2 2. Definitions See BL 7-10, Regulations on definitions regarding air traffic service. 3. Applicability This BL lays down regulations on provision of air traffic services within Danish territory and within areas where Denmark according to international agreements is under the obligation to provide air traffic services. Note 1: Regulations on establishment of air traffic services for public aerodromes are in BL Note 2: Regulations on operation of air traffic services units are in BL General 4.1 Air traffic services shall be arranged in accordance with the regulations in this BL and shall be provided in accordance with the ATS instructions laid down in pursuance the BL and BL The Civil Aviation Administration - Denmark a. lays down ATS instructions for provision of air traffic services, including for 1. cooperation between air traffic services units, 2. critical situations etc., cf. Part 10, 3. passing on of meteorological information to the meteorological office, cf. Part 11, 4. passing on of information of importance for the safe performance of a flight to the aeronautical information service (AIS), cf. Part 12, 5. cooperate with military authorities, cf. Part 13, and 6. coordination of activities that may be hazardous to aviation, cf. Part 14, and b. prepares agreements with ATS authorities in adjacent flight information regions regarding provision of air traffic services. Note: As regards the responsibility of the daily manager of the air traffic services personnel, reference is made to BL Air traffic services units shall use Universal Time Coordinated (UTC) and shall express the time in hours and minutes and, when required, seconds of the 24-hour day beginning at midnight. 4.4 Air traffic services unit clocks and other time-recording devices shall be checked as necessary to ensure correct time to within plus or minus 30 seconds of UTC. Whenever data link communications are utilized by an air traffic services unit, correct time to within 1 second of UCT shall be ensured. 4.5 Communication between foreign and Danish air traffic services units shall be in English. 4.6 Communication between Danish air traffic services units mutually shall be either in English or in Danish. 5. Division and objectives of the air traffic services 5.1 The air traffic services shall comprise the following: The air traffic control service which is divided in three parts as follows: a. Area control service: The provision of air traffic control service with the objective to 1. prevent collisions between aircraft and BL 7-6 / Edition 6 / / 2

3 2. expedite and maintain an orderly flow of air traffic. This service is provided for controlled flights, except for those parts of such flights described in Approach control service and Aerodrome control service, cf. b. and c. b. Approach control service: The provision of air traffic control service with the objective to 1. prevent collisions between aircraft and 2. expedite and maintain an orderly flow of air traffic. This service is provided for those parts of controlled flights associated with arrival or departure. c. Aerodrome control service: The provision of air traffic control service with the objective to 1. prevent collisions between aircraft, 2. prevent collisions between aircraft on the manoeuvring area and obstructions on that area, and 3. expedite and maintain an orderly flow of air traffic. This service is provided for aerodrome traffic, except for those parts of flights for which approach control service is provided Flight information service, including aerodrome flight information service, provided with the objective to advice and provide information useful for the safe and efficient conduct of flights Alerting service which shall be provided with the objective to notify the flight information centre or area control centre and rescue coordination centre, and to give these the immediate assistance required. 6. Classification of airspaces 6.1 ATS airspaces shall be classified and designated in accordance with the following: Class A. IFR flights only are permitted. All flights are provided with air traffic control service and are separated from each other. Class B. IFR and VFR flights are permitted. All flights are provided with air traffic control service and are separated from each other. Class C. IFR and VFR flights are permitted. All flights are provided with air traffic control service and IFR flights are separated from other IFR flights and from VFR flights. VFR flights receive traffic information in respect of other VFR flights. Class D. IFR and VFR flights are permitted. All flights are provided with air traffic control service. IFR flights are separated from other IFR flights and receive traffic information in respect of VFR flights. VFR flights receive traffic information in respect of all other flights. Class E. IFR and VFR flights are permitted. IFR flights are provided with air traffic control service and are separated from other IFR flights. All flights receive traffic information as far as practical. Class E shall not be used for control zones. Class F. IFR and VFR flights are permitted. All participating IFR flights receive an air traffic advisory service. All flights receive flight information service if requested. Class G. IFR and VFR flights are permitted and receive flight information service if requested. 6.2 The requirements for flights within each class of airspace and information on provision of service are as indicated in the below table: BL 7-4 / Edition 1 / / 3

5 6.2.1 Where the ATS airspaces adjoin vertically, i.e. one above the other, flights at a common level shall comply with the requirements of, and be given services applicable to, the less restrictive class of airspace. In applying these criteria, Class B airspace is therefore considered less restrictive than Class A airspace; Class C airspace less restrictive than Class B airspace, etc. 7. Air traffic control service 7.1 Application Air traffic control service shall be provided to a. all IFR flights in airspace Classes A, B, C, D and E, b. all VFR flights in airspace Classes B, C and D, c. all special VFR flights and d. all aerodrome traffic at controlled aerodromes. 7.2 Provision of air traffic control service Area control service shall be provided a. by an area control centre, or b. by the unit providing approach control service in a control zone or in a control area of limited extent which is designated primarily for the provision of approach control service Approach control service shall be provided a. by an aerodrome control tower or area control centre, or b. by an approach control unit when it is necessary or desirable, cf. BL Aerodrome control service shall be provided by an aerodrome control tower. Note: The task of providing apron management service may be assigned to an aerodrome control tower or to a separate unit. 7.3 Operation of air traffic control service In order to provide air traffic control service, an air traffic control unit shall a. be provided with information on the intended movement of each aircraft and with current information on the actual movements of each aircraft, b. determine from the information received, the relative positions of known aircraft to each other, c. issue clearances and information for the purpose of preventing collision between aircraft under its control and of expediting and maintaining an orderly flow of traffic, and d. coordinate clearances with other units, 1. whenever an aircraft might otherwise conflict with traffic operated under the control of such other units, and 2. before transferring control of an aircraft to such other units Information on aircraft movements, together with a record of air traffic control clearances issued to such aircraft, shall be so displayed as to permit ready analysis in order to maintain an efficient flow of air traffic with adequate separation between aircraft Clearances issued by air traffic control units shall provide separation a. between all flights in airspace Classes A and B, BL 7-4 / Edition 1 / / 5

6 b. between IFR flights in airspace Classes C, D and E, c. between IFR flights and VFR flights in airspace Class C, d. between IFR flights and special VFR flights, and e. between special VFR flights. However, when requested by an aircraft, an IFR flight in airspace Classes D and E may be cleared without separation being so provided in respect of a specific portion of the flight conducted in visual meteorological conditions and below FL Separation shall be obtained by at least one of the following: a. Vertical separation, obtained by assigning different flight levels from the tables of cruising levels in BL However, the correlation of levels to track shall not apply whenever otherwise indicated in the appropriate AIP or in the clearance. b. Horizontal separation, obtained by providing 1. longitudinal separation, by maintaining an interval between aircraft operating along the same, converging or reciprocal tracks, expressed in time or distance, or 2. lateral separation, by maintaining aircraft on different routes or in different geographic areas. c. Composite separation, consisting of vertical separation and horizontal separation. Composite separation shall only be applied on the basis of regional air navigation agreements. 7.4 Separation minima The separation minima for application within a given airspace shall be in accordance with the separation minima prescribed in ICAO DOC 4444 or regional air navigation agreements The selection of separation minima shall be made in consultation between the appropriate ATS authorities responsible for the provision of air traffic services in neighbouring airspace when a. traffic will bass from one into the other of the neighbouring airspaces, or b. routes are closer to the common boundary of the neighbouring airspaces than the separation minima applicable in the circumstances Details of the selected separation minima and of their areas of application shall be notified to the ATS units concerned and in AIP. 7.5 Responsibility for control A controlled flight shall be under the control of only one air traffic control unit at any given time Responsibility for the control of all aircraft operating within a given block of airspace shall be vested in a single air traffic control unit. However, control of the aircraft or groups of aircraft may be delegated to other air traffic control units provided that coordination between all air traffic control units concerned is assured. 7.6 Transfer of responsibility for control Regulations on transfer of control and communication shall be specified in agreements between the individual air traffic services units and shall be included in the local ATS instructions. 7 7.7 Clearances Clearances shall be issued with the purpose of meeting the requirements for providing air traffic control service and flow control Contents of clearances A clearance shall indicate a. aircraft identification as shown in the flight plan, b. clearance limit, c. route of flight, d. level(s) of flight for the entire route or part thereof and changes of levels if required, e. period of time within which the aircraft shall take-off or pass a specified position (SLOT), if allocated, and f. any necessary instructions or information on other matters such as approach or departure manoeuvres, communications and the time of expiry of the clearance Clearances for supersonic flight Clearances for supersonic flight over Danish area must not be given. Note: Danish area includes Danish territory, including Danish territorial waters Clearance relating to the acceleration of an aircraft from subsonic cruise to supersonic flight shall extend at least to the end of the acceleration phase Clearance relating to the deceleration of an aircraft from supersonic cruise to subsonic flight shall extend at least to end of the deceleration phase Coordination of clearances A clearance shall be coordinated between air traffic control units to cover the entire route of an aircraft or a specified portion thereof, cf. paragraphs An aircraft shall be cleared for the entire route to the aerodrome of first intended landing when a. it has been possible, prior to departure, to coordinate the clearance between all the units under whose control the aircraft will come, or b. there is reasonable assurance that prior coordination will be effected between those units under whose control the aircraft will subsequently come When coordination as in has not been achieved or is not anticipated, the aircraft shall be cleared only to that point where coordination is reasonably assured. Prior to reaching such point, or at such point, the aircraft shall receive further clearance, holding instructions being issued as appropriate When prescribed in the ATS instructions, an aircraft shall be requested to contact a downstream air traffic control unit, for the purpose of receiving a downstream clearance prior to the transfer of control point. Note: Aircraft shall maintain the necessary two-way communication with the current air traffic control unit whilst obtaining a downstream clearance A clearance issued as a downstream clearance shall be clearly identifiable as such to the pilot When an aircraft intends to depart from an aerodrome within a control area to enter another control area within a period of thirty minutes, or such other specific period of time as has been agreed between the area control centres concerned, coordination with the subsequent area control centre shall be BL 7-4 / Edition 1 / / 7

8 effected prior to issuance of the departure clearance When an aircraft intends to leave a control area for flight outside controlled airspace, and will subsequently re-enter the same or another control area, a clearance from point of departure to the aerodrome of first intended landing may be issued. Such clearance shall apply only to those portions of the flight conducted within controlled airspace and implies coordination with subsequent air traffic services units. 7.8 Air traffic flow management Air traffic flow management shall be implemented for airspace where air traffic demand at times exceeds, or is expected to exceed, the declared capacity of the air traffic control services concerned. Note: The mentioned capacity will be declared by Naviair When it becomes apparent to an air traffic control unit that traffic additional to that already accepted cannot be accommodated within a given period of time at a particular location or in a particular area, that unit shall no advise the air traffic flow management unit (ATFM unit), when such is established, as well as air traffic services units concerned. Flight crews of aircraft destined to the location or area in question shall also be advised of the delays expected or the restrictions that will be applied. 7.9 Control of persons and vehicles The movement of persons or vehicles, including towed aircraft, on the manoeuvring area may only take place after permission from the aerodrome control tower In conditions where low visibility procedures are in operation, b. particular regard shall be given to the requirements to protect the instrument landing system s sensitive areas when Category II or Category II operations are in progress, and c. minimum separation between vehicles and taxiing aircraft may be required The criteria for making use of the special procedures and minimum separation shall be included in the local ATS instructions Traffic on the manoeuvring area shall take place in accordance with the aerodrome regulations. Unless otherwise instructed by the aerodrome control tower, the following rules shall be complied with, cf., however, paragraph 7.9.4: a. All traffic shall give way to aircraft manoeuvring by its own power. b. All other traffic than the one mentioned in a., shall give way to persons and vehicles guiding an manoeuvring vehicle. c. Traffic between a manoeuvring aircraft and persons or vehicles guiding the aircraft shall be prohibited. d. All other traffic than the one mentioned in a. and b. shall give way to aircraft being towed. e. All other traffic than the one mentioned in a., b. and d. shall give way to emergency vehicles and piloting vehicles proceeding to the assistance of an aircraft in distress Emergency vehicles and piloting vehicles proceeding to the assistance of an aircraft in distress shall be afforded priority over all other surface movement traffic. a. the number of persons and vehicles on the manoeuvring area shall be restricted to the essential minimum, BL 7-6 / Edition 6 / / 8

9 7.10 Provision of radar Radar systems used in connection with provision of air traffic control service shall display the following safety-related alerts: a. Warning regarding i. interrupted tracking ( frozen radar image ), ii. iii. use of the SSR codes used in connection with emergency situations and other abnormal situations, and drop-out of the radar sources used by the chosen radar display. b. Conflict alert and conflict prediction. c. Minimum safe altitude warning. d. Warning of unintentionally duplicated SSR codes. 8. Flight information service 8.1 Application Flight information service shall be provided to all aircraft which are likely to be affected by the information, cf. paragraph 8.2, and which are a. provided with air traffic control service, or b. otherwise known to the relevant air traffic services units Where air traffic services units provide both flight information service and air traffic control service, the provision of air traffic control service shall have precedence over the provision of flight information service whenever the provision of air traffic control service so requires. However, aircraft on final approach, landing, take-off and climb may require flight information service before air traffic control service. 8.2 Scope of flight information service Flight information service shall include the provision of a. SIGMET and AIRMET information, b. information concerning pre-eruption volcanic activity, volcanic eruptions and volcanic ash clouds, c. information concerning the release into the atmosphere of radioactive materials or toxic chemicals, d. information on changes in the serviceability of navigation aids, e. information on changes in condition on aerodromes and associated facilities, including information on the state of the aerodrome movement areas when they are affected by snow, ice or water, f. information on unmanned free balloons, or g. any other information likely to affect safety Flight information service provided to flights shall include, in addition to that outlined in 8.2.1, the provision of information concerning: a. Weather conditions reported or forecast at departure, destination and alternate aerodromes. b. Collision hazards to aircraft operating in airspace Classes C, D, E, F and G Flight information service provided to VFR flights shall include, in addition to that outlined in 8.2.1, the provision of available information concerning traffic and weather conditions along the route of flight that are likely to make operation under the visual flight rules impracticable. 10 8.2.4 Air traffic services units shall transmit, as soon as practicable, reports on other conditions of significance to the handling of air traffic (special air-reports) to other aircraft concerned, to the associated meteorological office, and to other air traffic services units concerned. 8.3 Automatic terminal information service - ATIS ATIS shall be provided at aerodromes where there is a requirement to reduce the communication load on the air traffic service s VHF channels. When established it shall be as Voice-ATIS that may be supplemented by data link ATIS (D-ATIS) ATIS shall comprise: a. One broadcast serving arriving aircraft, or b. one broadcast serving departing aircraft, or c. one broadcast serving both arriving and departing aircraft, or d. two broadcasts serving arriving and departing aircraft respectively at those aerodromes where the length of a broadcast would be excessively long Voice-ATIS broadcasts should not, if possible, exceed a duration of thirty seconds with due regard to the interpretation of the ATIS report not being depreciated because of the transmission speed. 9. Alerting service 9.1 Application Alerting service shall be provided to a. all aircraft having filed a flight plan, and b. any other aircraft known to the air traffic service to need such service as a consequence of conditions leading directly to the critical phases mentioned in a., b. and c The flight information centre or area control centre shall serve as central point for collecting all information relevant to the stat of emergency of an aircraft operating within the area of responsibility, and for forwarding such information to the appropriate rescue coordination centre In the event an air traffic service unit becomes aware of an aircraft being in a critical situation, the unit shall notify immediately the flight information centre or area control centre which shall in turn notify the rescue coordination centre. Notification of flight information centre, control centre, or rescue coordination centre shall not be required when the nature of the critical situation is such that the notification would be superfluous Notwithstanding the air traffic service unit shall, whenever the urgency of the situation so requires, first implement the local alarm plan. 9.2 Notification of rescue coordination centre The flight information centre or control centre shall notify the rescue coordination centre immediately an aircraft is considered to be in a state of emergency in accordance with the following: a. Uncertainty phase (INCERFA) when: 1. no communication has been received from an aircraft within a period of thirty minutes after the time a communication should have been received, or from the time an unsuccessful attempt to establish communication with such aircraft was first made, whichever is the earlier, or when 2. an aircraft fails to arrive within thirty minutes of the estimated BL 7-6 / Edition 6 / / 10

11 time of arrival last notified to or estimated by the air traffic service unit, whichever is the later. b. Alert phase (ALERFA) when: 1. following the uncertainty phase, subsequent attempts to establish communication with the aircraft or inquiries to other relevant sources have failed to reveal any news of the aircraft, or when 2. an aircraft has been cleared to land and fails to land within five minutes of the estimated time of landing and communication has not been re-established with the aircraft, or when 3. information has been received which indicates that the operating efficiency of the aircraft has been impaired, but not to the extent that a forced landing is likely, or when 4. an aircraft is known or believed to be the subject of unlawful interference. c. Distress phase (DESTRESFA) when: 1. following the alert phase, further unsuccessful attempts to establish communication with the aircraft and more widespread unsuccessful inquiries point to the probability that the aircraft is in distress, or when 2. the fuel on board is considered to be exhausted, or to be insufficient to enable the aircraft to reach safety, or when 3. information is received which indicates that the operating efficiency of the aircraft has been impaired to the extent that a forced landing is likely, or when 4. information is received or it is reasonably certain that the aircraft is about to make or has made a forced landing The notification to the rescue coordination centre shall contain such of the following information as is available in the order listed: a. INCERFA, ALERFA or DETRESFA, as appropriate to the phase of the emergency. b. agency and person calling, c. nature of the emergency, d. significant information from the flight plan, e. unit which made last contact, time and means used, f. last position report and how determined, g. colour and distinctive marks of aircraft, h. dangerous goods carried as cargo, i. any action taken by reporting office, and j. other pertinent remarks Further the rescue coordination centre shall, without delay, be furnished with any useful additional information, especially on the development of the state of emergency through subsequent phases; or information that the emergency situation no longer exists. The cancellation of action initiated by the rescue coordination centre is the responsibility of that centre Information given to the rescue coordination centre by a control centre or a flight information centre shall be passed on to the air operator, if relevant. 12 10. Critical situations etc An aircraft known or believed to be in a state of emergency, including being subjected to unlawful interference, shall be given maximum consideration, assistance and priority over other aircraft as may be necessitated by the circumstances When an occurrence of unlawful interference with an aircraft takes place or is suspected, air traffic service units shall attend promptly to requests by the aircraft. Information pertinent to the safe conduct of the flight shall continue to be transmitted and necessary action shall be taken to expedite the conduct of all phases of the flight, especially the safe landing of the aircraft Procedures shall be established regarding strayed or unidentified aircraft When the situation is deemed to be critical the flight path of the aircraft shall be marked on a map or registered in another way so that the aircraft s future likely position as well as the maximum flight distance to the last known position can be estimated. If deemed necessary flight paths for other aircraft being close to the aircraft in question shall also be registered in order to estimate their future likely positions and maximum action time All available communication aids shall be used in the effort of establishing and maintaining contact with an aircraft in a critical situation, and of obtaining information regarding the aircraft When an occurrence of unlawful interference is presumed to have taken place against an aircraft, the nature of the critical situation must not be mentioned on radio telephony unless it was mentioned by the aircraft in question earlier during the radio communication, and it is certain that such mention will not worsen the situation. 11. Passing on of meteorological information to the meteorological office 11.1 To ensure that aircraft receive the most up-to-date meteorological information for aircraft operations, arrangements shall be made ensuring air traffic services personnel to report as soon as possible to the associated meteorological office information on a. such meteorological elements observed by air traffic services personnel or communicated by aircraft as may be agreed upon, b. meteorological phenomena of operational significance observed by air traffic services personnel or communicated by aircraft which have not been included in the aerodrome meteorological report, and c. pre-eruption volcanic activity, volcanic eruptions and volcanic ash cloud. The appropriate area control centre and flight information centre shall report this information to the associated meteorological watch office and volcanic ash advisory centres Close coordination shall be maintained between area control centre, flight information centre and the associated meteorological watch office to ensure that information on volcanic ash included in NOTAM and SIGMET messages is consistent. 12. Passing on information to the aeronautical information services (AIS) To ensure that the aeronautical information services obtain information to enable them to provide up-to-date pre-flight information and to meet the need for in-flight information, arrangements shall be made ensuring the air traffic services personnel to report, unless otherwise determined by local agreements, to the aeronautical information services with a minimum of delay BL 7-6 / Edition 6 / / 12

13 a. information on aerodrome conditions, b. the operational status of associated facilities, services and navigation aids within their area of responsibility, c. the occurrence of volcanic activity observed by air traffic services personnel or reported by aircraft, and d. any other information considered to be of operational significance. 13. Cooperation with military authorities 13.1 Air traffic services authorities shall establish and maintain close cooperation with military authorities responsible for activities that may affect flights of civil aircraft Arrangements shall be made to permit information relevant to the safe and expeditious conduct of flights of civil aircraft to be promptly exchanged between air traffic services units and appropriate military units Locally agreed procedures shall be established for providing, either routinely or on request, the military units with pertinent flight plan and other data concerning flights of civil aircraft Special procedures shall be established in order to ensure that a. air traffic services units are notified if a military unit observes that an aircraft which is, or might be, a civil aircraft is approaching, or has entered, any area in which interception might become necessary, and b. all possible efforts are made to confirm the identity of the aircraft and to provide it with the navigational guidance necessary to avoid the need for interception. 14. Coordination of activities potentially hazardous to civil aircraft 14.1 Arrangements for activities potentially hazardous to civil aircraft shall be coordinated early enough to permit timely promulgation of information regarding the activities in accordance with the provisions of Annex 15. The objective of the coordination shall be to achieve the best arrangements which will avoid hazards to civil aircraft and minimize interference with the normal operations of such aircraft In determining these arrangements the following should be applied: a. Unless no other options exist, the locations or areas, times and durations for the activities shall be selected to avoid 1. closure or realignment of established ATS routes, 2. blocking of the most economic flight levels and 3. delays of scheduled aircraft operations. b. The size of the airspace designated for the conduct of the activities shall be kept as small as possible. c. Direct communication with the organization or unit conducting the activities shall be provided for use in the event that emergencies or other unforeseen circumstances require discontinuation of the activities Measures shall be taken to prevent that any laser beam sent out causes inconvenience for air traffic. 14 15. Exemption The Civil Aviation Administration - Denmark may in particularly exceptional cases grant exemption from the regulations in this BL when it is deemed compatible with the considerations on which the regulations in question are based. 17. Implementation 17.1 This BL comes into force on 27 November At the same time BL 7-6, 5 edition of 11 April 2000 with later amendments are repealed. 16.
