 to JAR -FCL & 1.295, during which the two-way radiotelephony communication and the communication with other crew members are performed in English. 2 Alternatively, the above stated requirements may be demonstrated by having passed a specific examination given by or on behalf of the Authority after having undertaken a course of training enableing the applicant to meet all the objectives liste d in 1(a), (b) and (c) above. Subject to any other conditions specified in JARs, the privileges of the holder of an ATPL(A) are to: (1) exercise all the privileges of the holder of a PPL(A), a CPL(A) and an IR(A); and (2) act as pilot-in-command or co-pilot in aeroplanes engaged in air transportation. (b) Conditions. An applicant for an ATPL(A) who has complied with the conditions specified in JAR FCL 1.265, and through shall have fulfilled the requirements for the issue of an ATPL(A) containing a type rating for the aeroplane type used on the skill test.
